ELECTION OF CITY COUNCILMEMBERS BY DISTRICT
Attached is a draft of an Ordinance as requested by
Councilman Kelly for increasing the number of members of the City
Council from five to seven, and providing for election of the
City Councilmembers by District.
Government Code Section 34871 provides for submitting such
an Ordinance to the electors. It is the only method that a
general law city which has five members can use to increase the
size of its City Council to seven members.
If the City Council decides to proceed with this Ordinance,
it should hire an outside consultant, or direct staff, to provide
legal descriptions for boundaries for the seven districts that
shall be as nearly equal in population as may be. If electing
members of the City Council by District is approved by the
voters, then the boundaries will have to be adjusted after each
decennial federal census so that the Districts will continue to
be as nearly equal in population as may be (Elections Code
Section 35101) . This must be done before the first day of
November of the year following the year in which each decennial
federal census is taken (Elections Code Section 35102).
The Elections Code also provides for adjustments after
territory is annexed to the City.

ORDINANCE NO. 1036
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, PROVIDING
FOR THE ELECTION OF MEMBERS OF THE CITY
COUNCIL BY SEVEN DISTRICTS AND PROVIDING
FOR SUBMITTING SUCH ORDINANCE TO THE
REGISTERED VOTERS AT THE NEXT GENERAL
ELECTION THAT IS MORE THAN 88 DAYS AFTER
ADOPTION OF THIS ORDINANCE
WHEREAS, under the provisions of Government Code
Section 34871, a city may submit to the registered voters an
Ordinance providing for the election of members of the City
Council by district; and
WHEREAS, the City Council has determined that such an
Ordinance should be submitted to the voters providing for
the election of members of the City Council by seven (7)
districts.
NOW, THEREFORE, the City Council of the City of Tustin
does hereby ORDAIN as follows:
Section 1: The members of the City Council of the
City of Tustin shall be elected by seven (7) districts.
Section The seven (7) districts shall be
numbered and described as follows:
A. District No. 1 shall have boundaries described as
follows:

B. District No. 2 shall have boundaries described as
follows:

C. District No. 3 shall have boundaries described as
follows:

Section 3: Pursuant to the provisions of Government
Code Section 34871, this Ordinance shall be submitted to the
registered voters of the City of Tustin for approval at the
first regular municipal election occurring not less than 88
days after the effective date of Sections 3, 4, 8 and 9 of
this Ordinance.
Section 4: Pursuant to Elections Code Section 4018,
the City Clerk shall cause this Ordinance to be printed. A
copy of the Ordinance shall be made available to any voter
upon request.
Section 5: If a majority of the registered voters
of the City of Tustin, who vote, vote in favor of this
Ordinance, three (3) members of the legislative body shall
be elected by district in the even -numbered districts at the

first regular municipal election following the approval of
this Ordinance by the voters; and four (4) members of the
legislative body shall be elected by district in the odd -
numbered districts at the second regular municipal election
following approval of this Ordinance by the voters.
Section 6: The terms of office of the members of
the legislative body elected by districts shall be four (4)
years.
Section 7: The term of office of any Councilmember who
has been elected and whose term of office has not expired
shall not be affected by this Ordinance.
Section 8: Pursuant to Government Code Section
34877, the proposition to be submitted to the registered
voters of the City of Tustin to establish legislative
districts and approve this Ordinance shall read as follows:

A cross (+) placed in the voting square after the word
"YES" shall be counted in favor of adoption of the measure.
A cross (+) placed in the voting square after the word "NO"

Section 9: In all particulars not provided for, the
Clerk shall conduct the election as provided by law.
Section 10: Sections 3, 4, 8 and 9 of this Ordinance
shall become effective thirty (30) days after its adoption.
If approved by the voters, the remaining provisions of this
Ordinance shall become effective ten (10) days after the

date that the vote is declared by the legislative body as
provided in Elections Code Section 4013.
