CLOSED SESSION ITEMS - The Brown Act permits legislative bodies to discuss certain matters without members of the public present. The City Council finds, based on advice from the City Attorney, that discussion in open session of the following matters will prejudice the position of the City in existing and anticipated litigation: 1. CALL TO ORDER — Meeting #2424 at 7:11 p.m. PRESENTATION OF COLORS, INVOCATION AND PLEDGE OF ALLEGIANCE — American Legion PRESENTATIONS — Mayor Bernstein presented a Certificate of Recognition to Orange County Rescue Mission President Jim Palmer in honor of being a Gem of Tustin. Mayor Bernstein presented a Certificate of Recognition to Operation Warm Wishes Founder. TyRon Jackson in honor of being a Gem of Tustin. Tustin ,Chamber of Commerce Chairman introduced the new Executive Director— Rebecca Schultz. City Council December 5, 2017 Meeting Minutes Page 2 of 10 Management Analyst Ken Piguee presented the City's new South Hangar Marketing Video. Mayor Bernstein provided a PowerPoint presentation on his 2017 Accomplishments. On behalf of Congresswoman Mimi Walters, District Representative Luis Reyes presented a Certificate of Recognition to Mayor Pro Tem Bernstein. CLOSED SESSION REPORT — City Attorney David E. Kendig: The City Council took no reportable action. ORAL COMMUNICATION/PUBLIC INPUT — 1. Angela Lopez 2. James Collins CONSENT CALENDAR ITEMS 1-8 It was moved by Mayor Pro Tem Murray and seconded by Councilmember Puckett to move the balance as recommended by staff. Motion carried: 5-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL HELD ON NOVEMBER 21, 2017. Motion: That the City Council approve the Action Minutes of the Regular Meeting of the City Council held on November 21, 2017. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: That the City Council approve Payroll in the amount of $729,681.88 and City Council December 5, 2017 Meeting Minutes Page 3 of 10 4. 5. Demands in the amount of $2,028,207.84. ADOPTION OF THE 2018 INVESTMENT POLICY The California Government Code provides,guidelines for Cities to annually adopt their Investment Policy. The elected body and the Treasurer should review the existing Investment Policy at least annually and confirm its content at a public meeting and annually delegate authority to invest. Motion: That the City Council adopt the City of Tustin Investment Policy for calendar year 2018. POLICE DEPARTMENT VEHICLE PURCHASE Nine (9) Police Department patrol units, and two (2) Police Department unmarked vehicles are in need of replacement. The Department has determined the need to purchase eight (8) Dodge Charger pursuit rated vehicles, one (1) Chevrolet Tahoe pursuit rated vehicle, one (1) Dodge Durango unmarked vehicle and (1) Jeep Cherokee unmarked vehicle. Additionally, there will be a need to award a contract for police equipment conversion work for the newly purchased police units. Motion: That the City Council approve: 1. The purchase of eight (8) 2018 Dodge Charger pursuit rated vehicles, and one (1) Dodge Durango police packaged vehicle from Bravo Chrysler, Jeep, Dodge, Ram of Alhambra, California, in the amount of $239,017.56 (including tax, license, fees, and delivery). 2. The purchase of one (1) 2018 Chevrolet Tahoe pursuit rated vehicle from National Auto Fleet Group of Alhambra, California, in the amount of $40,066.96 (including tax, license, fees, and delivery). 3. The purchase of one (1) 2018 Jeep Grand Cherokee vehicle from Elk Grove Automotive of Elk Grove, California, in the amount of $34,944.53 (including tax, license, fees, and delivery). 4. The purchase of police equipment conversion packages for the conversion of eight (8) 2018 Dodge Chargers, one (1) Dodge Durango, one (1) Chevrolet Tahoe and one (1) Jeep Grand Cherokee from Hi -Standard Automotive in the City of Orange, California, in the amount of $66,156.76. Also, from one (1) additional vendor, Digital Magic Signs, in the amount of $4,628.00 (graphic signs for vehicles). 5. The Publ'ic'Works Department to dispose of the retired surplus vehicles at the next available public auction and credit net proceeds to the applicable City Revenue Fund. AMALFI APARTMENT HOMES The Tustin Police Department is committed to a partnership with our business and residential community to provide the highest level of service based on trust and transparency. The Tustin Police Department has been working closely with our business and community partner, the Irvine Company, to ensure the safety of the public and first responders. Members of the Tustin Police Department, City Staff, and the Irvine Company have had meetings researching options with the goal of finding the best option to provide for the radio frequencies at the Amalfi Apartment Homes. Through the meeting and research process with the various stakeholders, it was determined that an In -building Bi-directional Amplifier offers the most appropriate solution to address coverage for the Police Department and for the safety of the public. Motion: That the City Council approve a supplemental appropriation of $275,000.00 from the General Fund Reserves to pay for the City's share of the associated costs. 7. AWARD CONTRACT FOR THE PARK AVENUE IMPROVEMENTS FROM TUSTIN RANCH ROAD TO WARNER AVENUE CONSTRUCTION PROJECT (CIP NO. 70233) WITHIN THE DISTRICT Staff is recommending the City Council award the construction contract for the Park Avenue Improvements from Tustin Ranch Road to Warner Avenue Construction Project (CIP No. 70233) within The District to the lowest responsive/ responsible bidder, R. J. Noble, Company. Motion: That the City Council award the construction contract for the Park Avenue Improvements from Tustin Ranch Road to Warner Avenue Construction Project (CIP No. 70233) to the lowest responsive/responsible bidder, R. J. Noble, Company, in the amount of $1,419,380.51 and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City. 8. APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT FOR BIDS FOR THE MAIN STREET IMPROVEMENTS PROJECT, CIP NO. 40087 The plans and specifications for the Main Street Improvements Project, CIP No. 40087 have been prepared and the project is ready for bid, contingent on an Authorization to Proceed (E-76) from Caltrans. Motion: That the City Council: 1. Adopt Resolution No. 17-56 approving the plans and specifications for the Main Street Improvements Project, CIP No. 40087; and City Council December 5, 2017 Meeting Minutes Page 5 of 10 2. Authorize the City Clerk to advertise to receive bids contingent on receipt of an Authorization to Proceed (E-76) from Caltrans. RESOLUTION NO, 17-56 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE MAIN STREET IMPROVEMENTS PROJECT, CIP NO. 40087 AND AUTHORIZING ADVERTISEMENT FOR BIDS REGULAR BUSINESS ITEMS 9-11 9. LEASE AGREEMENT BETWEEN THE BOYS AND GIRLS CLUB AND THE CITY OF TUSTIN REQUEST FOR LOAN FOR ROOF REPLACEMENT In December 22, 1967, the City of Tustin and the Boys and Girls Club (Club) entered into a lease agreement (agreement) for 50 years to allow for the Boys and Girls Club to operate at 580 W. 6th Street, Tustin, CA 92780 for the cost of $1.00 per year and other conditions as outlined in the agreement. Subsequently, the lease was amended three separate times (1980, 1981, and 1982) and is due to expire December 31, 2017. The City of Tustin and Boys and Girls Club have concluded negotiations regarding a new agreement that covers certain legal concerns related to eminent domain and alike. Attached is the proposed agreement effective immediately for a term of 20 years or unless earlier terminated in accordance with the provisions with the proposed lease. Councilmember Gomez requested clarification on several items. It was moved by Councilmember Puckett and seconded by Councilmember Clark that the City Council: 1. Direct the City Manager to execute the attached lease agreement between the Tustin Boys and Girls Club and the City of Tustin and authorize the City Attorney to make changes to the agreement consistent with the intent of this approval. 2. Discuss a $90,000 capital improvement loan to the Tustin Boys and Girls Club, amortized over 15 -years at a 2% interest rate. Motion carried: 5-0 10. 2017 LEGISLATIVE YEAR IN REVIEW City Council December 5, 2017 Meeting Minutes Page 6 of 10 Deputy City Manager Matthew S. West provided an update of proposed key legislative items. The City Council unanimously received and filed this report. 11. MAYOR AND MAYOR PRO TEM SELECTION The City Council selects those members of the Council who will serve as Mayor and Mayor Pro Tem for the following year. Mayor Bernstein solicited nominations for Mayor. Councilmember Puckett nominated Al Murray. Councilmember Clark seconded the nomination. Motion carried: 5-0 Mayor Murray solicited nominations for Mayor Pro Tem. Mayor Murray nominated Beckie Gomez. Councilmember Clark seconded the nomination. Motion carried: 5-0 OTHER BUSINESS/CITY MANAGER AND CITY ATTORNEY City Manager Jeffrey C. Parker Announced a firestorm is currently occurring in Ventura County; being prepared and aware is important; the public can visit City of Tustin's website to get tips on how to be prepared for emergencies; if anyone has questions on how to be prepared, contact Emergency Management Coordinator, Joe Meyers in the Tustin Police Department. COUNCILMEMBER COMMENTS AND REPORTS Councilmember Puckett Expressed that he hoped everyone had a nice Thanksgiving. November 23 Served lunch with wife, Donna Puckett, to over 300 people at the Orange County Rescue Mission; had a phenomenal time; moving forward this will become a family tradition. November 30 o Attended two (2) Transportation Corridor Agencies (TCA) meetings o Attended the presentation by Non -Toxic Irvine at -Irvine City Hall; City of Tustin is currently experimenting with non-toxic chemicals at two (2) City of Tustin parks; anxious to see the results. Congratulated former Mayor Dr. Allan Bernstein for a great year; congratulated Mayor Al Murray and Mayor Pro Tem Beckie Gomez and is looking forward to serving with them this upcoming year. Councilmember Clark November 23 Participated with her family in Operation Warm Wishes' Thanksgiving Spectacular with TyRon Jackson at Peppertree Park; roughly 200 people were in attendance; great event for the entire community. December 1 Spoke to the Tustin Kiwanis Club at their Monthly Membership meeting about her experience working for a Council Member in New Orleans, Louisiana during Hurricane I Katrina; spoke on how cities have to be prepared during a time of emergencies; discussed how Tustin is prepared in case of a disaster; encouraged community members to participate in City trainings offered to the public; enjoyed speaking with the Kiwanis members. December 5 Attended the Public Relations meeting with the Orange County Vector Control Board. Announced December 9th will mark one (1) year of being on the Tustin City Council; expressed it has been an amazing and fulfilling year. Congratulated former Mayor Dr. Allan Bernstein for a great year; looking forward to serving the upcoming year with Mayor Murray and Mayor Pro Tem Gomez; looking forward to 2018. Councilmember Bernstein Announced many meetings were dark due to the Thanksgiving holiday. November 23 Participated in Operation Warm Wishes' Thanksgiving Spectacular at Peppertree Park; congratulated TyRon Jackson from Operation Warm Wishes on a job well done; was a great community event. City Council December 5, 2017 Meeting Minutes Page 8 of 10 Announced the Tustin Tree Lighting event will be held on Friday, December 8, 2017 at the Tustin Courtyard. Thanked everyone for attending the Council meeting for congratulating himself and his colleagues, wished everyone the best in the upcoming year. Announced is looking forward to serving on the Tustin City Council in the upcoming year. Mayor Pro Tem Gomez Announced due to work and recent travel schedule, was unable to attend a few meetings, as well, as there not being very many committee meetings. November 23 Thanked TyRon Jackson for doing a wonderful job on Thanksgiving Day with the Thanksgiving Spectacular at Peppertree Park; many volunteers were in attendance; lots of activities for the children; everyone seemed to enjoy the event. November 29 Attended the Orange County (OC) Pathways at the Marconi Automotive Museum in Tustin; was host to the Orange County K12 Community Colleges Showcase for all their programs; was an outstanding event; many of the representatives from the schools had never been to Tustin; was a great introduction into the City of Tustin. November 27 -December 1 Attended the State School Board Conference; was a great opportunity to meet elected officials throughout the state; was a gubernatorial candidate forum with all the declared candidates, was very informative; encouraged everyone to hear the candidates and their positions on various issues. Announced it is important to know the City of Tustin has put aside one million dollars in an event of an emergency; nice to have that reserve so not have to dip into other funds. Congratulated Dr. Allan Bernstein on his tenure as Mayor; congratulated Mayor Murray for being selected into the Mayor's chair. Announced will see everyone at the Tustin Tree Lighting. Mayor Murray November 22 Participated in the Tustin Police Officers Association (TPOA) Turkey Donation fundraiser at the Tustin Area Family Youth Center with daughter Emily; thanked TPOA for their hard work each year with the fundraiser. November 23 City Council December 5, 2017 Meeting Minutes Page 9 of 10 o Served Thanksgiving dinner with wife and daughter to over 300 people at the Orange County Rescue Mission with President of the Orange County Rescue Mission, Jim Palmer, Council Member Chuck Puckett and his wife Donna Puckett. o Attended the Operation Warm Wishes' Thanksgiving Spectacular at Peppertree Park; event was organized very well; thanked TyRon Jackson from Operation Warm Wishes on a job well done and for everything he does for the community. November 27 Attended the Orange County Transportation Authority (OCTA) Board meeting. November 28 Attended the presentation of retired Army General David Petraeus at the Richard Nixon Presidential Library and Museum; very interesting interview. November 30 Attended the Association of California Cities of Orange County (ACCOC) and the Orange County Transportation Authority (OCTA) tour of the 91 freeway expressway; freeway is doing well since the expansion. December 4 Attended the Orange County Transportation Authority (OCTA) Executive Board meeting. Orange County Fire Authority Division Chief Andy Kovacs As a request from Mayor Murray, Division Chief Andy Kovacs gave an update on the Creek Fire, Thomas Fire, and the Rye Fire. Mayor Murray (continued) Congratulated Mayor Pro Tem Gomez and thanked colleagues for their support. Thanked former Mayor, Dr. Allan Bernstein and fellow council members for a great year. Thanked wife Tammy and daughter Emily for their continuous support. Announced the Tustin Tree Lighting event scheduled on Friday, December 8, 2017. Wished Tustin Police Chief, Charles F. Celano Jr. a very Happy Birthday.
