SUBJECT: APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE
ADVERTISEMENT FOR BIDS FOR THE PETERS CANYON CHANNEL
IMPROVEMENTS CONSTRUCTION PROJECT, CIP NO. 50040
SUMMARY
The plans and specifications for the Peters Canyon Channel Improvements Construction
Project, CIP No. 50040 have been prepared and the project is ready to be bid.
RECOMMENDATION
It is recommended that the City Council:
1. Adopt Resolution No. 17-54 approving the plans and specifications for the Peters
Canyon Channel (CIP No. 50040) Improvements Construction Project; and
2. Authorize the City Clerk to advertise to receive bids.
FISCAL IMPACT
Sufficient funds have been budgeted and appropriated in this Fiscal Year 2017-2018 Capital
Improvement Program for the project in the Peters Canyon Channel Improvements, CIP No.
50040. The engineer's estimate for the project is $16,100,000. The project is funded through
Legacy Backbone Infrastructure Fees (Fund 187).
CORRELATION TO THE STRATEGIC PLAN
The construction of Peters Canyon Channel Improvements contributes to the fulfillment of three
goals in the City's Strategic Plan. First is contribution to the fulfillment of the City's Strategic
Plan Goal A: Economic and Neighborhood Development; specifically implementation of Strategy
#1 which, among other items, is to develop critical phases of Tustin Legacy. Secondly is
implementation of Goal B, Strategy #3 to ensure public safety and protection of assets through
continuous maintenance and improvement of public facilities. Lastly the agreement also
addresses Goal D, Strategy #2 by working collaboratively with agencies to address issues of
mutual interest and concern.
DISCUSSION AND BACKGROUND
The City, Orange County Flood Control District, and the County of Orange entered in to
Cooperative Agreement D02-119 dated March 11, 2003 to establish terms and conditions under
which certain Peter's Canyon Channel Flood Control Improvements are to be scheduled,
engineered, financed, constructed, operated, and maintained. Amendment No. 3 to
Cooperative Agreement D02-119, approved on July 5, 2017 and signed by the County on
August 4, 2017 increased the residential certificate of occupancy limit of 1,200 units, established
in the 2nd amendment to the agreement with the Orange County Flood Control District
Plans and Specifications Approval for Peters Canyon Channel Improvements

(OCFCD) and the County of Orange, by an additional 200 units to 1,400 units. Prior to that limit
being reached, a contract for the construction of the Peter's Canyon Channel Improvements is
required to be awarded and construction commenced.
The Peters Canyon Channel Improvement project from north of Edinger Avenue to just north of
Warner Avenue consists of widening the channel by approximately thirty feet along the eastern
edge and construction of a concrete channel lining. The project will also provide improvements to
the pedestrian and bicycle trail on the east side of the channel.
The tentative schedule for construction of the project is as follows:

RESOLUTION NO. 17-54
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE PETERS
CANYON CHANNEL IMPROVEMENTS CONSTRUCTION PROJECT, CIP NO.
50040, AND AUTHORIZING ADVERTISEMENT FOR BIDS
WHEREAS, it is the intention of the City Council of the City of Tustin, California to
contract for the construction of the Peters Canyon Channel Improvements Construction Project,
CIP No. 50040; and
WHEREAS, the City Engineer has presented plans and specifications for the
construction of said work; and
WHEREAS, on January 16, 2001, the City of Tustin certified the Program Final
Environmental Impact Statement/Environmental Impact Report (FEIS/EIR) for the reuse and
disposal of MCAS Tustin. On December 6, 2004, the City Council adopted Resolution No. 04-
76, approving a Supplement to the FEIS/EIR for the extension of Tustin Ranch Road between
Walnut Avenue and the future alignment of Valencia North Loop Road. On April 3, 2006, the
City Council adopted Resolution No. 06-43 approving an Addendum to the FEIS/EIR. On May
13, 2013, the City Council adopted Resolution No. 13-32 approving the 2nd Addendum to the
FEIS/EIR. The FEIS/EIR along with its Addendums and Supplement is a program EIR under the
California Environmental Quality Act (CEQA). The FEIS/EIR, Addendum and Supplement
considered the potential environmental impacts associated with development on the former
Marine Corps Air Station, Tustin; and
WHEREAS, an environmental checklist was prepared for the proposed project that
concluded no additional environmental impacts would occur from approval of the project. The
Environmental Analysis Checklist concludes that it can be seen with certainty that there is no
possibility that the activity in question may have a significant effect on the environment because
all potentially significant effects 1) have been analyzed adequately in an earlier EIR pursuant to
applicable standards, and 2) have avoided or mitigated pursuant to that earlier EIR, including
revisions or mitigation measures that are imposed upon the proposed project; and
NOW, THEREFORE,, BE IT RESOLVED that the plans and specifications presented by
the City Engineer are hereby approved as the plans and specifications for:
Peters Canyon Channel Improvements Construction Project, CIP No. 50040
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to
advertise as required by law for the receipt of sealed bids or proposals for the performance of
the work specified in the aforesaid plans and specifications;
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin
held on the 7t" day of November 2017.
