HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/FIELD SERVICES TO: SUBJECT: APPROVAL OF THE FIRST AMENDMENT TO THE REIMBURSEMENT AGREEMENT WITH IRVINE RANCH WATER DISTRICT FOR THE INSTALLATION OF WICK IRRIGATION SYSTEM ON JAMBOREE ROAD - PHASE II SUMMARY Approval of the first amendment to the Reimbursement Agreement with the Irvine Ranch Water District (IRWD) will add a new demonstration site and provide for 50/50 sharing of the cost for modifying another portion of the existing irrigation system on Jamboree Road (Phase II). RECOMMENDATION It is recommended that the City Council approve the first amendment to the Reimbursement Agreement with the IRWD for the installation of the WICK Irrigation System on Jamboree Road - Phase II, and authorize the Mayor and the City Clerk to execute the document. FISCAL IMPACT The design/construction cost associated with the modification of a portion of the existing irrigation on Jamboree Road (Phase II) is estimated to be $100,000. This cost will be shared 50/50 by the City of Tustin and the IRWD. Funds have been budgeted in the Capital Improvement Program Budget for the Jamboree Road Irrigation Replacement Project (CIP No. 1538). BACKGROUND The original irrigation system on Jamboree Road, north of Tustin Ranch Road was installed as part of the Jamboree Road Improvement Project in late 1989. The original system had been evaluated and found to be inefficient in providing adequate water coverage for the turf in the median. This inefficiency has forced the City to use additional water in order to maintain the turf in an attractive, acceptable condition. The additional watering has created water run-off that impacts the life expectancy of the asphalt roadway and increases water expense. On September 4,2001 the City and IRWD entered into a Reimbursement Agreement to modify a small portion of the original irrigation system to make it more efficient and to eliminate as much water run-off as possible. Approval of the First Amendment to the Reimbursement Agreement with Irvine Ranch Water District for the Installation of WICK Irrigation System on Jamboree Road - Phase II July 19, 2004 Page 2 DISCUSSION The City of Tustin and the Irvine Ranch Water District have worked together on a solution and have completed a demonstration project (Phase I) in which a portion of the existing irrigation system on Jamboree Road between Tustin Ranch Road and Patriot Way was modified with new water conservation components called WICK Irrigation System. This demonstration/modification has been evaluated over a period of time for efficiency and water usage with encouraging results. The attached first amendment to the Agreement will expand the demonstration site to include another portion of Jamboree median between Pioneer Road and north City limits (Phase II) and provides for the equal sharing of the cost between the City of Tustin and IRWD. The benefits of this project will help IRWD in conserving water; help the City by reducing water expenses; and improve the iife expectancy of the pavement. The new system will be evaluated in the future for possible expansion within the remaining median on Jamboree Road and other locations throughout the City. Staff is pursuing the application for grant funding (Proposition 50) for future phases of the project. ~ Tim D. Attachment AMENDMENT NO.1 TO REIMBURSEMENT AGREEMENT BETWEEN IRVINE RANCH WATER DISTRICT AND THE CITY OF TUSTIN This AMENDMENT NO.1 TO REIMBURSEMENT AGREEMENT (the "Amendment") is made and entered into as of this day of ,2004, by and between IRVINE RANCH WATER DISTRICT, a California water district formed and existing pursuant to the California Water District Law (hereinafter referred to as "DISTRICT") the CITY OF TUSTIN, a municipal corporation (hereinafter referred to as "CITY"). WITNE S SE TH: WHEREAS, DISTRICT and CITY previously entered into that certain "Reimbursement Agreement Between the Irvine Ranch Water District and the City of Tustin For the Construction of Project No. 1538 (Tustin Code)," dated as of January 31,2002 (the "Agreement"), regarding the construction of Wick irrigation improvements in a defined segment of the Jamboree Road median; WHEREAS, DISTRICT and CITY desire to expand the scope of the Agreement to provide for the construction of additional irrigation improvements under the Agreement; WHEREAS, DISTRICT is amenable to the construction of the additional improvements described below by CITY at the estimated cost of $1 00,000 (including design), 50% of which cost (not to exceed $50,000) is to be reimbursed by DISTRICT after the work is completed; NOW, THEREFORE, the parties hereto, in consideration of the mutual promises and covenants hereinafter set forth, do agree as follows: SECTION 1. DISTRICT and CITY agree that the additional irrigation improvements depicted in Exhibit "A" to this Amendment (the "ADDITIONAL IMPROVEMENTS") are hereby added to the improvements to be constructed subject to cost reimbursement as provided in the Agreement. SECTION 2. This Amendment shall not affect the Wick irrigation improvement project originally constructed under the Agreement. The ADDITIONAL IMPROVEMENTS shall be deemed a new and separate project hereby included within the Agreement, and all of the terms of the Agreement shall apply to the ADDITIONAL IMPROVEMENTS, except as provided in this Amendment. For the purposes of this Amendment, the term "WICK IRRIGMION IMPROVEMENTS" when used in the Agreement shall mean the ADDITIONAL IMPROVEMENTS defined in Section 1 of this Amendment. SECTION 3. The following special terms apply to the construction of the ADDITIONAL IMPROVEMENTS under this Amendment and supersede any contrary provisions of the Agreement: A. The fourth recital of the Agreement is deleted and superseded by the third recital of this Amendment. B. SECTION 2 of the Agreement is revised to read as follows: "CITY agrees that WICK IRRIGATION IMPROVEMENTS shall be completed pursuant to DISTRICT approved plans _and specifications (the "Plans and Specifications") which shall be prepared by CITY andstlpplkd to CITY b} the DISTRICT'S CONSULTANT. The figure "$25,000" used in the first and second sentences of SECTION 4 of the Agreement is deleted and replaced with the figure "$100,000." D. The figure "$12,500" used in SECTION 7 of the Agreement is deleted and replaced with the figure "$50,000." 2 SECTION 4. Either party may terminate this Amendment in the manner provided for termination of the Agreement in SECTIONS 3 and 12 of the Agreement.
