OK 'F n d +1;• garr ,.. ._ r-'^ ,- ,.. e;p,r ti-tt v.ar'.,q., 305 and 315 South C Street BACKGROUND AND DISCUSSION At the November 14, 2017, Planning Commission meeting, a representative of the Tustin Preservation Conservancy presented the Commission with a letter (Attachment A) regarding the pending sale of the vacant Mary Tustin — Lindsay house located at 305 S. C Street in Old Town. The Conservancy expressed concerns about the future of the property and urged the Commission to take steps to preserve the house. The property at 305 South C Street and the adjacent property at 315 South C Street are within the Cultural Resource Overlay District and are zoned Central Commercial with a Parking Overlay (C2P). The properties are listed for sale by Newmark Grubb Knight 305 and 315 S. C Street December 12, 2017 Page 2 Frank and are currently in escrow (Attachment B). According to the listing. agent, it is.,. .: .anticipated that the escrow will close by the end of December. Staff has provided the listing agent and the potential buyer with information regarding the historic significance_, of each of the properties, which is summarized below. .Staff has also informed the- listing agent and the potential buyer that the exterior alteration or demolition of any of the structures on either property would require the approval of a Certificate of Appropriateness and the issuance of a building permit by the City of Tustin (City). In addition, pursuant to State law, demolition or any significant exterior alterations that have a substantial adverse change in the historical significance of the structure would be required to comply with the California Environmental Quality Act (CEQA) and would not be exempt from CEQA. Mary Tustin — Lindsay House (305 S. C Street) . The Mary Tustin — Lindsay House located at 305 S. C Street is listed in the City's 2003 Historic Resources Survey and has a National Register of Historic Places (NRHP) Code -of 3S; the rating indicates that it appears eligible for separate listing in the National Register. It is also listed in the City's 1990 Historical Resources Survey with an "A" rating. Excerpts from each of the surveys are provided for reference in Attachment C. On April 28, 2009, the Tustin Planning Commission approved the nomination of the Mary Tustin — Lindsay House to the Tustin Historic Register Plaque Program. According to the 1990 Survey, the Victorian board and batten residence was built around 1886 and moved to its current site around the turn of the century. Mary Tustin, the wife of Columbus Tustin, was the original owner of the house. Since 1945, the property has been owned by the Lindsay family. Patton House (315 S. C Street) The .Patton House at 315 S. C Street is listed in the City's 2003 Historic Resources Survey and has an NRHP Code of 5131, which indicates that the house is locally significant and is a contributor to the Cultural Resource District. The house is also listed in the City's 1990 Survey and has a "C" rating. The applicable pages from each of the surveys are provided in Attachment C. On April 28, 2009, the Tustin Planning Commission approved the nomination of the Patton House to the Tustin Historic Register Plaque Program. According to the 1990 Survey, the California bungalow was built-' around 1910' on property owned by the Tustin family and was inherited by Sam Tustin upon the death of his mother, Mary Tustin. In the 1940s, the property was purchased :by the Patton family, and was later acquired by the Lindsay family. 305 and 315 S. C Street December 12, 2017 Page 3 RV Storage Depot (130 W. Third Street) The buildings at the rear of the 305 S. C Street property are separately addressed as 130 W. Third Street and are currently occupied by a business called RV Storage Depot and used for general office purposes. Neither of the buildings is identified on the City's Historical Resource Surveys, but one or both of the buildings may be over 50 years of age. Based on historical aerial photographs available for viewing on the website, www.historicalaerials.com, it appears that the buildings may have been in existence in the 1950s and 1960s. Additional research would be needed to accurately determine the ages of the buildings. I i 130 West Third Street According to the listing agent, the RV Storage Depot business owner leases the buildings at 130 West Third Street and has about three (3) years remaining on the lease, making it more difficult for any improvements to be made to the buildings or the properties in general until the business vacates the property. 305 and 315 S. C Street December 12, 2017 Page 4 Next Steps As more information becomes available regarding any future redevelopment plans for the site, staff will report back to the Planning Commission and inform the Tustin Preservation Conservancy. Within the past year,it has come to our attention that the historic Mary Tustin—Lindsay House,located at 305 S.C Street in Old Town Tustin,is presently vacant and has been put up for sale by the owners. Built in 1886 by Mary Tustin,widow of Columbus Tustin,it was moved to its present location using mules and logs. Previously,it was located at the corner of EI Camino Real and Sixth Street,where the Black Marlin Restaurant is now Iocated.The Columbus Tustin family owned this house until the arid-1940's. Ralph Lindsay and his wife,Louise,bought the home in 1945.In addition to being a business owner in Tustin,he served as Fire Chief from 1951-1959.This house is considered a rare example of a primary settlement period building.In addition,it is one of the few remaining homes constructed in the board and batten style in Orange County. In an effort to preserve the historic home of our city founder's family,we provided the funding for a new roof and front porch repair.This required testing for asbestos and lead before repairs could be started. At the request of the owner's family,the Conservancy also provided funding for the home's new landscaping and sprinklers. The Conservancy's Board of Directors feel it is essential that the Planning Commission,in its role as the Historic Resource Committee,be aware of the fact that this historic city landmark could be at risk.Many citizens of Tustin have reached out to us concerned about the future of the Mary Tustin—Lindsay House. We want the Planning Commission to be aware of the potential loss of this historic resource and share their concerns with the Tustin City Council and City Staff.The Mary Tustin--Lindsay House is possibly the most historic structure in our city. We ask that the Planning Commission take steps to preserve this historic legacy. The side facing gabled roof slants downward at the back and the house has double hung windows in the center of each gable. Eaves are enclosed. A full porch is topped with a hipped roof and has enclosed eaves. Turned posts,connected by a plain balustrade with closely spaced balusters,support the porch roof. Windows flank the center front door. The inverted cross door has molded bordering on each vertical panel. Capped by a sidc-facing gabIcd roof which slants downward at the back, the house features 2-over-2 double-hung windows in the center of each gable. The eaves are enclosed. The full porch is topped with a hipped roof and also features enclosed eaves. Turned posts, connected by a plain balustrade with closely-spaced balusters, support the porch roof. 2-over-2 windows flank the centered front door, which appears to be original. The inverted cross door is accented with molding bordering each vertical panel. Because of the break in the roof on each side, at a spot where the eaves would logically end, it appears that the back section was added on. Because the materials, including the 2-over-2 windows, match the original it appears the addition was done very soon. - after the original construction. SIGNIFICANCE: Mary Tustin, the original owner of the house (ca 1886); was the wife of Columbus Tustin, founder of the City of Tustin. The Tustin had t�hc;building moved to this site:around the tum of the century, with the aid of logs and mules. The house was owned by membcrs'of the Tustin family until 1943, but Fannie, Tustin Platt and possibly Mary lane Tustin Nicoles were the only ones who lived here. The house was rented in the 1930's to George Chandler and his family of nine children. Ralph and Louise Lindsay have owned the house since 1945. Ralph owned a shoe repair shop in the Knights of Pythias building, but is best known as a volunteer fireman,serving as Fire Chief from 1951 through 1959.
