JUNE 14, 2004 CALL TO ORDER PLEDGE OF ALLEGIANCE ROLL CALL Elizabeth A. APPROVAL OF MINUTES - MAY 24, 2004, PLANNING COMMISSION MEETING. It was moved by Pontious, seconded by Menard, to approve the Consent Calendar. Motion passed 5-0. PUBLIC HEARINGS 2. CONDITIONAL USE PERMIT 04-017 REQUESTING AUTHORIZATION TO TEMPORARILY STORE CONSTRUCTION MATERIALS AND EQUIPMENT ON A PORTION OF THREE (3) VACANT LOTS FOR UP TO EIGHTEEN (18) MONTHS FOR A REGIONAL WATER AND SEWER LINE IMPROVEMENT PROJECT. THIS PROJECT IS LOCATED ON VACANT PROPERTY NORTH OF VALENCIA AVENUE BETWEEN SR-55 AND DEL AMO AVENUE IN THE PLANNED COMMUNITY INDUSTRIAL (PC-IND) ZONING DISTRICT. RECOMMENDATION: That the Planning Commission adopt Resolution No. 3917 approving Conditional Use Permit 04-017. Minutes - Planning Commission June 14, 2004 - Page 1 7:01 p.m. The Public Hearing opened. Ortlieb Presented the staff report. Nielsen Asked if there will be a construction supply site for the Newport Avenue extension in an area near this site. Ortlieb Replied that the City acquired the right-of-way from the property owner; it may be an option for the City to use the remaining portions of the vacant property; through the acquisition, the City was able to obtain an 100 foot construction easement on both sides of those right-of-ways which could be utilized for storage. Nielsen Stated he was concerned about having too many construction sites in a small area. Director Indicated that when the City project begins, the City's property to the east of Edinger Avenue will be utilized for the staging area. Menard Asked if there has been a traffic study regarding how much traffic this will generate in terms of the business neighbors across the street. Ortlieb Indicated that no traffic study was done. Menard Asked if staff has any idea of trip counts for this yard. Ortlieb Suggested that such a request could be incorporated as a condition of approval. Director Stated the contractor is working throughout the City; although there are trips being generated to this. site, allowing the contractor to stage at this central location will reduce the number of total trips. Menard Indicated that his concern was being a good neighbor to Ricoh across the street. Pontious Added that the hours of operation will be different from regular business hours. Director Agreed that much of this work will be taking place at night; and, added that when it is no longer convenient for the contractor to be at this location, they will be moving out of this area. Minutes - Planning Commission June 14, 2004 - Page 2 Amante Director Amante Director Menard Director 7: 11 p.m. After discussion, the Planning Commission directed staff to perform further research and report back to the Commission Asked how this will relate to the project at 1 ih and Newport (the Prescott property). Stated it was her understanding that the contractor located some of their storage facilities at 1 ih and Newport Avenue temporarily; staff received information they were asked by the County to vacate those premises; the contractor then located some of their storage materials on the property next to the Armstrong facility; a 30-day temporary permit was then requested and approved for the site being considered in this item. Noted he only wanted to verify they would not be storing in multiple locations; and, asked what amount they are being asked to post in case there are clean-up issues. Indicated the amount is sufficient. Questioned whether or not Ricoh and other businesses in the vicinity were notified. Responded that property owners within 300 feet were notified. The Public Hearing closed. It was moved by Floyd, seconded by Pontious, to adopt Resolution No. 3917. Motion carried 5-0. REGULAR BUSINESS 3. OFFICE USES IN THE CENTRAL COMMERCIAL (C-2) DISTRICT: In May, 2002, the City Council adopted Code Amendment 02-002 to clarify the process and criteria for considering office uses within the Central Commercial (C-2) zoning district. In implementing Code Amendment 02-002, staff has encountered issues that are presented in this report for the purpose of initiating Planning Commission discussion. RECOMMENDATION AND ALTERNATIVES: Discuss issues and opportunities related to the office use provisions. Some alternatives to be considered include: Minutes - Planning Commission June 14, 2004 - Page 3 1. Continue to apply the office use provisions as they have been implemented by staff. 2. Direct staff to conduct additional research and report back to the Planning Commission to receive additional direction. 3. Initiate the development of policy guidelines and/or zoning code amendments, as directed. Willkom Presented the staff report. After a general discussion among the Planning Commissioners, staff, the Assistant City Attorney, and Patti Eby, President of the Tustin Old Town Association, a general consensus was reached as follows for further research by staff: . Evaluate methods of focusing the existing office use provisions in the core commercial area of Old Town, particularly the buildings fronting onto EI Camino Real and Main Street, and eliminate the requirement for discretionary review of offices outside of Old Town in the existing C-2 zoning district. . Evaluate "soft" amortization mechanism, including discretionary use review processes for subsequent or new uses, for new office construction or establishment of new office businesses, even if located in an existing office building, within the focus area. . Include some analysis of whether there is a strong demand for retail space in Old Town that would support office restrictions. . Evaluate whether certain permitted "quasi-office" uses such as real estate offices, travel agencies, etc. should be conditionally permitted and distinguish between those uses that generate pedestrian activity and those that do not. . Evaluate whether other uses that would encourage day to evening activity in Old Town should be listed as permitted or conditionally permitted. . Evaluate methods of establishing parking requirements for pedestrian-generating activities or uses or devising shared parking techniques as incentives to convert office uses to retails. Collect and analyze available data on buildings between Main Street and First Street that have retail storefronts that could be converted into retail spaces or are office buildings with minimal potential to convert to retail. . Study any modifications to the office use provisions within the Central Commercial (C-2) zoning district in conjunction with the upcoming Zoning Code update workshops to minimize staff work and ensure consistency with the update. , . Be sure to obtain legal counsel's opinion on the implementation process to ensure that the City is not subject to unnecessary liabilities. STAFF CONCERNS 4. REPORT OF ACTIONS TAKEN AT THE JUNE 7, 2004, CITY COUNCIL MEETING. The City Council held the second reading for Ordinance No. 1284, Prospect Village Planned Community Project; the project will now move forward. COMMISSION CONCERNS No concerns. Reported that the Chili Cook-Off was a huge success; and, congratulated the winners. Stated this evening's discussion was interesting. Agreed with Commissioner Menard that the evening's discussion was informative. Thanked staff for the report. Indicated she did not taste any of the chili but thought it was a wonderful event. Noted the Armstrong Nursery opening was a well-attended event. Stated the judging of the Chili Cook-Off was more difficult than ever. Minutes - Planning Commission June 14, 2004 - Page 5 Amante continued 8:10 p.m. Asked everyone to remember the passing of former President Ronald Reagan, a great American; and, noted that such a remembrance seemed especially appropriate on Flag Day. ADJOURNMENT: The next regular meeting of the Planning Commission is scheduled for Monday, June 28, 2004, at 7:00 p.m. in the Council Chamber at 300 Centennial Way.
