Kendig: The City Council unanimously denied Claim No. 17-19. Other than that, there was no reportable action. PRESENTATIONS — Mayor Bernstein presented a Certificate of Recognition to Donna Marsh Peery in honor of being named a Gem of Tustin. Orange County Fire Authority Division Chief Andy Kovacs introduced himself to the City Council and Tustin community. ORAL COMMUNICATION/PUBLIC INPUT — 1. John Garay 2. Kara Sandaval It was moved by Mayor Pro Tem Murray and seconded by Councilmember Gomez to pull Item No. 6 and move the balance as recommended by staff. Motion carried: 4-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. City Council June 6, 2017 Meeting Minutes Page 3 of 14 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL HELD ON MAY 16, 2017. Motion: That the City Council approve the Action Minutes of the Regular Meeting of the City Council held on May 16, 2017. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: That the City Council approve Payroll in the amount of$702,978.24 and $732,736.69; and Demands in the amount of$6,913,631.91. 4. ADOPT RESOLUTION NO. 17-20 ORDERING THE SUMMARY VACATION OF "OLD" DEL AMO AVENUE BETWEEN "NEW" NEWPORT AVENUE AND "NEW" DEL AMO AVENUE The Newport Avenue/SR-55 Ramp Reconfiguration Project (CIP No. 70130) realigned Del Amo Avenue, constructed Newport Avenue between Edinger Avenue and Valencia Avenue, and relocated the northbound on/off ramp to SR - 55. "Old" Del Amo Avenue is no longer needed as a street and can be vacated. Motion: That the City Council adopt Resolution No. 17-20 ordering the summary vacation of "Old" Del Amo Avenue between "New" Newport Avenue and "New" Del Amo Avenue. RESOLUTION NO. 17-20 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, TO SUMMARILY VACATE AND ABANDON "OLD" DEL AMO AVENUE BETWEEN "NEW" NEWPORT AVENUE AND "NEW" DEL AMO AVENUE 5. FOURTH AMENDMENT TO CONTRACT WITH CR&R INCORPORATED FOR SOLID WASTE AND RECYCLING SERVICES CR&R Incorporated (CR&R) is the City's exclusive provider for solid waste and recycling services. The contract between the City and CR&R is set to expire on September 30, 2017. The City is preparing a Request for Proposals (RFP). CR&R has agreed to extend the current contract through September 30, 2018 to ensure the City has sufficient time to finalize the RFP, solicit and review proposals, and award a new contract. Motion: That the City Council: 1. Approve the Fourth Amendment to the Contract for the Collection, City Council June 6, 2017 Meeting Minutes Page 4 of 14 Transportation and Disposal of Municipal Solid Waste and for the Collection, Transportation, Processing and Diversion of Recyclable Materials; and 2. Authorize the Mayor and City Clerk to execute the amendment on behalf of the City. 6. ON-STREET PARKING IN OLD TOWN RESIDENTIAL AREA PowerPoint presentation by Principal Planner Scott Reekstin. During the past several years, Old Town residents have expressed concerns about the impacts related to an increase to on-street parking in the Old Town residential area. Concerns were expressed at the various public workshops and public hearings held on the subject of second residential units in Old Town Tustin in 2013, 2014, and 2015, and when the Vintage residential project was considered and approved in 2016. To address these concerns, the City Council directed staff on September 15, 2015, and November 15, 2016, to take several actions including: the facilitation of permit parking requests; increased enforcement; an updated overnight vehicle count; a resident survey; a community workshop; meeting with apartment managers; studying potential parking impacts in conjunction with the proposed Downtown Commercial Core Plan; and outreach to the Tustin Acres community. The City Council also directed staff to report back with its findings and to recommend a strategy for the Council's consideration. This report summarizes: 1) the ongoing concerns related to on-street parking in the Old Town residential area; 2) the City's 2015 and 2016 Old Town on-street parking counts and findings; 3) public outreach undertaken to address the issue; and, 4) recommendations of additional actions for the Council's consideration. It was moved by Councilmember Clark and seconded by Councilmember Gomez to direct staff to take the following actions to address the issue of on—street parking in the Old Town residential area: 1. Mail a summary of a proposed Old Town residential area permit parking policy and a ballot/petition (Attachment A of the staff report) by certified mail to all owners of property and tenants within the Old Town residential parking study area (Attachment B of the staff report), including single and multiple family residential property owners; and, 2. Report back to the City Council with the results of the ballot/petition to provide the basis for a recommended strategy for Council consideration. JOHN WAYNE AIRPORT NOISE ABATEMENT QUARTERLY REPORT This agenda report transmits the John Wayne Airport (JWA) Noise Abatement Quarterly Report for the fourth quarter of 2016. The average noise level measured at Tustin's monitoring station (NMS 1ON), located at Columbus Tustin Middle School on Beneta Way (Figure 1), remained consistent with prior quarters during this fourth quarter reporting period. Average noise levels during the fourth quarter remained well below the City, County, and State criteria of 65 dB Community Noise Equivalent Level (CNEL) for residential uses. Motion: That the City Council receive and file this report. PUBLIC HEARING ITEM NO. 8 8. CONDUCT PUBLIC HEARING TO CONSIDER LEVYING OF ANNUAL ASSESSMENTS FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT FOR FISCAL YEAR 2017-2018 Mayor Bernstein, Mayor Pro Tem Murray and Councilmember Gomez recused themselves due to a potential conflictin real property interest. Due to a lack of quorum, Mayor Bernstein, Mayor Pro Tem Murray and Councilmember Gomez drew three coffee sticks to determine who will remain at the dais to participate in the discussion. Councilmember Gomez drew the shortest stick; therefore she exited the Council Chamber during the discussion. The Tustin Landscape and Lighting District Engineer's Report was completed and approved by the City Council at their May 2, 2017 meeting. At that meeting, the City Council declared its intention to levy annual assessments and set a public hearing for June 6, 2017. In order to levy the annual assessments, the City Council is required to conduct a public hearing and, provided there is no majority protest, adopt Resolution No. 17-24 confirming the annual assessments for Fiscal Year 2017-2018. Public hearing opened at 7:36 p.m. Public hearing closed at 7:36 p.m. with no public input. It was moved by Mayor Pro Tem Murray and seconded by Councilmember Clark to.. 1. Conduct a public hearing to receive testimony on the proposed levy of annual assessments for the Tustin Landscape and Lighting District for Fiscal Year 2017-2018; and 2. Adopt Resolution No. 17-24 confirming the annual assessments for Fiscal Year 2017-2018. City Council June 6, 2017 Meeting Minutes Page 6 of 14 Motion carried: 3-0 RESOLUTION NO. 17-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA CONFIRMING THE LEVY OF ANNUAL ASSESSMENTS FOR THE LANDSCAPE MAINTENANCE AND PUBLIC STREET LIGHTING EXPENSES IN THE TUSTIN RANCH AREA WITHIN THE BOUNDARIES OF THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT FOR FISCAL YEAR 2017-2018 Councilmember Gomez returned to the dais. REGULAR BUSINESS ITEMS 9-12 9. DESIGNATION OF VOTING DELEGATES AND ALTERNATES-LEAGUE OF CALIFORNIA CITIES ANNUAL CONFERENCE SCHEDULED FOR SEPTEMBER 13-15, 2017 (SACRAMENTO) In order to vote at the Annual Business Meeting, the City Council must designate a voting delegate and up to two alternate voting delegates, one of whom may vote in the event that the designated voting delegate is unable to serve in that capacity. It was moved by Mayor Bernstein and seconded by Councilmember Clark to designate Mayor Bernstein as the voting delegate and Mayor Pro Tem Murray and Councilmember Clark as the two alternate voting delegates. Motion carried: 4-0 10. LEGISLATIVE UPDATE Deputy City Manager Matthew S. West provided an update of proposed key legislative items. Please note with this legislative update that the Legislature has until Friday, June 2, to pass all bills out of the house that they were originally introduced in, known as the "House of Origin Deadline". During the week leading up to June 2, both the Assembly and the Senate will be voting on hundreds of pieces of legislation to advance those measures further down the legislative process. 11. ASSOCIATE MEMBERSHIP IN GOLDEN STATE FINANCE AUTHORITY AND RESOLUTIONS FOR PACE PROGRAM ELIGIBILITY Staff is presenting several items that will allow the City of Tustin to become an Associate Member of the Golden State Financing Authority (GSFA) and allow property owners in the City to participate in GSFA Property Assessed Clean Energy (PACE) programs. City Council June 6, 2017 Meeting Minutes Page 7 of 14 City Manager Jeffrey C. Parker provided an overview of the proposed program. It was moved by Mayor Pro Tem Murray and seconded by Councilmember Gomez to: 1. Approve Associate Membership in Golden State Finance Authority; and, 2. Adopt revised Resolution No. 17-25, consenting to inclusion of properties within the City of Tustin's territory in the Golden State Finance Authority Community Facilities District No. 2014-1 (Clean Energy) to finance renewable energy generation, energy efficiency and water conservation improvements, electric vehicle charging infrastructure and other authorized improvements ("SB 555 PACE Program Resolution"); and, 3. Adopt Resolution No. 17-26, consenting to inclusion of properties within the City of Tustin's territory in the Golden State Finance Authority AB 811 PACE program to finance renewable energy improvements, energy efficiency and water conservation improvements, electric vehicle charging infrastructure and other authorized improvements ("AB 811 PACE Program Resolution"); and, 4. Direct staff to return for Council's consideration with a Resolution to allow additional PACE program providers to operate in the City of Tustin. RESOLUTION NO. 17-25 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN CONSENTING TO INCLUSION OF PROPERTIES WITHIN THE CITY'S JURISDICTION IN THE GOLDEN STATE FINANCE AUTHORITY COMMUNITY FACILITIES DISTRICT NO. 2014-1 (CLEAN ENERGY) TO FINANCE RENEWABLE ENERGY IMPROVEMENTS, ENERGY EFFICIENCY AND WATER CONSERVATION IMPROVEMENTS, ELECTRIC VEHICLE CHARGING INFRASTRUCTURE, AND OTHER AUTHORIZED IMPROVEMENTS RESOLUTION NO. 17-26 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN CONSENTING TO INCLUSION OF PROPERTIES WITHIN THE CITY'S JURISDICTION IN THE GOLDEN STATE FINANCE AUTHORITY PACE PROGRAM TO FINANCE RENEWABLE ENERGY GENERATION, ENERGY AND WATER EFFICIENCY IMPROVEMENTS, ELECTRIC VEHICLE CHARGING INFRASTRUCTURE, AND OTHER AUTHORIZED IMPROVEMENTS Motion carried: 4-0 12. PROPOSED BIENNIAL PROGRAM AND FINANCIAL PLAN FOR THE FISCAL YEARS 2017-18 AND 2018-19 AND CAPITAL IMPROVEMENT PROGRAM City Council June 6, 2017 Meeting Minutes Page 8 of 14 City Manager Jeffrey C. Parker and Deputy Director of Finance Sean Tran provided a PowerPoint presentation. This is the biennial budget for the City of Tustin for fiscal years 2017-18 and 2018- 19. The biennial budget process allows for longer term financial projects and focuses on program essentials to provide quality services to our community. Transmitted herewith are the proposed Biennial Program and Financial Plan and Capital Improvement Program for Fiscal Years 2017-18 and 2018-19. The Program and Financial Plan is the operating budget for all City services. The Capital Improvement Program includes projects for Fiscal Year 2017-18 and projects programmed for a seven-year period. OTHER BUSINESS/COMMITTEE REPORTS City Manager Jeffrey C. Parker Attended the Association of California Cities of Orange County (ACCOC) Central Orange County Homeless Service Area Meeting; the meeting was co-sponsored by many different agencies, County of Orange, ACCOC, cities, Susan Price Orange County's Director of Care Coordinator; combined expenditures cities in Orange County are spending on the homelessness issue is close to 300,000,000 million dollars which is spent annually on behavioral health and public safety, as well as other expenditures as it relates to homelessness; Orange County has 2,584 unsheltered homeless individuals; includes 357 unsheltered veterans; 4,792 are in transitional or emergency housing; central Orange County has the largest homeless population 1,362; city staff, with the direction of City Council will work diligently to address this issue; would like to bring back, at an upcoming Council meeting, a more detailed report on some of the housing alternatives Councilmember Gomez May 19 o Was one of three speakers on a Panel at the Hillview High School People of Success event. o Attended the Tustin Unified School District Teacher of the Year Dinner; congratulated all the teachers. May 20 Thanked OneOC and the twenty companies who volunteered at the Thorman Elementary and Currie Middle School; volunteers worked to beautify the campus with painting of murals and the United States map, as well as several other projects. May 23 Attended the tour of the new Grocery Outlet; believes the community will be very happy with this new store. City Council June 6, 2017 Meeting Minutes Page 9 of 14 May 25 Attended the Santa Ana River Flood Protection Executive committee meeting; major discussion was the budget for the upcoming year which will be presented to the full board in June. May 30 Attended the Tustin Police Department Volunteer Dinner; thanked the volunteers for their many hours of service. May 31 Presented the Jonathan Dizon Memorial Scholarship at Tustin High School. June 4 Attended the Chili Cook-Off; was another great event, everyone seemed to enjoy the day. Councilmember Clark May 17 Mistress of Ceremony for the Susan G. Coleman of Orange County Annual Breast Cancer Awareness Day Half Day conference in conjunction with Kaiser Permanente; promoted proactive health for women in the community. May 18 Attended the Orange County Vector Control Board meeting; board approved the annual budget as well part-time staff needs for the summer months. May 22 Met with the Tustin Police Department; thanked Chief Charles F. Celano and his staff for the tour of the Police Department; learned a lot about their department. May 23 Attended the tour of the new Grocery Outlet.; was highly impressed with the products that were on the shelves; many affordable items to choose from. May 26 Attended the 10th Annual Memorial Day Celebration Ceremony at Tustin Ranch Elementary School; thanked Principal Tracy Barquer and the staff for a great ceremony. May 30 Attended the Tustin Police Department Volunteer Dinner; congratulated Kathy Leger, Tustin Police Volunteer of the Year. June 1 Attended the Grocery Outlet Ribbon Cutting Ceremony; job well done by the Tustin Chamber of Commerce. June 4 Attended the Tustin Parks and Recreation Annual Chili Cook-Off Event; congratulated Chili Cook-Off Chair, volunteered in the Kids Zone; thanked Chili Cook-Off Chair, Donna Marsh- Perry and Recreation Supervisor, Marilyn Buescher for the opportunity to volunteer and for putting on a successful event. Requested to have the Council meeting adjourned in honor of former city employee, Adam Kohn who passed away on May 19, 2017. City Council June 6, 2017 Meeting Minutes Page 11 of 14 May 30 Attended the Tustin Police Department Volunteer Dinner; volunteers contributed over 6,000 hours which equates to $150,000 in savings; since its inception in 2001, volunteers have contributed about $1.6 million in work hours; thanked all the volunteers within the Tustin Police Department. May 31 Attended the Tustin Street Fair and Chili Cook Off Committee meeting. June 1 Attended the Orange County Task Force on Drowning Prevention campaign kickoff event. June 2 o Attended and chaired the State Route 91 Advisors Committee meeting; the 91 Express Lane improvement, exceeding expectations with higher traffic volumes, higher than projected new accounts opened; 12% increase through the corridor. o Participated as an evaluator in the 4th Annual Orchard Hills 8th grade Exit Interviews; was very impressed with all the students. o Attended, with daughter Emily, the Miss Tustin Farewell Dinner for the 2017 Miss Tustin Emma Foss who will be competing in the Miss California competition. June 4 Participated, along with the Tustin Tillers Basketball Team, Mayor Bernstein and former Mayors Jerry Amante and Doug Davert in the setup of the 33rd Annual Tustin Street Fair and Chili Cook Off; participated in judging the chili competition with Irvine Mayor Don Wagner, Orange Mayor Pro Tem Mark Murphy, Aliso Viejo Mayor Dave Harrington, Yorba Linda Councilmember Gene Hernandez, staff members from Assemblyman Steven Choi's office and staff from Association of California Cities of Orange County (ACCOC); thanked Chili Cook Off Co-Chairs Recreation Supervisor Marilyn Buescher and Donna Marsh-Peery, committee members, volunteers and Tustin Police Department for a great safe family event; thanked Police Chief Charles F. Celano and his staff for keeping such a large event extremely safe. June 5 o Attended the Orange County Transportation Association (OCTA) Executive Board meeting; recommendations for Measure M2 were made; Citizen Committee appointments were decided; fiscal year 2017-18 Budget Workshop follow-up. o Attended the Association of California Cities of Orange County (ACCOC) Central Orange County Homeless Service Area meeting with Mayor Bernstein, City Manager Jeffrey C. Announced recently retired Tustin City employee Paul Kohn will be having a memorial service at the Tustin Area Senior Center on Thursday at 1:30 p.m. for his son Adam Kohn who unexpectedly passed away after a seizure on May 19tH City Council June 6, 2017 Meeting Minutes Page 12 of 14 Mayor Bernstein May 18 Attended the Leadership Tomorrow Mayor's Panel and Luncheon; included the Mayors from City of Newport Beach, City of Irvine, City of Costa Mesa, and City of Tustin. May 19 o Attended the Arroyo Elementary School Second Grade Class Town Hall meeting; had a wonderful time; thanked second grade teacher Stephanie Lukkes for the invitation. o Attended the Tustin Unified School District Teacher of the Year Celebration; good time was had by all; congratulated all the staff who were nominated and won; congratulated Tustin High School teacher, Randy Reta for his second nomination for Teacher of the Year. May 24 Attended the Orange County Sanitation District Board meeting; had a lively discussion and review of a project that will involve the Orange County Sanitation District and the Orange County Transportation Authority (OCTA). May 25 Attended the Association of California Cities of Orange County (ACCOC) Legislative meeting; thanked Deputy City Manager Matthew S. West for the review of the current legislation. May 26 Attended the 10th Annual Memorial Day Celebration Ceremony at Tustin Ranch Elementary School; heartwarming to see the participation of the elementary school; thanked Tustin Ranch Elementary School for the invitation to the ceremony. May 29 Was a speaker at the Tri-City Memorial Day Program ceremony at the Santa Ana Cemetery; Orange County's largest veterans attendance ceremony; was an honor and privilege to be in attendance. May 30 o Attended the Newport Bay Watershed Tour; the Irvine Ranch Water District San Joaquin Marsh in Irvine is a natural wonder; a natural wildlife preserve and purification system; congratulated the Orange County Vector Control for their ingenuity on dealing with the mosquito issue in Orange County. o Attended the Tustin Police Department Volunteer Dinner; congratulated Police Chief Charles F. June 1 o Along with the assistance of the President of the Orange County Rescue Mission Jim Palmer, gave Orange County Supervisor Andrew Do a tour of the Tustin Veterans Outpost. o Attended the Grocery Outlet Ribbon Cutting Ceremony; congratulated Grocery Outlet Operators Amanda and Ryan Stack on the opening; very well attended. June 2 o Attended the Orange County Water Advisory Board Committee meeting; conservation is the way of life. o Attended the Miss Tustin Send Off Party for Miss Tustin 2017 Emma Foss; wished good luck to Emma Foss as she competes in the Miss California competition. June 4 Attended the Tustin Parks and Recreation Annual Chili Cook Off Event; thanked Chili Cook- Off Chair, Donna Marsh-Perry and Recreation Supervisor, Marilyn Buescher for a job well done; thanked Police Chief Charles F. Celano and his staff for keeping the event safe. Announced the Tustin State of the City will be held on Thursday, June 8t" at the Tustin Community Center at the Market Place. Announced the 2017 Tustin Man and Woman of the Year will be held on Friday, June 9th. Announced to please keep Councilmember Puckett in everyone's thoughts as he recovers from surgery. Announced that June 6t" was the Allied invasion of Normandy in Operation Overlord during World War II; let everyone not forget the sacrifices veterans have made and the sacrifices military personal continue to make for our freedom.
