HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: CITY OF TUSTIN MEASURE M GROWTH MANAGEMENT PROGRAM ANNUAL COMPLIANCE, FISCAL YEAR 2004-2005 SUMMARY In order to maintain eligibility for the Measure M Growth Management Program, the City is required to annually submit a compliance package to the Orange County Transportation Authority (aCTA). For Fiscal Year 2004-2005, that package includes: (1) an updated Seven- Year Capital Improvement Program, (2) a Master Plan of Arterial Highways Consistency Resolution, and (3) a Maintenance of Effort Certification. RECOMM ENDA TION In order to maintain eligibility for the Measure M Growth Management Program (GMP), it is recommended that the City Council take the following actions in compliance with the Measure M GMP requirements: A. Adopt the attached draft Measure M Growth Management Program Seven-Year Capital Improvement Program (Fiscal Year 2004-2005 through Fiscal Year 2010- 2011 ). B. Adopt Resolution No. 04-56 concerning the City's Circulation Element for Master Plan of Arterial Highways consistency. C. Authorize the Director of Public Works/City Engineer to submit the City of Tustin's Measure M GMP eligibility package, including certification of the City's Maintenance of Effort (MaE), to the Orange County Transportation Authority. FISCAL IMPACT Compliance with Measure M requirements will ensure continued City eligibility for the Measure M Local Turnback Program and the Measure M Competitive Programs. BACKGROUND In November 1990, the voters of Orange County approved Measure M, the revised Traffic Improvement and Growth Management Program (GMP), which established a one-half (1/2) cent sales tax over a twenty-year period for local and regional transportation improvements City of Tustin Measure M Growth Management Program Annual Compliance, Fiscal Year 2004-2005 June 21, 2004 Page 2 throughout Orange County. In order to receive revenue from these programs for facility improvements, the City of Tustin and other Orange County cities must continue to meet certain requirements. Tustin's Measure M eligibility package for Fiscal Year 2003-2004 was approved by OCTA last year. In order to maintain eligibility for these programs, the City is required to submit the following items for the Fiscal Year 2004-2005 compliance submittal: Seven-Year Capital Improvement Program (CIP) The draft CIP is a seven-year projection of specific projects upon which Measure M funds may be expended. Adoption of the seven-year CIP is a requirement of the Measure M GMP. Included in the plan are projects that could be submitted to OCTA during future Measure M calls for projects. The proposed CIP is currently in draft form until the formal adoption of the City's seven-year Capital Improvement Program as part of the Fiscal Year 2004-2005 budget process. The finalized seven-year CIP will be forwarded to OCTA when the budget has been adopted by the City Council. Master Plan of Arterial Highways (MPAH) Consistency The City of Tustin is required to affirm, by a City Council resolution, that no unilateral reduction in through lanes has been made on any MPAH arterial on the City's circulation element. The City has completed studies for the amendment of the MPAH to reclassify EI Camino Real, between First Street and Newport Avenue, and submitted those studies to aCTA. The City is currently processing a General Plan Circulation Element Amendment to reclassify EI Camino Real between First Street and Newport Avenue. Upon adoption, the resolution will be submitted to aCTA. Maintenance of Effort (MOE) A Maintenance of Effort Reporting Form, with a statement certifying that the City will meet its MaE expenditure in accordance with Measure M requirements for Fiscal Year 2004- 2005, must be submitted with a copy of the City's draft budget sections showing these expenditures. Upon authorization, the certification of the MOE will be executed by the Director of Public Works/City Engineer and submitted to aCTA. Kasdan Engineering Services Manager Attachments: Resolution No. 04-56 Draft Seven-Year CIP (aCTA Format) RESOLUTION NO. 04-56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA CONCERNING THE STATUS OF THE CIRCULATION ELEMENT FOR THE CITY OF TUSTIN WHEREAS, the City of Tustin desires to maintain and improve the streets within its jurisdiction, including those arterials contained in the Master Plan of Arterial Highways (MPAH); and WHEREAS, the City of Tustin has endorsed a definition of and a process for determining consistency of the City's Arterial Highway Plan with the MPAH; and WHEREAS, the City has adopted a General Plan Circulation Element which does not preclude implementation of the MPAH within its jurisdiction; and WHEREAS, the City has completed studies for the amendment of the MPAH to reclassify EI Camino Real, between First Street and Newport Avenue, and submitted those studies to OCT A, and the City is currently processing a General Plan Circulation Element Amendment to reclassify EI Camino Real between First Street and Newport Avenue; and WHEREAS, the City is required to adopt a resolution every even-numbered year informing the Orange County Transportation Authority (aCTA) that the City's General Plan Circulation Element is in conformance with the County's Master Plan of Arterial Highways and whether any changes to any arterial highways of said Circulation Element have been adopted by the City during Fiscal Years 2002-2003 and 2003-2004; and WHEREAS, the City is required to send annually to the OCT A all recommended changes to the City Circulation Element and the County's Master Plan of Arterial Highways for the purpose of re-qualifying for participation in the Measure M Combined Transportation Funding Programs. NOW, THEREFORE, BE IT RESOLVED that the City of Tustin does hereby inform the aCTA that: a) The arterial highway portion of the Circulation Element of the City is in conformance with the County's Master Plan of Arterial Highways. b) The City attests that no unilateral reduction in through lanes has been made on any MPAH arterials during Fiscal Years 2002-2003 and 2003-2004. c) The City has adopted a uniform setback ordinance providing for the preservation of rights-of-way consistent with the MPAH arterial highway classification.
