LOT LINE ADJUSTMENT NO. 04-02: 14071-14081 NEWPORT AVENUE
(TUSTIN FREEWAY CENTER- PHASE II)
SUMMARY
The proposed lot line adjustment is being requested by Strata Tustin, LLC to move existing lot lines to
adjust the size of two separate parcels for development purposes.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 04-59 approving Lot Line Adjustment
No. 04-02.
FISCAL IMPACT
None.
BACKGROUND
Strata Tustin, LLC has requested a lot line adjustment between two parcels at 14071-14081 Newport
Avenue. This is the location of the former Alta Dena Dairy Distribution Center. The request calls for the
existing lot lines to be relocated to accommodate future development of the site.
Strata Tustin, LLC intends to construct a retail building at 14071-14081 Newport Avenue. The lot line
adjustment will move the property line between Lots 1 and 2 slightly to the south to avoid being in
conflict with the proposed building.
DISCUSSION
Lot line adjustments are provided for in Section 66412(d) of the California Subdivision Map Act. In that
Section, the Act provides for local authorities to approve lot line adjustments where land taken from one
lot/parcel is added to an adjacent lot/parcel, and where a greater number of parcels than originally
existed are not created.
The attached documents, consisting of the application and Resolution No. 04-59, will provide for the
requested adjustments once Resolution No. 04-59 has been adopted by the City Council and the lot line
adjustment application has been recorded at the Orange County Recorder's Office.

The Lot Line Adjustment Application has been reviewed by the Community Development Department
and the Public Works Department/Engineering Division. The proposed adjustments have been
determined to be in compliance with all zoning requirements of the City, the provisions of the California
Subdivision Map Act, and the California Environmental Quality Act.

RESOLUTION NO. 04-59
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING LOT LINE ADJUSTMENT NO. 04-02
WHEREAS, Section 66412(d) of the California Subdivision Map Act makes
provisions for a local agency to approve lot line adjustments where the land taken from
one parcel is added to an adjacent parcel and where a greater number of parcels than
originally existed is not thereby created; and
WHEREAS, the City Council of the City of Tustin has reviewed Lot Line Adjustment
No. 04-02 and has made findings that the real property described in Exhibit A and shown
on Exhibit B complies with the provisions of the California Subdivision Map Act and
applicable City of Tustin ordinances and regulations including the requirements for building
sites; and
WHEREAS, the City Council of the City of Tustin has made the following findings:
1.
That the proposal is eligible for processing as a lot line adjustment pursuant to
Section 66412 (d) of the California Subdivision Act;
2.
That the requirements of the California Environmental Quality Act have been
met;
3.
That the proposal is consistent with the Tustin General Plan; and
4.
That the resultant parcels will meet the requirements of the Tustin Zoning Code;
NOW, THEREFORE, BE IT RESOLVED that the proposed Lot Line Adjustment
No. 04-02 as shown on Exhibits A and B is hereby approved and that the parcels be
considered building sites upon recordation of this document.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 6th day of July 2004.
