CERTIFICATE OF APPROPRIATENESS FOR AN ADDITION
TO THE EXISTING NON-CONTRIBUTING SINGLE FAMILY
RESIDENCE LOCATED AT 440 WEST SECOND STREET,
TUSTIN.
Dear Mr. and Mrs. Jones:
Thank you for your application for Design Review and
Certificate of Appropriateness requesting authorization
for an eighty (80) square foot addition to the single
family dwelling located at 440 West Second Street. After
review of your submittal, and in conformance with
Government Code Section 65943, the Community Development
Department is pleased to inform you that your project has
been approved based upon the findings and subject to the
conditions contained in the attached Exhibit A.
This action and those conditions, except as identified
with an asterisk (*), may be appealed to the Planning
Commission by any person provided that a petition
indicating why the action or conditions are being
appealed and an appeal fee, established by the City
Council, are submitted. The Community Development
Department action and conditions will become final unless
an appeal petition and fee, as noted above, is received
by the Department within seven (7) calendar days from the
date of this letter.

FINDINGS AND CONDITIONS OF APPROVAL
DESIGN REVIEW 94-016 AND CERTIFICATE OF APPROPRIATENESS
FOR AN EIGHTY (80) SQUARE FOOT ADDITION
TO THE EXISTING SINGLE FAMILY RESIDENCE
LOCATED AT 440 WEST SECOND STREET, TUSTIN.
The Community Development Department finds and determines as
follows:
A. That a proper application was filed by Mr. and Mrs.
William R. Jones to authorize an eighty (80) square foot
addition to the single family dwelling located at 440
West Second Street, Tustin, California.
B. That pursuant to Section 9272(c) of the Tustin City Code,
the Community Development Department finds that the
location, size, architectural features and general
appearance of the proposal will not impair the orderly
and harmonious development of the area, the present or
future development therein, or the occupancy as a whole.
In making such findings, the Community Development
Department has considered at least the following items:
1. Height, bulk and area of buildings.
2. Setbacks and site planning.
3. Exterior materials and colors.
4. Type and pitch of roofs.
5. Size and spacing of windows, doors and other
openings.
6. Towers, chimneys, roof structures, flagpoles, radio
and television antennae.
7. Landscaping, parking area* design and traffic
circulation.
8. Location, height and standards of exterior
illumination.
9� Location and appearance of equipment located
outside of an enclosed structure.
10. Location and method of refuse storage.
11. Physical relationship of proposed structures to
existing structures in the neighborhood.

12. Appearance and design relationship of proposed
structures to existing structures and possible
future structures in the neighborhood and public
thoroughfares.
13. Development Guidelines and criteria as adopted by
the City Council.
C. In accordance with Ordinance No. 1001 which was adopted
June 20, 1988 by the Tustin City Council, the Community
Development Director has the authority to approve,
approve with conditions or deny Certification of
Appropriateness for improvements requiring a City
building permit for property located within a Cultural
Resource District.
in considering such a Certificate of Appropriateness the
Community Development Department has considered the
following items:
a. The proposed work conforms to the Municipal Code
and design standards which may be established from
time to time by the Cultural Resources Committee.
b. The proposed work does not adversely affect the
character of the District or Designated Cultural
Resources within the District.
C. The proposed work is harmonious with existing
surroundings. The extent of harmony shall be
evaluated in terms of appropriateness of materials,
scale, size, height, placement and use of a new
building or structure in relationship to existing
buildings and structures and the surrounding
setting.
D. That this project is Categorically Exempt from the
requirements of the California Environmental Quality Act,
pursuant to Section 15303 (Class 3).

GENERAL
1.1 The proposed project shall substantially conform with the
submitted plans for the project date stamped May 11, 1994
on file with the Community Development Department, as
herein modified, or as modified by. the Director of
Community Development Department in accordance with this
Exhibit. The Director of Community Development may also
approve subsequent minor modifications to plans during
plan check if such modifications are to be consistent
with provisions of the Tustin City Code.
1.2 Design Review approval shall become null and void unless
building permits are issued within eighteen (18) months
of the date of this Exhibit.
1.3 The applicant shall sign and return an Agreement to
Conditions Imposed form prior to the issuance of any
permits.
1.4 The applicant shall hold and defend the City of Tustin
harmless for all claims and liabilities out of City's
approval of the entitlement process for this project.
SITE AND BUILDING CONDITIONS
2.1 All new colors, materials and finishes of the proposed
addition shall match those of the existing residential
structure.
2.2 All exterior walls of the proposed addition shall consist
of vertical siding which matches the vertical siding on
the existing portions of the residence.
2.3 All locks and security hardware shall meet specifications
as indicated by the City of Tustin Security Code.
FEES
* 3.1 Prior to issuance of any building permits, payment shall
be made of all applicable Building plan check and permit
fees to the Community Development Department.
* 3.2 Within forty-eight (48) hours of approval of this
project, please submit payment in the amount of $25.00 to
the City of Tustin for the preparation of the
environmental notice of exemption.

* 3.3 Within forty-eight.(48) hours of approval of the subject
project, the applicant shall deliver to the Community
Development Department, a cashier's check payable to the
County Clerk, in the amount of $25.00 (twenty-five
dollars) to enable the City to file with the County
Clerk, the appropriate environmental documentation
pursuant to the California Environmental Quality Act. If
within such forty-eight (48) hour period, the applicant
has not delivered to the Community Development Department
the above noted check, the approval for the project
granted herein shall be considered automatically null and
void.
In addition, should the Department of Fish and Game
reject the Certificate of Fee Exemption filed with the
Notice of Determination and require payment of fees, the
applicant shall deliver to the Community Development
Department within forty-eight (48) hours of notification,
a cashier's check payable to the County Clerk in the
amount of $850 (eight hundred fifty dollars) if a
Negative Declaration was prepared. If this fee is
imposed, the subject project shall not be operative,
vested or final unless and until the fee is paid.

I, the undersigned hereby agree to comply with all conditions
imposed by the Community Development Department of the City of
Tustin on approval of the Certificate of Appropriateness and Design
Review 94-016 for an eighty (80) square foot addition to the single
family dwelling located at 440 West Second Street, Tustin,
California, as stated in Exhibit A attached to the letter dated
May 11, 1994.

DESIGN/ZONING REVIEW APPLICATION
The City Council of the City of Tustin finds that poor quality in the exterior
design, development and maintenance of structures, landscaping and general
appearance affect the desirability of the community as a whole. Prior to the
issuance of any building. permit for new structures, buildings to be relocated,
and signs to be constructed or modified, the Community Development Department
shall approve the site plan, architectural design, landscaping and signage,
where applicable, for such development. Approvals remain valid for a period of
eighteen months. The decision of the Community Development Department shall be
final unless appealed to the Planning Commission, within seven (7) days of the
Community Development Department's decision. Applications for Design/Zoning
Review will be accepted by appointment only..
