FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS
EL CAMINO REAL UNDERGROUND UTILITY DISTRICT NO. 5
RECOMMENDATION:
That the Tustin Community Redevelopment Agency, at their meeting of September 21,
1981, adopt the attached resolution accepting said work and authorizing the
filing of the Notice of Completion.
Assuming no claims or stop payment notices are filed within 30 days of the date of
recordation of the Notice of Completion, it is further recommended that the
Redevelopment Agency authorize payment of the final 10% retention amount
($54,350.00) at that time. This amount together with previous payments of
$489,152.70 represents 100% of the contract work completed to date. These amounts
do not include the $6,000.00 of uncompleted work.
BACKGROUND:
The subject project, consisting of conduit and structures for electrical and
telephone facilities within the E1 Camino Real Underground Utility District No. 5,
has been completed by the contractor, Pacific Pipeline Construction Co., with the
exception of approximately 255 L.F. of Telephone Co. conduit. The Telephone Co.
is still in the process of obtaining an easement for this remaining work and it is
estimated that the easement acquisition will be resolved by mid-October.
Pacific Pipeline Co. has requested that the project be accepted by the
Redevelopment Agency for the work that has been completed, so as to commence the
30 -day lien period, and they have agreed by letter to complete the remaining work
at the original unit prices contained in the contract. The estimated cost of the
remaining work is $6,000.00. This delay is no fault of the contractor, but has
originated from the Telephone Company's failure to obtain the necessary easements.
The preliminary contract amount based on estimated quantities was $530,945.00.
The final contract amount based on as -built quantities completed to date is
$543,503.00 plus the estimated cost of $6,000.00 for an overrun of $18,558.00, or
3.5%.
Attached is a resolution of acceptance for said work and authorization for
recordation of the Notice of Completion.
