STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 17-39 TO ACCEPT IMPROVEMENTS FOR THE MOFFETT DRIVE EXTENSION (CIP NO. 70230), LEGACY ROAD EXTENSION (CIP NO. 70231), FUTURE TUSD SCHOOL SITE (CIP NO. 70234) AND CITY PROPERTY (CIP NO. 70235) GRADING PROJECT AND AUTHORIZE THE CITY ENGINEER TO FILE A NOTICE OF COMPLETION SUMMARY Construction of the Moffett Drive Extension (CIP No. 70230), Legacy Road Extension (CIP No. 70231), Future TUSD School Site (CIP No. 70234) and City Property (CIP No. 70235) Grading Project has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council take the following actions: Adopt Resolution No. 17-39 accepting the construction of the Moffett Drive Extension (CIP No. 70230), Legacy Road Extension (CIP No. 70231), Future TUSD School Site (CIP No. 70234) and City Property (CIP No. 70235) Grading Project; and 2. Authorize the City Engineer to execute and file the Notice of Completion with the Orange County Recorder's Office. FISCAL IMPACT The final construction cost for the Moffett Drive Extension (CIP No. 70230), Legacy Road Extension (CIP No. 70231), Future TUSD School Site (CIP No. 70234) and City Property (CIP No. 70235) Grading Project is $3,621,949.73, which includes the cost of construction, construction management and inspection, archaeological and paleontological monitoring, and geotechnical and materials testing. Payments to Sukut Construction totaled $3,121,456.64, including one authorized contract change order in the amount of $631,473.64 that for additional grading and storm drain installation within the LIFOC area for both roadway extensions (Moffatt and Legacy) and City property. This additional grading and storm drain work added in the LIFOC area for both roadways and city property was originally identified as a phase 2 area (see attached exhibit). This area was added to Sukut's work earlier this year to complete the grading for both roadways up to their future intersection in the LIFOC area and to not leave a low area on City property that would have been difficult to grade later. Sufficient funds were budgeted and appropriated in this Fiscal Year 2017/18 Capital Improvement Program to cover this expenditure. Notice of Completion for Moffett, Legacy, TUSD & City Property Grading Project August 15, 2017 Page 2 CORRELATION TO THE STRATEGIC PLAN The construction of Moffett Drive Extension (CIP No. 70230), Legacy Road Extension (CIP No. 70231), Future TUSD School Site (CIP No. 70234) and City Property (CIP No. 70235) Grading Project contributes to the fulfillment of the City's Strategic Plan Goal A: Economic and Neighborhood Development. Specifically, the project implementation of Strategy 1, which among other items, is to develop critical phases of Tustin Legacy. DISCUSSION The Moffett Drive extension from Tustin Ranch Road to Legacy Road, Legacy Road extension from Valencia Avenue to Moffett Drive, future TUSD School site, and City property grading project consists of rough grading and erosion control and has been deemed complete to the satisfaction of the City Engineer and is now ready for City Council acceptance. Expanded Ph 1 and Ph 2 ST Grading Exhibit SACity Council Items\2017 Council Items\08-15-2017\NOC - Moffett (70230), Legacy (70231), TUSD (70234) 8 City Property (70235) Grading\140C Moffett (70230), Legacy (70231), TUSD (70234) 8 City Property (70235) Grading.doox RESOLUTION NO. 17-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE MOFFETT DRIVE EXTENSION (CIP NO. 70230), LEGACY ROAD EXTENSION (CIP NO. 70231), FUTURE TUSD SCHOOL SITE (CIP NO. 70234) AND CITY PROPERTY (CIP NO. 70235) GRADING PROJECT WHEREAS, Sukut Construction, LLC, having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Moffett Drive Extension (CIP No. 70230), Legacy Road Extension (CIP No. 70231), Future TUSD School Site (GIP No. 70234) and City Property (CIP No. 70235) Grading Project BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
