SUBJECT: AWARD CONTRACT FOR THE MEDIAN LANDSCAPE REHABILITATION
PROJECT CIP NO. 10074
SUMMARY
Staff is recommending that the City Council award the construction contract for the Median
Landscape Rehabilitation Project CIP No. 10074 to the lowest responsive / responsible bidder,
California Landscape & Design, Inc.
RECOMMENDATION
It is recommended that the City Council award the construction contract for the Median
Landscape Rehabilitation Project CIP No. 10074 to the lowest responsive/responsible bidder,
California Landscape & Design, Inc., in the amount of $2,994,120.12 and authorize the Mayor
and the City Clerk to execute the contract documents on behalf of the City.
FISCAL IMPACT
Sufficient funds in the amount of $3,653,155 has been budgeted and appropriated in the Capital
Improvement Program for the Median Landscape Rehabilitation Project with a budget allowance
of $150,000 for construction engineering and $450,000 for construction contingency. The
project is funded through a combination of sources that include Gas Tax (Fund 130), Measure
M2 Fair Share (Fund 139), Measure M2 Environmental Cleanup Program Grant (Fund 139),
and MCAS Land Sale Proceeds (Fund 189).
CORRELATION TO THE STRATEGIC PLAN
The project contributes to the fulfillment of the City's Strategic Plan Goal B: Public Safety and
Protection of Assets, to ensure Tustin is an attractive, safe and well maintained community in
which people feel pride. Specifically, the project implements Strategy #3, which among other
items, is to ensure continuous maintenance and improvement of public facilities.
DISCUSSION AND BACKGROUND
On April 1, 2015, the Governor of the State of California issued Executive Order B-29-15,
imposing strict temporary water use restrictions to mitigate the effects of severe drought
conditions that continued to persist throughout the state. Among other restrictions, the Order
prohibits the irrigation with potable water of ornamental turf on public street medians.
Subsequently, Executive Order B-37-16 "Making Water Conservation a California Way of Life"
was issued on May 9, 2016, making permanent many of the orders and provisions included in
previous Emergency Proclamations and Executive Orders, including the prohibition of irrigation
of ornamental turf in public street medians.

In compliance with the Order, the Median Landscape and Rehabilitation Project (CIP No.
10074) will remove dead median turf along Irvine Blvd. between the SR -55 Freeway and Old
Irvine Blvd., along First St. between the SR -55 Freeway and Newport Ave., and along Newport
Ave. between Wass St. and McFadden Ave., and replace with drought tolerant plant material
and water efficient irrigation systems. Also included in the project are removal of existing
substandard height median curbs and replacement with full height curbs, installation of median
pavers and decorative hardscape, and utility relocations.
The City Council adopted Resolution No. 17-27 approving the plans and specifications and
authorized and directed the City Clerk to advertise for project bids on August 1, 2017. The
project was advertised and the bids were opened on October 3, 2017 and evaluated. The
engineer's estimate was $3,100,000. A budget allowance of $150,000 for construction
engineering (material and equipment testing and inspection services) and $450,000 for
construction contingency is recommended. The use of the construction contingency is only for
unforeseen circumstances that may arise necessary to complete the work within the approved
project scope and appropriation.
