THAYER, CHIEF OF POLICE Inter Com cc, Vea ) z SUBJECT: PARKING COMPLAINTS - SAN JUAN EAST OF RED HILL Background lt'o ij 0 CITY There have been numerous complaints by residents of commercial tractor/ trailer vehicles parking on San Juan east of Red Hill Avenue. The specific complaint has been that the trucks are being started early in the morning, causing excessive noise, vibration, and diesel smoke, which disturbs the residents of a nearby condominium complex known as Rancho San Juan Condos. Current Enforcement Procedures Our current enforcement policy was reiterated to our personnel on March 19 and April 17, 1985. All on -duty personnel were urged to keep high visibility in the area and cite violators when possible. Unfortunately, Tustin City Code Section 5340d states in part, "No parking of any vehicle over 4,000 pounds for more than two hours in a residential zone or eight hours in a commercial zone". There has been some confusion as to what zoning exists at this location. A good portion of the area is zoned R-3 for the Rancho San Juan Condos and the Tustin East Apartments; however, it is P & I zoning for Veeh School and Colonial Bible School. At the corner of Red Hill and San Juan (on the south side) it is zoned C-1 near the Albertson Shopping Center. This has created considerable confusion in connection with enforcement, although a number of citations have been issued. Apparently the major problem occurs when the trucks park near the C-1 zone. Analysis The area has been closely watched by all personnel, including myself. The trucks that park at this location are present on an infrequent basis. Some drivers park their vehicles on San Juan, start their engines, and leave the engines running while they eat breakfast. This usually occurs sometime during 5 a.m. to 6 a.m. Many times they are not parked for the number of hours required to cite the vehicle. Currently, we are citing unoccupied vehicles that are left with the motors running, which falls under the California Vehicle Code. However, the resident in the area who is complaining the most would like to see elimination of the trucks from the street on which he lives, San Juan. Mr. Huston - 2 - November 1, 1985 Alternatives 1, City Engineer Bob Ledendecker indicated we can post signs on both the / north and south sides of San Juan, from Red Hill to the Tustin East ! Apartments. The signs would read, "Vehicle Parking Prohibited of 1 Vehicles in Excess of 6,000 Pounds, 6 P.M, to 8 A.M." This action would allow officers to cite vehicles in violation of the signs on sight and would strictly address the "big rigs", excluding other smaller vehicles. 2. Posting could be extended from Red Hill to Green Valley, which will keep the larger trucks from parking in front of any businesses located on the southwest corner of San Juan and Red Hill. Again, we could immediately cite for violations. We could establish an amendment to Tustin City Code Section 5340d: "No parking of any vehicle over 6,000 pounds for more than two hours in a residential gene or eight hours in a eemmereial zone". This would enable the enforcement of illegal truck parking to be better managed throughout the City of Tustin (not just at this location), as the zoning requirements seem to be creating a problem at this time. Additionally, by causing the change of "no parking for more than two hours" at any place in the City for vehicles in excess of 6,000 pounds, it also eliminates the possibility of covering some pickups, some trailers, etc. Recommendation I recommend the implementation of the signing immediately and that the City Attorney be directed to draft an amendment to Tustin City Code Section 5340d accordingly.
