FINDINGS AND CONDITIONS OF APPROVAL
DESIGN REVIEW -96-046 (265 S. PACIFIC ST.)
OCTOBER 25, 1996
I. The Community Development Department finds and determines as
follows:
A. That a proper application, Design Review 96-044, was
filed on September 19, 1996, by Kimberley Barnhardt and
Edward Rowan requesting authorization to add 234 square
feet to the rear of the residence and reconstruct a non-
conforming structure (garage) on property located at 265
S. Pacific Street.
B. That pursuant to Section 9272(c) of the Tustin City
Code, the Community Development Department finds that
the location, size, architectural features and general
appearance of the proposal are harmonious with the
development of the area, the present or future
development therein, or the occupancy as a whole. In
making such findings, the Community Development
Department has considered at least the following items:
1. Height, bulk and area of buildings.
2. Setbacks and site planning.
3. Exterior materials and colors.
4. Type and pitch of roofs.
5. Size and spacing of windows, doors and other
openings.
6. Towers, chimneys, roof structures, flagpoles,
radio and television antennae.
7. Physical relationship of proposed structures to
existing structures in the neighborhood.
8. Appearance and design relationship of proposed
structures to. existing structures and possible
future structures in the neighborhood and public
thoroughfares.
9. Development Guidelines and criteria as adopted by
the City. Council.
C. That this project is an addition to an existing
structure and is, therefore, categorically exempt (Class
1) from the requirements of the California Environmental
Quality Act, (CEQA) pursuant to Section 15301 of the
State CEQA Guidelines.
D. This project has been reviewed for consistency with the
Air Quality Sub -Element of the City of Tustin General
Plan and has been determined to be consistent or has
been conditioned to be consistent with the Air Quality
Sub -Element.

II. The Community Development Department hereby approves Design
Review 96-044 authorizing the addition of 234 square feet to
an existing residence and reconstruction of a non -conforming
structure (garage) on property located at 265 S. Pacific
Street, subject to the conditions below and the provisions of
the Certificate of Appropriateness contained in Exhibit A
attached hereto:
GENERAL
* 1.1 The proposed project shall substantially conform with
the submitted plans for the project date stamped
September 19, 1996, and the subsequent revisions date
stamped October 25, 1996, on file with the Community
Development Department, as herein modified, or as
modified by the Director of Community Development
Department in accordance with this Exhibit. The
Director of Community Development may also approve
subsequent minor modifications to plans during' plan
check if such modifications are to be consistent with
provisions of the Tustin City Code.
* 1.2
Design Review approval shall become null and void unless
building permits are issued within eighteen (18) months
of the date of this Exhibit.
* 1.3
The applicant shall sign and return an Agreement to
Conditions Imposed form prior to the issuance of any
permits.
* 1.4
All conditions in this Exhibit shall be complied with
prior to the issuance of any building permits for this
project, subject to review and approval of plans by the
Community Development Department.
* 1.5
The applicant shall hold and defend the City of Tustin
harmless from all claims and liabilities arising out of
the City's.approval of entitlements for this project.
PLAN SUBMITTAL
* 2.1
At building plan check, provide three (3) complete sets
of the following to ensure compliance with the Uniform
Building Code, other related Codes, City Ordinances and
state and federal laws and regulations:
a) Complete architectural, electrical, mechanical
and plumbing plans, specifications and details.
b) Structural plans, calculations and
specifications.
c) Type of construction and occupancy group
indicated on plans.

d) Documentation per the State Energy Regulations,
Title 24.
* 2.2 The following notes shall be added to the site plan:
A. All revisions on plans after initial City
approval shall be submitted to the Community
Development Department for subsequent approval
and noted on signatured title sheets prior to
implementation.
* B. Note on plans that no outdoor storage is
permitted during construction except as approved
by the Tustin Community Development Director.
* C. All exposed metal flashing or trim is either
anodized or painted to be compatible with main
buildings.
SITE PLAN AND ARCHITECTURE
* 3.1 All treatments (siding, window frames, finish colors,
etc.) on the addition and garage shall match to the
greatest extent feasible and be consistent with the
.existing features of the residence, as noted on the
plans date stamped September 19, 1996, and October 22,
1996, subject to final approval of the Community
Development Department. Note accordingly on all
subsequent plans.
FEES
* 4.1 Prior to issuance of any building permits, payment shall
be made of all required fees. Payment shall be made
based upon the rates in effect at the time of permit
issuance and are subject to change.
A. All applicable building plan check and permit
fees to the Community Development Department.
B. All School fees as required by the Tustin Unified
School District.
C. within forty-eight (48) hours of approval of the
subject project, the applicant shall deliver to
the Community Development Department, a cashier's
check payable to the COUNTY CLERK in the amount
of $38.00 (thirty-eight dollars) to enable the
City to file the appropriate environmental
documentation for the project. If within such
forty-eight (48) hour period that applicant has
not delivered to the Community Development
Department the above -noted check, the statute of
limitations for any interested party to challenge
the environmental determination under the
provisions, of the California Environmental
Quality Act could be significantly lengthened.

CERTIFICATE OF APPROPRIATENESS

OCTOBER 25, 1996
In accordance with Ordinance No. 1001, which was adopted June 20,
1988 by the Tustin City Council, the Community Development Director
has the authority to approve, approve with conditions, or deny a
Certificate of Appropriateness for improvements requiring a City
building permit for property located within a Cultural Resource
District.
The following findings are required before a Certificate of
Appropriateness is issued:
1. The proposed work conforms to the Municipal Code and design
standards which may be established from time to time by the
Cultural Resources Committee;
The proposed work does not adversely affect the character of
the District or Designated Cultural Resources within the
District; and
The proposed work is harmonious with existing surroundings.
The extent of harmony shall be evaluated in terms of
appropriateness of materials, scale, size, height, placement
and use of a new building or structure in relationship to
existing buildings and structures and the surrounding setting.
It has been determined that the project is in conformance with the
above requirements. The Community Development Director has reviewed
the proposed plan and approves a Certificate of Appropriateness for
the residence, subject to the conditions contained in Design Review
96-044, incorporated herein by reference.
