ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION
TO FILE NOTICE OF COMPLETION
SUMMARY
The Pioneer Road Park Construction Projection (Project No. 2053) is ready for
acceptance and filing of the Notice of Completion.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 04-50 accepting said work
as complete; authorize the recordation of the Notice of Completion; and direct the City
Clerk to:
1. Release the Labor and Materials Bond no sooner than 35 days after the date of
recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond no sooner than one year after the date of
recordation of the Notice of Completion.
FISCAL IMPACT
The final cost of the construction contract for the Pioneer Road Park project, including
change orders, was $2,064,901.80. The project was funded through an appropriation
from the Park Development Funds with additional support coming from the Roberti-
Z'Berg Per Capita Grant Program.
BACKGROUND
The scope of the work included improvement to a 3.1-acre park site. It included
restroom, picnic shelter, two tot-lots, a water play area, volleyball court and a permeable
pavement parking lot. Landscape improvements included a walking path, turf areas,
over 200 trees and numerous shrub and plant material.

The project was substantially complete as of April 27, 2004. The City is retaining 10%
of the contract amount, which will be disbursed no sooner than 35 days after the
recordation of the Notice of Completion.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF NOTICE OF COMPLETION FOR
PIONEER ROAD PARK (PROJECT NO. 2053).

The City Council of the City of Tustin does hereby resolve as follows:

WHEREAS, Ecology Construction, Inc., having a contract with the City of Tustin
to construct the hereinafter described public works and improvements; and

WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvements hereinafter mentioned in a manner
satisfactory to the City Council of the City of Tustin; and

WHEREAS, the City Council finds that said contractor has completed said
public improvement hereinafter more particularly described in accordance with the
provisions of the contract documents and the Notice of Completion, and acceptance of
said public work and improvement should be filed and payment of the balance due
said contractor authorized in accordance with the contract documents;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said public work and improvement be accepted, and the same is hereby
accepted. Said public work and improvement is more particularly described as
follows:
