1. CONDITIONAL USE PERMIT (CUP) 2017-19

REQUEST:
To authorize a reduction in the required number of parking spaces through a joint-
use parking for attorney office within an existing office building.
ENVIRONMENTAL STATUS:
This project is Categorically Exempt (Class 1) pursuant to Section 15301 of the
California Environmental Quality Act.
RECOMMENDATION:
That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 17-010
approving Conditional Use Permit (CUP) 2017-19, a request for a reduction in the
required number of parking spaces through a joint-use parking facility to
accommodate attorney offices within an existing office building.
It was noted there were no members of the public in attendance for this item.
The applicant, Giovanni Milan, and Adnan Handia, Traffic Engineer, were present.

The Zoning Administrator opened the Public Hearing item at 10:30 a.m.
The Zoning Administrator stated she had reviewed the staff report and did not need
a presentation. She asked the applicant if he had an opportunity to review the
revisions to the Conditions of Approval presented earlier that morning to him,
provided by Beier (via email). The applicant, Mr. Milan did not have any concerns
with the revisions presented and he was in agreement with the revisions to the
Conditions of Approval.
The Zoning Administrator approved ZAA 17-010. She stated that correspondence
was received from the City's Building Division with regards to "several significant
outstanding code issues in the building as well as in the parking lot". The Building
Division wanted to make sure the applicant was aware that even though the CUP
was acceptable, it did not mean the outstanding code issues were satisfied and that
they need to be taken care of in a timely fashion.
In response to the Zoning Administrator's previous statement, Mr. Milan stated he
understood that there was a "miscommunication on his end to the Building Division"
and that he is aware of the code issues. The Zoning Administrator referred him to
Dana Ogdon, Assistant Director of Community Development, who oversees the
Building Division, if he should have any further questions with regards to the
outstanding code issues. Also if there was any further misunderstanding, to contact
the Zoning Administrator.
The Public Hearing item was closed at 10:36 a.m.

The date of the next meeting of the Zoning Administrator will be scheduled when
items are set for hearing.
