It was moved by Mayor Pro Tem Murray and seconded by Councilmember Gomez to pull
Items 4 and 5 and approve the balance as recommended by staff.

1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON
THE AGENDA
Motion: That the City Council waive reading in full of all ordinances and
resolutions on the agenda and declare that said titles which appear on the public
agenda shall be determined to have been read by title and further reading
waived.
2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL
HELD ON OCTOBER 17, 2017.
Motion: That the City Council approve the Action Minutes of the Regular Meeting
of the City Council held on October 17, 2017.
3. RATIFICATION OF PAYROLL AND DEMANDS

The City Council has approved the use of Government Code Section 37208 to
expedite the payment of City of Tustin obligations that are in accordance with the
approved budget or continued operations authorizations.
Motion: That the City Council approve Payroll in the amounts of $770,267.54
and $777,710.46; and Demands in the amount of $2,445,408.63.
4. OPT -IN TO CALIFORNIA STATEWIDE COMMUNITIES DEVELOPMENT
AUTHORITY OPEN PACE PROGRAM
City Council adoption is requested to opt -in to the California Statewide
Communities Development Authority (CSCDA) Open PACE Program, allowing
five (5) more Property Assessed Clean Energy (PACE) programs to operate
within the City.
Councilmember Gomez requested clarification on the number of residents that
utilize this program. City Manager Jeffrey C. Parker replied that the program has
received applications for the following: 25 water, 45 solar and 275 energy
conservation.
It was moved by Councilmember Gomez and seconded by Mayor Pro Tem
Murray to adopt Resolution No. 17-55, consenting to include properties within the
City of Tustin's territory in the CSCDA AB 811 Open PACE Program, in order to
finance renewable energy improvements, energy efficiency and water
conservation improvements, electric vehicle charging infrastructure and other
authorized improvements.

RESOLUTION NO. 17-55
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNA CONSENTING TO THE INCLUSION OF PROPERTIES WITHIN
THE TERRITORY OF THE CITY IN THE CSCDA OPEN PACE PROGRAMS;
AUTHORIZING THE CALIFORNIA STATEWIDE COMMUNITIES
DEVELOPMENT AUTHORITY TO ACCEPT APPLICATIONS FROM
PROPERTY OWNERS, CONDUCT CONTRACTUAL ASSESSMENT
PROCEEDINGS AND LEVY CONTRACTUAL ASSESSMENTS WITHIN THE
TERRITORY OF THE CITY; AND AUTHORIZING RELATED ACTIONS
5. AWARD CONTRACT FOR THE MEDIAN LANDSCAPE REHABILITATION
PROJECT CIP NO. 10074
Director of Public Works Douglas S. Stack provided a PowerPoint presentation.
Staff is recommending that the City Council award the construction contract for
the Median Landscape Rehabilitation Project CIP No. 10074 to the lowest
responsive/responsible bidder, California Landscape & Design, Inc.

It was moved by Mayor Bernstein and seconded by Councilmember Gomez to
award the construction contract for the Median Landscape Rehabilitation Project
CIP No. 10074 to the lowest responsive/responsible bidder, California Landscape
& Design, Inc., in the amount of $2,994,120.12 and authorize the Mayor and the
City Clerk to execute the contract documents on behalf of the City.

6. AWARD CONTRACT FOR THE EL CAMINO REAL/JAMBOREE ROAD
MEDIAN MODIFICATIONS AND STRIPING REVISIONS PROJECT, CIP NO.
70238
Staff is recommending that the City Council award the construction contract for
the EI Camino Real/Jamboree Road Median Modifications and Striping Revisions
Project, CIP No. 70238 to the lowest responsive/responsible bidder, Aramexx
Group, Inc.
Motion: That the City Council award the construction contract for the EI Camino
Real/Jamboree Road Median Modifications and Striping Revisions Project, CIP
No. 70238 to the lowest responsive/responsible bidder, Aramexx Group, Inc., in
the amount of $112,955.00, appropriate an additional $20,000 from Gas Tax fund
balance to cover construction contingency and authorize the Mayor and the City
Clerk to execute the contract documents on behalf of the City.
7. APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE
ADVERTISEMENT FOR BIDS FOR THE PETERS CANYON CHANNEL
IMPROVEMENTS CONSTRUCTION PROJECT, CIP NO. 50040
The plans and specifications for the Peters Canyon Channel Improvements
Construction Project, CIP No. 50040 have been prepared and the project is ready
to be bid.
Motion: That the City Council:
Adopt Resolution No. 17-54 approving the plans and specifications for the
Peters Canyon Channel (CIP No. 50040) Improvements Construction
Project; and
2. Authorize the City Clerk to advertise to receive bids.

8. AUTHORIZE PUBLIC WORKS TO PURCHASE AND INSTALL BIOCLEAN
ENVIRONMENTAL SERVICES WATER QUALITY DEVICES CIP 50036
Staff is requesting City Council to authorize Public Works to contract with
BioClean Environmental Services to purchase and install water quality devices
for Phase 6 of the Citywide Catch Basin BMP's Project CIP 50036.
Motion: That the City Council authorize the City of Tustin to use, purchase and
install 108 water quality devices at various locations throughout the City for Phase
6 of the Citywide Installation of Catch Basin BMP's Project CIP 50036.
9. APPROVE GRANT OF EASEMENT TO WICKLAND PIPELINES LLC OVER
PORTIONS OF LOTS 2 AND C OF TR 17144
Wickland Pipelines LLC (Wickland) is requesting a non-exclusive easement from
the City of Tustin for the purpose of connecting the John Wayne Airport Jet Fuel
Pipeline cathodic protection system to a power access point owned and operated
by the Southern California Edison Company (SCE).
Motion: That the City Council grant an easement to Wickland over portions of
lots 2 and C of TR 17144 as shown on the attached easement document exhibits
for electrical facilities and access purposes, and authorize the Mayor and City
Clerk to execute the document on behalf of the City.
10. REJECTION OF ALL BIDS AND AUTHORIZATION TO POSTPONE
ADVERTISEMENTS FOR BIDS FOR THE CLIFTON C. MILLER COMMUNITY
CENTER AUDITORIUM RENOVATION (CIP NO. 20079)
Staff is recommending that the City Council reject all bid proposals received on
the Clifton C. Miller Community Center Auditorium Renovation (CIP No. 20079).
The City received six (6) bids (one of which was withdrawn by the bidder) for this
project, all considerably higher than the engineer's estimate.
Motion: That the City Council reject all bids received for the Clifton C. Miller
Community Center Auditorium Renovation (CIP No. 20079) and direct the City
Clerk to return all bid bonds and re -advertise for bids at a later date.
REGULAR BUSINESS ITEMS 11-14
11. SECOND READING AND ADOPTION OF ORDINANCE NO. 1487
Ordinance No. 1487 amends the Tustin City Code by adding Chapter 11 to Article
4 regarding the regulation of unmanned aircraft.

It was moved by Mayor Pro Tem Murray and seconded by Councilmember
Gomez to have second reading by title only and adoption of Ordinance No. 1487
by roll call vote.
Motion carried: 4-0
ORDINANCE NO. 1487
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA ADDING CHAPTER 11 TO ARTICLE 4 OF THE TUSTIN CITY
CODE REGARDING THE REGULATION OF UNMANNED AIRCRAFT.
12. TUSTIN AREA SENIOR CENTER NEEDS ASSESSMENT
Director of Public Works David A. Wilson provided a PowerPoint presentation.
RJM Consultant Bob Mueting provided a PowerPoint presentation.
The Tustin Area Senior Center Needs Assessment has been completed and the
final report has been submitted.
It was moved by Councilmember Gomez and seconded by Councilmember Clark
to form an ad hoc committee of two Council Members (Councilmember Gomez
and Councilmember Clark) to review the report with staff and discuss at the 2018
Strategic Planning Workshop early next year.

13. PUBLIC ART POLICY OPTIONS
On May 17, 2016, staff presented the City Council a Gift Public Art Policy
regarding the reviewing, accepting, or rejecting of public art projects proposed to
be gifted to the City. The City Council directed staff to prepare and return with a
more consolidated policy addressing gifted art, donations of art, and City
commissioning of public art projects.
Director of Parks and Recreation David A. Wilson provided a PowerPoint
presentation.
It was moved by Mayor Bernstein and seconded by Councilmember Gomez to
refer the policy to the Community Services Commission and provide a
recommendation to the City Council for consideration at a future meeting.
Amended Motion: Councilmember Gomez amended the motion to include a
deadline to return to the City Council on the first meeting in March. It was moved
Mayor Bernstein and seconded by Councilmember Gomez to include the
amended motion.

14. ORDINANCE ADDING SECTION 7114 TO CHAPTER 1 OF ARTICLE 7 OF THE
TUSTIN CITY CODE IDENTIFYING THE TUSTIN CIVIC CENTER PLAZA AND
ADOPTING REGULATIONS GOVERNING THE USE OF THE TUSTIN CIVIC
CENTER PLAZA
The proposed Ordinance 1488 would, if adopted, define the public property which
encompasses Tustin City Hall, the Tustin Branch of the Orange County Library,
the Tustin Police Department and the public property adjacent thereto as the
Tustin Civic Center Plaza. Additionally, the proposed Ordinance would provide
for regulations regarding permissible and prohibited use of the newly defined
Tustin Civic Center Plaza.
It was moved by Mayor Pro Tem Murray and seconded by Councilmember
Gomez to conduct the first reading by title only of Ordinance 1488 and direct staff
to schedule the Ordinance for second reading and adoption at the next regular
meeting of the Council.

Attended the Tustin Police Department Tip -A -Cop event at Red Robin to raise money for
the Special Olympics.

Attended the Tustin Parks and Recreation Art Walk event in Old Town Tustin; thanked all
those who participated as well as the Parks and Recreation staff for making the Art Walk a
wonderful community event.
October 23
Attended the Habitat for Humanity Groundbreaking event; announced the event was a
wonderful idea and a great collaboration between the City of Tustin, local non-profit groups
and well deserving residents; announced Communications Manager Stephanie Najera
would be scheduling a day for the Council to participate in the project.

Attended the Orange County Teacher of the Year event at the Disneyland Hotel.

Attended the Stater Brothers Ribbon Cutting Ceremony at the Tustin Legacy; spoke to many
happy residents regarding the variety and quality at the new store.

Attended Tustin's Mayor Business Recognition Luncheon; luncheon is a wonderful way of
honoring local businesses and allows them to be introduced to other patrons and to gain a
following.
November 2
Announced she was unable to attend services for longtime Tustin Senior Center Volunteer
Mary Konjoyan; Mary is a great loss to the Tustin Senior Community.

Attended the Tustin Public Schools Foundation Dinosaur Dash at the Market Place; Tustin
Police Chief Charles F. Celano Jr., was the lead cyclist to kick-off the bike races.

Attended the Tustin Unified School District's College Night at Tustin High School; was a
good way to introduce students to different colleges and careers.

allow the City to serve more seniors and widen the routes to serve more medical
facilities.
o Attended the Tustin Senior Fund meeting; funds were allocated and special projects
were approved for the upcoming year.

Attended the Orange County Mosquito and Vector Control meeting; the second West Nile
related death was reported in Fullerton.
October 23
Joined TyRon Jackson and nine (9) families at Roma D' Italia to celebrate Operation Warm
Wishes Ninth Anniversary; Operation Warm Wishes does a great job within the Tustin
Community to help homeless and underserved families; was great to celebrate with them.
October 24
Attended with colleagues a V.I. P tour of the new Stater Brothers at the Tustin Legacy.
October 25
Attended the Stater Brothers Ribbon Cutting Ceremony at the Tustin Legacy; announced

that Stater Brothers has a cookie credit card for children, when a child presents the credit
card, they receive a free cookie.
November 1
Attended Tustin's Mayor Business Recognition Luncheon; announced the Business
Recognition Luncheon was one of the nicest events attended this year; enjoyed meeting
the new business owners as well as business owners who are unable to attend City
functions; congratulated Communications Manager Stephanie Najera and City staff for a
great event.
November 4
Judged the Inaugural Mr. Tustin Pageant, to benefit the Miss Tustin Scholarship;
congratulated Tustin Recreation Coordinator, Garrsion De Vine, Blue Buoy Swim School,
Johnny Johnson, former Tustin Chamber of Commerce Chair, Chris Cusac, Tustin
Community Service Commissioner, Barry Cooper, and Mayor Bernstein's son, Adam
Bernstein for being contestants; Johnny Johnson won the title of Mr. Tustin; enjoyed
participating with the pageant.
November 5
Attended the Tustin Public Schools Foundation Dinosaur Dash at the Market Place; many
runners participated; fun to see all the parents and students representing their schools
proudly.
November 7
Participated in the christening of the two new Senior Center buses; congratulated Director
of Parks and Recreation, David A. Wilson, Deputy Director of Parks and Recreation Chad
Clanton, Recreation Supervisor, Marilyn Buescher, and staff for their hard work and effort
in receiving the grant for the buses.

o Attended the Orange County Young Republicans meeting with Senator Patricia
Bates, held in Tustin.

o Attended the Association of California Cities of Orange County (ACCOC) Municipal
Law Seminar and Review; discussed new laws for 2018, which will affect city
government.
o Attended the V.I. P tour of the new Stater Brothers at the Tustin Legacy.

Attended the Stater Brothers Ribbon Cutting Ceremony at the Tustin Legacy.

o Attended the Orange County Community Service Program (CSP) Breakfast to
celebrate their 45th Anniversary; CSP provides assistance to police departments
dealing with juvenile arrests; during the breakfast, the organization announced that
the organization is changing its name to Wayfinder.
o Attended the Grand Opening and Ribbon Cutting Ceremony for Golden Bank with
Santa Ana Mayor Miguel A. Pulido, and members of the Tustin Chamber of
Commerce.
o Attended the California Women's Leadership Association Women to Watch Awards
Luncheon; City of Anaheim Council Member Kris Murray received the 2018 Woman
of the Year award.
October 27
o Attended the Cop on a Rooftop Fundraiser with Mayor Bernstein, at Dunkin Donuts;
the donations were collected for the Special Olympics; enjoyed the event.
o Attended a Digital Speaking Presentation with Elected Officials by Cox
Communication; presentation was on the challenges with digital communications.
October 28
Participated in the Public Safety panel for the Southern California Jack and Jill Conference
in Costa Mesa; discussed public safety careers, challenges for teenagers dealing with the
driving laws, and interaction with police officers.
November 1
o Attended Tustin's Mayor Business Recognition Luncheon.
o Attended the Orange County Drowning Prevention Task Force meeting.
o Attended the Heroes with a Heart Dinner in Anaheim; event recognizes police
officers, firefighters and hospital personnel who went above the call of duty

throughout the year.
November 2
o Participated in the Orange County Transportation Authority (OCTA) Inaugural Los
Angeles (L.A.) Metro Regional Coordination meeting; chaired by L.A. Mayor and
Metro Board of Director Chair Eric Garcetti and OCTA Chair Michael Hennessey;
was first time the two counties have met for a joint meeting; goals were established
and a MOU was signed; Mayor James T. Butts Jr. from the City of Inglewood, gave
an update on the new football stadium being built.
o Attended the Orange County Selection Committee meeting; was re -appointed to the
Orange County Transportation Authority (OCTA) Board; congratulated Council
Member Gomez for being re -appointed to the Third District Senior Advisory Board
position.
November 5
o Attended the Tustin Public Schools Foundation Dinosaur Dash at the Market Place.
o Announced daughter competed in the Gymnastics Final Championship Meet in
Huntington Beach; received second place on the beam, fourth place on the floor, and
won the handstand contest.
November 6
Attended the Orange County Transportation Authority (OCTA) Executive meeting;
discussed the next ten years of funding challenges in transportation for Orange County.
November 7
Participated in the christening of the two new Senior Center buses; congratulated
Recreation Supervisor Marilyn Buescher on receiving the grant for two (2) $75,000 buses,
funding for one of the drivers, and working with OCTA; job well done.
Expressed that the Sutherland Springs Texas massacre was a terrible tragedy; encouraged
all that if one ever feels threatened or is uneasy in a situation to inform others and/or the
police department.
Thanked all Veterans for their service in honor of Veterans Day.

meeting; congratulated the Tustin Police Department for phenomenal job on keeping
the city safe.

Participated in the Point of Dispensing Event at the Columbus Tustin Activity Center; a
disaster drill, led by the Tustin Police Department and various members of the community;
free flu shots were available at the drill.
October 28
o Attended the Tustin Kiwanis Club Pancake Breakfast at John Patterson's Mazda
Dealership.
o Attended the Tustin Boys and Girls Club Gala; Peter Noone from Herman's Hermits
was in attendance; many funds were raised for a worthy cause.
November 1
o Hosted the Tustin's Mayor Business Recognition Luncheon; congratulated
Communications Manager Stephanie Najera and City staff for a great event.
o Attended the Orange County Sanitation District Operations Committee meeting;
invited everyone to go to the Orange County Sanitation District website to learn about
the wonderful things that are being done within the District.

Attended the Orange County City Selection Committee meeting; congratulated Mayor Pro
Tem Murray for maintaining his position on the Orange County Transportation Authority
(OCTA) Board; congratulated Council Member Gomez for her re -appointment to the Third
District Senior Advisory Board position.
November 4
Attended the Inaugural Mr. Tustin Pageant to benefit the Miss Tustin Scholarship Program;
congratulated all the contestants who participated including Tustin Community Service
Commissioner, Barry Cooper and Recreation Coordinator, Garrison De Vine; thanked Miss
Tustin Executive Director, Jen Kohlenberger, Pam Sailor, and Miss Tustin, Emma Foss for
their hard work and dedication.
November 5
Attended the Tustin Public Schools Foundation Dinosaur Dash at the Market Place; great
turn -out of participants.
November 6
Attended the National Adoption Month Ceremony at the Tustin Area Senior Center; was a
wonderful event; congratulated everyone who took part in the ceremony.
November 7
o Attended the Association of California Cities -Orange County Water Committee
meeting.

o Participated in the christening of the two new Senior Center buses; congratulated
Director of Parks and Recreation, David A. Wilson, Recreation Supervisor, Marilyn
Buescher, Recreation Coordinator, Garrison DeVine, and Senior Advisory Board
Member, Don Ropele for their hard work on receiving the grant.
Expressed that the Sutherland Springs Texas massacre was a terrible tragedy; on behalf of
Tustin, our hearts go out to all the victims and families affected by the tragedy.
Thanked Veterans for their service in honor of Veterans Day; encouraged all to fly the
American flag proudly.
