~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING FINAL TRACT MAP 15707 LOCATED AT
2 THE SOUTHEAST CORNER OF EL CAMINO AND SIXTH STREET
(715-765 EL CAMINO REAL & 120-250 SIXTH STREET), TO
3 SUBDIVIDE PARCEL 1 OF FINAL PARCEL MAP 98-161 INTO
THIRTY EIGHT (38) NUMBERED LOTS AND TEN (10) LETTERED
4 LOTS TO ACCOMMODATE DEVELOPMENT OF THIRTY EIGHT (38)
SINGLE FAMILY RESIDENTIAL DETACHED UNITS.

The City Council of the City of Tustin does hereby resolve as follows:

s I. The City Council finds and determines as follows:
9 A. That Final Tract Map 15707 has been submitted by Warmington Old
Town Associates ("the Subdivider") to subdivide Parcel 1 of Final
~0 Parcel Map 98-161 into thirty eight (38) numbered lots and ten (10)
lettered lots to accommodate development of thirty eight (38) single
~ family residential detached units;
~2 B. That a public hearing was held by the Planning Commission on
is November 23, 1998. At this hearing, the Planning Commission
recommended that the City Council approve Tentative Tract Map
~4 15707. Subsequently, the City Council approved Tentative Tract Map
15707 on December 7, 1998;

C. Pursuant' to Section 15268(b) (Ministerial Projects) of the California
~6 Environmental Quality Act (CEQA), the Final Map is considered
statutorily exempt from the requirements of C'EQA.

D. That the proposed subdivision is in substantial conformance with the
~s Tustin General Plan, the Tustin Zoning Code and Subdivision Map ACt;
~9 E. That the proposed project has been reviewed for conformity with the
20 provisions of the Orange County Congestion Management Program,
and it has been determined that the additional traffic generated by the
~_~ proposed project onto the CMP Highway. System does not cause the
system to exceed established level of service standards '(ELS);

F. That the City has reviewed the status of the school facilities and the
23 Tustin. Unified School District for the impact of Tentative Tract Map
15707. No impacts associated with this approval on School District
24 facilities have been determined;
:5 G. That the site is physically suitable for the type of development
26 proposed;
27 H. That the site is physically suitable for the proposed density of
development;

I. That the design of the subdivision or the proposed improvements are
2~ not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife in their habitat;
J. That the 'design of the subdivision or the type of improvements
proposed will not conflict with easements acquired by the public-at-

2 large, for access through or use of the property within the proposed
subdivision;

K. That the design of the subdivision or the types of improvements
4 proposed are not likely to cause serious public health problems;
5 L. That the Final Map is in substantial conformance with the Tentative
Tract Map; and,

? M. That the project has been reviewed for consistency with the Air Quality
Sub-Element of the City of Tustin General Plan and has been
s determined to be consistent or has been conditioned to be consistent
with the Air Quality Sub-Element
I1o The City Council hereby approves Final Tract Map 15707, to subdivide Parcel
20 I of Final Parcel Map 98-161 into thirty eight (38) numbered lots and ten (10)
lettered lots to accommodate development of thirty eight (38) single family
22 residential detached units.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on the
19th day of April, 1999,
