HomeMy WebLinkAboutCC RES 04-55 RESOLUTION NO. 04-55 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING PAYMENT BY THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY FOR COSTS ASSOCIATED WITH THE TUSTIN LIBRARY PROJECT PURSUANT TO HEALTH AND SAFETY CODE SECTION 33445 The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: A. The City Council previously adopted Resolution No. 02-58 on June 12, 2002 and Resolution No. 04-07 on January 5, 2004 authorizing submittal of a Library Bond Act Grant application and making certain commitments as required by the Library Bond Act including but not limited to a commitment to provide local matching funds in the development of the Tustin Library Präject ("the Project"). B. The Tustin Community Redevelopment Agency (the "Agency") is engaged in implementation of the "Redevelopment Plan" for the Town Center Area Redevelopment Project (the "Redevelopment Project"); and C. Section 33445 of the California Community Redevelopment Law (Health & Safety Code 33000, et seq.: "CRL") authorizes the Agency, with the consent of the legislative body (Tustin City Council), to pay all or a part of the value of the land for and the cost of the design, installation of improvements and construction of any building, facility, structure or other improvement which is publicly owned either within or without the project area, if the legislative body determines all of the following: (1 ) That the buildings, facilities, structures, or other improvements are of benefit to the project area or the immediate neighborhood in which the project is located, regardless of whether the improvements is within another project area, or in the case of a project area in which substantially all of the land is publicly owned the improvement is of benefit to an adjacent project area of the agency. (2) That no other reasonable means of financing the buildings, facilities, structures, or other improvements, are available to the community. (3) That the payment of funds for the acquisition of land, design, and the cost of buildings, facilities, structures, or other improvements will assist in the elimination of one or more blighting conditions inside the Resolution No. 04-55 Page 1 of 3 project area or provide housing for low or moderate income persons, and is consistent with the implementation plan adopted pursuant to Section 33490. D. The properties that comprise the Tustin Library Project site are a blighting influence on the Redevelopment Project area exhibiting both physical and economic blight reflected by a combination of conditions including, but not limited to residential overcrowding, building dilapidation or deterioration, incompatible uses inhibiting economic development of those parcels and other portions of the project area, and low lease rates resulting in stagnant property values and impaired investments in the project area. E. The Project will remove the blighting influence described above and provide construction of a new publicly owned library facility; and F. The Project will entail acquisition of land, demolition of existing structures, design and installation of on-site, off-site improvements, including new construction of an expanded library building (the "Improvements"), which are needed to meet community needs (see the Library Bond Act Grant Application which is on file in the City Manager's office, and is incorporated herein by this reference.) G. The public improvements contemplated for the Project are of benefit to the Redevelopment Project Area or the immediate neighborhood in which the Redevelopment Project is located; and II. The City Council hereby finds and determines, based upon substantial evidence provided in the record before it: A. That the foregoing recitals are true and correct; B. That the Improvements are of benefit to the project area or the immediate neighborhood in which the project is located; C. That no other reasonable means of financing the entire portion of the City's local matching fund obligation under the Library Bond Act for the Improvements, are available to the community; D. That the acquisition of land and the cost of the Improvements for the Project will assist in the elimination of blight in the Redevelopment Project area, and is consistent with the Town Center Redevelopment Plan and the implementation plan adopted by the Agency for the Town Center Area Redevelopment Plan pursuant to Section 33490 of the CRL.
