CALL TO ORDER PLEDGE OF ALLEGIANCE INVOCATION ROLL CALL CLOSED SESSION REPORT FIRST PUBLIC INPUT PUBLIC HEARING A public hearing provides individuals the opportunity to be heard regarding an intended action of the City Council related to land use or fees. (Agenda Item 1) 1. APPROVAL OF RESIDENTIAL AND COMMERCIAL SOLID WASTE RATE ADJUSTMENTS AND ADOPTION OF RESOLUTION NO. 04-43 PLACING ASSESSMENTS FOR RESIDENTIAL SOLID WASTE COLLECTION ON THE 2004-2005 ORANGE COUNTY PROPERTY TAX ROLL Recommendations: 1.a. Approve residential and commercial solid waste rate adjustments related to the Produced Price Index and an extraordinary insurance cost adjustment to both residential and commercial rates; 1.b. Adopt resolution; and RESOLUTION NO. 04-43 - A resolution of the City Council of the City of Tustin, California adopted pursuant to the provisions of Section 5473 et seq. of the Health and Safety Code of the State of California, approving and adopting a report relative to parcels of real property receiving solid waste collection services, determining the charges for solid waste collection to be assessed against the respective lots or parcels of land as they appear on the current assessment roll 1.c. Adopt a policy of not considering retroactive cost recovery and require the submission of a request for extraordinary rate adjustment at the time that the expense is incurred by the franchisee. City Council Meeting Agenda June 21 2004 Page 2 of 5 CONSENT CALENDAR All matters listed under the Consent Calendar are considered to be routine by the City Council and will be enacted by one motion without discussion. Persons wishing to speak regarding Consent Calendar matters should file a "Request to Speak" form with the City Clerk. (Agenda Items 2 through 15) 2. APPROVAL OF MINUTES - REGULAR MEETING OF JUNE 7, 2004 Recommendation: Approve the Regular City Council Meeting Minutes of June 7, 2004. 3. APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $484,533.89; $1,591,625.64; and $895.20; Reversals in the amount of $109.49; and ratify payroll in the amount of $489,951.84 4. PLANNING COMMISSION ACTION AGENDA - JUNE 14,2004 All actions of the Planning Commission become final unless appealed by the City Councilor member of the public. Recommendation: Ratify the Planning Commission Action Agenda of June 14, 2004. 5. CITY OF TUSTIN MEASURE M GROWTH MANAGEMENT PROGRAM ANNUAL COMPLIANCE, FISCAL YEAR 2004-2005 Recommendation: In order to maintain eligibility for the Measure M Growth Management Program (GMP), it is recommended that the City Council take the following actions in compliance with the Measure M GMP requirements: 5.a. Adopt the attached draft Measure M Growth Management Program Seven-Year Capital Improvement Program (Fiscal Year 2004-2005 through Fiscal Year 2010-2011); 5.b. Adopt resolution; and RESOLUTION NO. 04-56 - A resolution of the City Council of the City of Tustin, California concerning the status of the Circulation Element for the City of Tustin 5.c. Authorize the Director of Public Works/City Engineer to submit the City of City Council Meeting Agenda June 21,2004 Page 3 of 5 Tustin's Measure M GMP eligibility package, including certification of the City's Maintenance of Effort (MOE), to the Orange County Transportation Authority. 6. AUTHORIZATION TO CONTINUE OPERATION FOR FISCAL YEAR 2004- 2005 Recommendation: Approve continued fiscal operations pending finalization of the 2004/2005 budget as recommended by the Finance Director. 7. NOVEMBER 2, 2004 GENERAL MUNICIPAL ELECTION Recommendation: Adopt resolutions. RESOLUTION NO. 04-57 - A resolution of the City Council of the City of Tustin, California (1) calling and giving notice of a General Municipal Election to be held on Tuesday, November 2, 2004, (2) requesting the County of Orange Board of Supervisors to consolidate the General Municipal Election with the Statewide General Election (3) authorizing the County of Orange Registrar of Voters Department to canvass the election returns; and (4) providing for expenses of the election RESOLUTION NO. 04-58 - A resolution of the City Council of the City of Tustin establishing a system for candidates whose statements are submitted to the electorate in the 2004 General Municipal Election to pay the pro rata share of the cost of inclusion of the statement 8. AGREEMENT WITH JHTM AND ASSOCIATED TO PROVIDE CONTINUED CARETAKER SERVICES AT TUSTIN LEGACY Recommendation: Authorize the City Manager or Assistant City Manager to execute a Caretaker/Property Management Consultant Services Agreement between JHTM and Associates and the City of Tustin to provide necessary caretaker services at Tustin Legacy, subject to final contract review by the City Attorney. 9. JOHN WAYNE AIRPORT NOISE ABATEMENT QUARTERLY REPORTS Recommendation: Receive and file report. (Agenda Item 10) 10. ORDINANCE NO. 1285 - AMENDED MODEL AMBULANCE SERVICE ORDINANCE Recommendation: Have second reading by title only and adoption of the following ordinance (roll call vote): ORDINANCE NO. 1285 - An ordinance of the City Council of the City of Tustin, California: (1) adding Chapter 8 to Article 6 of the Tustin City Code establishing general operating procedures and standards for ambulance transportation services within the City; and (2) repealing Ordinance No. 955 SECOND PUBLIC INPUT - Refer to First Public Input for information. OTHER BUSINESS - City Manager, City Attorney, City Council COMMITTEE REPORTS - City Council ADJOURNMENT - The next regular meeting of the City Council is scheduled for Tuesday, July 6, 2004, at 7:00 p.m. in the Council Chamber at 300 Centennial Way, Tustin.
