SUBJECT: CERTIFICATE OF APPROPRIATENESS FOR CONSTRUCTION OF A WALL
AND ADDITIONS TO AN EXISTING SWIMMING POOL
Dear Mr. Edgell:
We have received your applications for building permits to: 1)
construct along the north property line, a six -foot -high CMU wall
with a brick veneer (Permit No. 2083), to match existing walls; and
2) enlarge an existing swimming pool by adding a spa and
approximately 260'square feet of pool area (Permit No. 1566).
In accordance with Ordinance No. 1001, adopted by the Tustin City
Council on June 20, 1988, the Director of Community Development has
the authority to approve, approve with conditions or deny
Certification of Appropriateness for improvements located within
a Cultural Resources District and requiring a City building permit.
The following findings are required for issuance of a Certificate
of Appropriateness:
a. The proposed work conforms to the Municipal Code and design
.standards which may be established from time to time by the
Cultural Resources Committee.
b. The proposed work does not adversely affect the character of
the District or Designated Cultural Resources within the
District.
C. The proposed work is harmonious with existing surroundings.
The extent of�harmony shall be evaluated in terms of
appropriateness of materials, scale, size, height, placement
and use of a new building or structure in relationship to
existing buildings and structures and the surrounding setting.
The Director of Community Development has reviewed your proposal
and determined that the improvements are consistent with provisions
of Ordinance 1001, and hereby approves a Certificate of
Appropriateness, subject to the following conditions:

1. All materials shall match those of the existing fence.

The property located at 345 W. Main Street is square - 150 X 150
feet. Because the dwelling faces Main Street and has a Main Street
address, it was determined by staff that, for zoning purposes, Main
Street should be considered the front of the property, "A" Street
the side, and the north property line the rear.
Currently, three sides of the property (east, south and west) are
enclosed with wrought iron fencing spanning between "used -brick"
pilasters. However, there is little documentation on that
perimeter fencing. No building permit could be located and no
record that a planner had reviewed plans for the existing fencing
were found. (A Certificate of Appropriateness, dated September 1,
1988, for a 30 -foot section of fence in the interior of the lot was
located.)
Section 9271 of the Tustin Zoning Code prohibits structures over
36" (3 feet) high within the required 20 -foot front yard. Portions
of the fence along Main Street exceed 3611, and if a building permit
was issued, it was done so in error. No enforcement action has
been taken at this time.
The Tustin Zoning Code also states that.no structure over 36" (3
feet) in height is allowed within ten feet of a driveway in a
required side or rear yard. However, that standard may be waived
by the Director of Community Development. An approximately 5 -foot
high pilaster at the "A" Street end of the proposed 3 -foot high
fence is within 10 feet of the semi -circular driveway, located in
the side yard, which provides access to the site. The pilaster is
at the right-of-way line, 13.5 feet behind the face of the curb,
and does not block visibility when exiting the driveway.
Therefore, the building permit was approved. However, if "A"
Street is ever widened to its full 66 -foot right-of-way, the fence
along the west property line may need to be relocated. (See "A"
