STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: AWARD OF CONTRACT FOR SENIOR CENTER ALTERNATE POWER SOURCE IMPROVEMENTS CIP 10073 SUMMARY Staff is requesting that the City Council award the construction contract for the Senior Center Alternate Power Source Improvements CIP No. 10073 to the lowest responsive/responsible bidder. RECOMMENDATION It is recommended that the City Council deny the bid protest submitted by AMTEK Construction and award the construction contract for the Senior Center Alternate Power Source Improvements CIP No. 10073 to the lowest responsive/responsible bidder, The Stone Collector, in the amount of $350,000 and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. FISCAL IMPACT Sufficient funds from the Community Development Block Grant (CDBG) Fund will be utilized in - lieu of budgeted and appropriated funds from Fund 184 for this project in Capital Improvement Program CIP No. 10073, pursuant to City Council action on October 3, 2017 adopting Resolution 17-48 approving amendments to the 2015-16 and 2016-17 Action Plans, to transfer unused funds to the Senior Center Alternative Power Source Improvements, which can be immediately implemented during the 2017-18 Program Year. CORRELATION TO THE STRATEGIC PLAN The recommended actions contribute to the fulfillment of the City's Strategic Plan Goal B, Public Safety and Protection of Assets. BACKGROUND The installation of a generator at Tustin Area Senior Center (TASC) will be an added power source. TASC has been chosen as the City's 1st Alternate Seat of Government in the event the Civic Center is not usable because of emergency conditions. In addition, TASC is designated as the City's Cooling Center for seniors when temperatures are deemed extreme. Furthermore, the need for TASC to become an emergency designated shelter is a probable scenario. The installation of an alternate power source at this site will be necessary when Southern California Edison (SCE) needs to implement a Rotating Outage. Rotating outages occur when Senior Center Alternate Power Source Improvements November 21, 2017 Page 2 SCE needs to ease the burden of energy needs in a geographical area. Typically, in the summer, SCE will shut down power intentionally. The City Council approved plans and specifications and authorized soliciting bids at the September 19, 2017 meeting. Formal bids were received on October 24, 2017 and reviewed by the Public Works Department. The Engineer's Estimate was $366,847. Nine (9) contractors attended the pre-bid job walk and four (4) bids were received and are summarized below by order of least dollar amount: • The Stone Collector............................................................................... $350,000 • Newbuild Construction and Restoration, Inc .......................................... $377,000 • AMTEK Construction............:................................................................ $397,566 • Minco Construction................................................................................ $465,170 The City received a Formal Bid Protest dated October 25, 2017 from AMTEK Construction. In the protest, AMTEK Construction requested that the City find the two apparent lowest bidders, The Stone Collector and Newbuild Construction and Restoration, Inc., non-responsive for their alleged failure to include all subcontractors for the proposed work. Specific allegations were aimed at concrete, paving/earthwork and masonry. After a staff review of both The Stone Collector's bid and consultation with the City Attorney's office, the Stone Collector's bid was found to be responsive and able to perform these tasks under its current Class B License. In accordance with the Business & Professions Code Division 3, Chapter 9. Contractors, Article 4. Classifications, a General Building Contractor with a Class B License can self -perform the scope of work as required in the contract bid documents for the Project. A General Building Contractor with a "B" license can take a prime contract for projects, requiring in its construction the use of at least two unrelated building trades other than framing or carpentry, or to do the whole or any part thereof. It is recommended that the City Council deny the bid protest submitted by AMTEK Construction and award the construction contract for the Senior Center Alternate Power Source Improvements CIP No. 10073 to the lowest responsive/responsible bidder, The Stone Collector, in the amount of $350,000 and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City.
