ADOPTION OF RESOLUTION APPROVING PAYMENT OF FUNDS BY
THE REDEVELOPMENT AGENCY FOR COSTS ASSOCIATED WITH
THE TUSTIN LIBRARY PROJECT
SUMMARY
Agency authorization is requested to permit the payment of Tustin Community
Redevelopment Agency (the "Redevelopment Agency") funds for a portion of costs
associated with the proposed Tustin Library Project located in the Town Center
Redevelopment Project Area.
RECOMMENDATION
It is recommended the Agency adopt Resolution No. RDA 04-03 pursuant to Health and
Safety Code Section 33445 approving payment of funds by the Agency for costs
associated with the proposed Tustin Library Project.
FISCAL IMPACT
Adoption of the proposed resolution has no direct fiscal impacts on the Redevelopment
Agency. All proposed Tustin Library Project expenses will either be included in
separate budget requests as part of the City and Agency's budget approval process or
will be processed as separate appropriation requests.
BACKGROUND
The Redevelopment Agency has been conducting preliminary design and programming
studies and preparing State funding assistance applications for the redevelopment and
expansion of the Tustin Library, which would replace the existing facility located at 345
East Main Street on an enlarged site that encompasses the existing library site and
additional properties. The proposed Tustin Library Project entails the acquisition of

land, demolition of existing improvements, and design and installation of on-site and off-
site improvements, including new construction of an expanded library building (the
"Project") to meet community needs.
Anticipated funding for the proposed Project would include grant funds pursuant to the
California Reading and Literacy Improvement and Renovation Act of 2000 (the
California Library Bond Act) and additional local funds. In fiscal years 2001-2002,
2002-03 and 2003-04, the City Council authorized submittal of a Library Bond Act
Grant application and made certain commitments as required by the Library Bond Act
including, but not limited to a commitment to provide local matching funds in the design
and development of the proposed Project. Section 33445 of the California
Redevelopment Law (Health and Safety Code 33000 et seq.: "CRL") authorizes the
Redevelopment Agency, with the consent of the legislative body (Tustin City Council), to
pay all or a part of the value of the land for and the cost of design, installation of
improvements, and construction of any building, facility, structure or other improvement
which is publicly owned, either within or without the project area, if the Redevelopment
Agency and legislative body make certain determinations, as identified in the attached
Resolution No. RDA 04-03.
Finding of Benefit
This proposed project is located in the Town Center Redevelopment Project Area. The
Town Center Redevelopment Plan identifies the expansion or renovation of the Tustin
Library as an authorized public improvement within the Project Area. In March, 2000,
the Tustin Community Redevelopment Agency adopted a Second Five-Year
Implementation Plan for the Town Center and the South/Central Redevelopment
Projects for fiscal years 2000-2001 to 2004-2005. The Implementation Plan was
composed of two parts: a five-year plan for Redevelopment activities; and a five-year
plan for housing activities. Anticipated accomplishments and expenditures for the five-
year period included property acquisitions, design studies and State funding assistance
applications to support and facilitate the redevelopment and expansion of the Tustin
Branch Library.
The proposed Project is consistent with the Implementation Plan for the Town Center
Redevelopment Project Area. It would remove the existing library facility in the Project
Area, which is nearing the end of its useful life and which is characterized by a number
of deterioration problems, over-utilization and insufficient parking, and assemble aging
disparate ownership apartment buildings and two commercial properties to provide for
the much needed expanded library. The proposed project will substantially expand the

Tustin Branch Library and its services, provide educational and recreational
improvements, and stimulate economic development in the area. The proposed project
would construct a new, single story facility on the present site expanded by the
acquisition of the additional properties.
Adoption of Resolution No. RDA 04-03 approving payment of funds by the
Redevelopment Agency pursuant to Health and Safety Code Section 33445 for cost
associated with the proposed Project does not commit the Agency to funding project
costs until the Agency and City approves individual discretionary actions necessary for
the Project to proceed. Redevelopment Agency financial assistance provided for
components of the proposed project will require separate City Council and, Agency
budget approvals or separate appropriations.

A RESOLUTION OF THE TUSTIN COMMUNITY
REDEVELOPMEMT AGENCY OF THE CITY OF
TUSTIN, CALIFORNIA, APPROVING PAYMENT BY
THE TUSTIN COMMUNITY REDEVELOPMENT
AGENCY FOR COSTS ASSOCIATED WITH THE
TUSTIN LIBRARY PROJECT PURSUANT TO HEALTH
AND SAFETY CODE SECTION 33445
The Tustin Community Redevelopment Agency (the "Agency") of the City of Tustin does
hereby resolve as follows:
I.
The Agency finds and determines as follows:
A. The City Council adopted Resolution No. 02-58 on June 12, 2002 and
Resolution No. 04-07 on January 5, 2004 authorizing submittal of a Library Bond Act
Grant application and making certain commitments as required by the Library Bond Act
including but not limited to a commitment to provide local matching funds in the
development of the Tustin Library Project ("the Project").
B. The Agency is engaged in implementation of the "Redevelopment Plan"
for the Town Center Area Redevelopment Project (the "Redevelopment Project"); and
C. Section 33445 of the California Community Redevelopment Law (Health &
Safety Code 33000, et seq.: "CRL") authorizes the Agency, with the consent of the
legislative body (Tustin City Council), to pay all or a part of the value of the land for and
the cost of the design, installation of improvements and construction of any building,
facility, structure or other improvement which is publicly owned either within or without
the project area, if the legislative body determines all of the following:
(1) That the buildings, facilities, structures, or other improvements are of
benefit to the project area or the immediate neighborhood in which the project is
located, regardless of whether the improvements is within another project area, or in the
case of a project area in which substantially all of the land is publicly owned the
improvement is of benefit to an adjacent project area of the agency.
(2) That no other reasonable means of financing the buildings, facilities,
structures, or other improvements, are available to the community.
(3) That the payment of funds for the acquisition of land, design, and the cost
of buildings, facilities, structures, or other improvements will assist in the elimination of
one or more blighting conditions inside the project area or provide housing for low or
moderate income persons, and is consistent with the implementation plan adopted
pursuant to Section 33490.

D. The properties that comprise the Tustin Library Project site are a blighting
influence on the Redevelopment Project area exhibiting both physical and economic
blight reflected by a combination of conditions including, but not limited to residential
overcrowding, building dilapidation or deterioration, incompatible uses inhibiting
economic development of those parcels and other portions of the project area, and low
lease rates resulting in stagnant property values and impaired investments in the project
area.
E. The Project will remove the blighting influence described above and
provide construction of a new publicly owned library facility; and
F. The Project will entail acquisition of land, demolition of existing structures,
design and installation of on-site, off-site improvements, including new construction of
an expanded library building (the "Improvements"), which are needed to meet
community needs (see the Library Bond Act Grant Application which is on file in the City
Manager's office, and is incorporated herein by this reference.)
G. The public improvements contemplated for the Project are of benefit to the
Redevelopment Project Area or the immediate neighborhood in which the
Redevelopment Project is located; and
II. The Agency hereby finds and determines, based upon substantial evidence
provided in the record before it:
A.
That the foregoing recitals are true and correct;
B. That the Improvements are of benefit to the project area or the immediate
neighborhood in which the project is located;
C. That no other reasonable means of financing the entire portion of the
City's local matching fund obligation under the Library Bond Act for the
Improvements, are available to the community;
D. That the acquisition of land and the cost of the Improvements for the
Project will assist in the elimination of blight in the Redevelopment Project area,
and is consistent with the implementation plan adopted by the Agency for the
Town Center Area Redevelopment Plan pursuant to Section 33490 of the CRL.
