CLOSED SESSION UPDATE — City Attorney David E. Kendig CLOSED SESSION ITEMS - The Brown Act permits legislative bodies to discuss certain matters without members of the public present. The City Council finds, based on advice from the City Attorney, that discussion in open session of the following matters will prejudice the position of the City in existing and anticipated litigation: 1 . CONFERENCE WITH LEGAL COUNSEL—ANTICIPATED LITIGATION - Significant exposure to litigation pursuant to Government Code § 54956.9(d)(2): (Two Cases) WRITTEN MATERIALS — Materials that are distributed to a majority of the Council members, less than 72 hours prior to the Regular Meeting, are available for public inspection at the following locations: In the City Clerk's Office during regular business hours and following business hours (after 5:30 p.m.) in the Council Chamber on the day of the meeting. PRESENTATIONS — o Gem of Tustin - Bob Ammann and Ivan Bishop CONSENT CALENDAR ITEMS All matters listed under the Consent Calendar are considered to be routine and will be enacted by one motion without discussion. Persons wishing to speak regarding Consent Calendar matters should file a"Request to Speak"form with the City Clerk. (Agenda Items 1 through 8) 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Recommendation: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL HELD ON NOVEMBER 7, 2017 AND THE SPECIAL MEETING OF THE CITY COUNCIL HELD ON NOVEMBER 7, 2017. City Council November 21, 2017 Meeting Agenda Page 3 of 6 Recommendation: That the City Council approve the Action Minutes of the Regular Meeting of the City Council held on November 7, 2017 and Special Meeting of the City Council held on November 7, 2017. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Recommendation: That the City Council approve Payroll in the amounts of $733,219.40; and Demands in the amount of$3,524,725.49. 4. QUARTERLY INVESTMENT REPORT FOR THE CITY OF TUSTIN AND THE SUCCESSOR AGENCY FOR THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY Government Code Section 53646 requires that the Treasurer make an Investment Report to the City Council at least quarterly showing balances by authorized investment and certifying its compliance with the adopted Investment Policy. Recommendation: That the City Council receive and file. 5. CANCELLATION OF THE JANUARY 2, 2018 CITY COUNCIL MEETING Due to a lack of quorum, staff recommends cancellation of the January 2, 2018 Regular City Council meeting. Recommendation: That the City Council direct the City Clerk to post a Notice of Cancellation for the regularly scheduled Council meeting on January 2, 2018. The City Council hereby waives notice of said meeting as required by Government Code §54954. 6. AWARD OF CONTRACT FOR SENIOR CENTER ALTERNATE POWER SOURCE IMPROVEMENTS CIP 10073 Staff is requesting that the City Council award the construction contract for the Senior Center Alternate Power Source Improvements CIP No. 10073 to the lowest responsive/responsible bidder. Recommendation: That the City Council deny the bid protest submitted by AMTEK Construction and award the construction contract for the Senior Center Alternate Power Source Improvements CIP No. 10073 to the lowest responsive/responsible bidder, The Stone Collector, in the amount of $350,000 City Council November 21, 2017 Meeting Agenda Page 4 of 6 and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. 7. APPROVE COOPERATIVE AGREEMENT NO. C-7-1863 WITH THE ORANGE COUNTY TRANSPORTATION AUTHORITY FOR THE BICYCLE CORRIDOR IMPROVEMENT PROGRAM MAIN STREET/EL CAMINO REAL IMPROVEMENT PROJECT Staff is requesting that the City Council approve the Cooperative Agreement No. C-7-1863 with the Orange County Transportation Authority (OCTA) for the Bicycle Corridor Improvement Program (BCIP) Main Street/EI Camino Real Improvement Project. The City Council at their regular meeting on April 19, 2016, previously adopted Resolution No. 16-22 to submit the application and appropriate the minimum match for funding the construction phase of the Main Street/EI Camino Real Improvement Project. Recommendation: That the City Council approve Cooperative Agreement No. C-7-1863 with OCTA for the BCIP Main Street/EI Camino Real Improvement Project, and authorize the Mayor and City Clerk to execute the agreement on behalf of the City. 8. SUMMARY OF PROJECTS The following report provides a summary of projects and activities from the Community Development Department to the Tustin City Council. The report focuses on the status of projects that the Planning Commission, Zoning Administrator, or staff approved; major improvement projects; Certificates of Appropriateness; Code Enforcement activities; and, other items of interest. Recommendation: That the City Council receive and file this item. REGULAR BUSINESS ITEM Matters listed under Regular Business are generally proposals for new legislation or items requiring discussion (Agenda Item 9) 9. SECOND READING AND ADOPTION OF ORDINANCE NO. 1488 Ordinance No. 1488 amends the Tustin City Code by adding Section 7114 to Chapter 1 of Article 7 of the Tustin City Code identifying the Tustin Civic Center Plaza and adopting regulations governing the use of the Tustin Civic Center Plaza Recommendation: That the City Council have second reading by title only and adoption of Ordinance No. 1488. City Council November 21, 2017 Meeting Agenda Page 5 of 6 ORDINANCE NO. 1488 AN ORDINANCE OF THE CITY OF TUSTIN, CALIFORNIA, ADDING SECTION 7114 TO CHAPTER 1 OF ARTICLE 7 OF THE TUSTIN CITY CODE IDENTIFYING THE TUSTIN CIVIC CENTER PLAZA AND ADOPTING REGULATIONS GOVERNING THE USE OF THE TUSTIN CIVIC CENTER PLAZA.
