HomeMy WebLinkAboutCC RES 99-34 RESOLUTION NO. 99-34 : A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE FINAL NEGATIVE 3 DECLARATION AS ADEQUATE FOR CONDITIONAL USE PERMIT 98-007 AND DESIGN REVIEW 98-007 AND 4 MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY s ACT. The City Council of the City of Tustin does hereby resolve as follows: 7 I. The City Council finds and determines as follows: A. That Conditional Use Permit 98-007 and Design Review 98-007 are 9 considered >"projects" pursuant to the terms of the California Environmental Quality Act~ and 10 B. A Negative Declaration has been prepared for this project and has ~ been distributed for public review. ~2 C. Whereas, the City Council of the City of Tustin has considered evidence presented by the Community Development Director and ~3 other interested parties with respect to the subject Negative ~4 Declaration. ~5 D. The City Council has evaluated the proposed. final Negative Declaration and determined that the project is regulatory in nature ~6 and therefore, would not .have a significant effect on the environment. When individual applications are submiRed for ~? consideration, independent environmental review will occur. ~8 II.. A Draft Negative Declaration has been completed in compliance with CEQA and state guidelines. The City Council has received and considered 19 the information contained in the Negative Declaration prior to recommending approval of. the proposed project, and found that it 20 adequately discussed the environmental effects of the proposed project. 2!
