PARKER, CITY MANAGER SUBJECT: ORDINANCE ADDING SECTION 7114 TO CHAPTER 1 OF ARTICLE 7 OF THE TUSTIN CITY CODE IDENTIFYING THE TUSTIN CIVIC CENTER PLAZA AND ADOPTING REGULATIONS GOVERNING THE USE OF THE TUSTIN CIVIC CENTER PLAZA SUMMARY: The proposed Ordinance 1488 would, if adopted, define the public property which encompasses Tustin City Hall, the Tustin Branch of the Orange County Library, the Tustin Police Department and the public property adjacent thereto as the Tustin Civic Center Plaza. Additionally, the proposed Ordinance would provide for regulations regarding permissible and prohibited use of the newly defined Tustin Civic Center Plaza. RECOMMENDATION: Conduct the first reading by title only of Ordinance 1488 and direct staff to schedule the Ordinance for second reading and adoption at the next regular meeting of the Council. FISCAL IMPACT: Potential cost of enforcement and cost of placing required signs regarding nightly closures of the Tustin Civic Center Plaza. STRATEGIC PLAN: The proposed ordinance advances Tustin Strategic Plan Goal B, Public Safety and Protection of Assets, to "Ensure Tustin is an attractive, safe and well maintained community in which people feel pride." BACKGROUND AND DISCUSSION: The proposed Ordinance will serve to promote the City's goals of providing public property which is safe, clean and attractive, and which is readily available for use by all members of the community in the manner in which it was intended. Particularly, the proposed Ordinance will serve to preserve the public property surrounding Tustin City Hall, the building currently designated as the Tustin Branch of the Orange County Public 1279187.1 Ordinance Defining Tustin Civic Center Plaza And Providing Regulations Regarding Its Use November 7, 2017 Page 2 Library system, and the Tustin Police Department by defining that area as the Tustin Civic Center Plaza and by providing for regulations related to the use of that public property. The purpose of the proposed Ordinance is to maintain and preserve the Tustin Civic Center in a clean, safe and sanitary condition. Additionally, the Ordinance will serve to protect the health, safety and general welfare of the residents of the City of Tustin and the community at large by maintaining accessibility of the Tustin Civic Center Plaza so that it may be used for its intended purpose by all residents, businesses and visitors to the City. The Ordinance does not interfere with the lawful and ordinary uses of public property. Unlike parks within the City of Tustin, there are no regulations which govern the use of the Tustin Civic Center Plaza. Accordingly, conduct which is generally prohibited in City parks (e.g. littering, defacing of property, gambling, etc.) is not expressly prohibited on the public property which surrounds Tustin City Hall and the adjacent publicly owned buildings. Further, unlike City parks, the Tustin Civic Center Plaza is not currently subject to hours of closure. By imposing use regulations and dictating the hours during which use of the Tustin Civic Center Plaza is prohibited, the City will provide law enforcement personnel with tools to more effectively prevent illegal activity such as consumption of alcohol, use of narcotics, vandalism, etc., particularly during night time hours when such activity is more common. Proposed Ordinance 1488: If adopted, proposed Ordinance 1488, will add Section 7114 to Chapter 1 of Article 7 of the Tustin City Code. This section will define the Tustin Civic Center Plaza as the "exterior open public areas generally bounded by Centennial Way to the East; East Main Street to the South; South Prospect Avenue, and the parcels of private properties identified as 217- 249 Preble Drive, and 309 East 31d Street to the West; and East 31d Street and the parcels of private property identified as 380-436 East 2nd Street, and 190 Centennial Way to the North. (See, Map Included within proposed Ordinance) In addition, proposed Ordinance 1488 will prohibit various forms of conduct within that area which are detrimental to the public health, safety and welfare including, but not limited to, use of alcohol and narcotics, gambling, littering, defacing property, destroying landscaping materials, creating fires, carrying weapons, and entry into areas that are closed to the public. Finally, proposed Ordinance 1488 will dictate that the Tustin Civic Center Plaza be closed to the public during the hours of 12:00 a.m. and 5:00 a.m. each day (subject to certain specified exceptions).
