REPORT AND ACCOUNT OF NUISANCE ABATEMENT COSTS RELATING TO
14412 RAINTREE ROAD AND SPECIAL ASSESSMENT REQUEST FOR
UNPAID NUISANCE ABATEMENT COSTS INCURRED BY THE CITY OF
TUSTIN -
Staff was notified that a private residence block wall at 14412 Raintree Road constructed
adjacent to a sidewalk (the residence occupies a corner lot) was leaning and threatening to fall
onto the adjacent sidewalk. The City's Building Official inspected the wall and determined it to
be an imminent life -safety concern. Ms. Karen J. Calkins (the property owner) did not positively
respond to City requests that the wall be replaced (including actions taken by the City Attorney).
Consequently, the City obtained a court order, entered the property and replaced the wall. The
City Attorney submitted a bill to the property owner in September 2016 for reimbursement of the
City's expenses. In addition, the Finance Department billed the owner on three (3) separate
occasions in 2017. To date, the owner has not responded to the City's invoices. However, City
staff worked through the Franchise Tax Board to successfully recover all Code Enforcement
citation fines and penalties ($2,630.00). Tustin City Code (TCC) Section 5508 establishes a
process that authorizes the Tustin City Council to assess the property through a special
assessment to recover the outstanding $22,555.17 of the City's unpaid costs.
FISCAL IMPACT:
Recording of the proposed special assessment will not impact the General Fund since
municipalities are generally exempted from the payment of County Recorder fees (Gov't Code
27383). However, the City has not been reimbursed for its efforts in resolving the violations at
the subject property ($22,555.17). The proposed special assessment will recover these costs at
the same time and in the same manner as ordinary municipal taxes are collected.
RECOMMENDATION:
1. Conduct a public hearing;
2. Adopt Resolution No. 18-05, which approves, confirms and adopts the report attached
thereto as Exhibit "A";
3. Direct the City Clerk to cause the delivery of a certified copy of the Report to the Orange
County Auditor and to submit a certified copy of the Resolution (with attachments) to the
Orange County Recorder for recordation; and
4. Order that the nuisance abatement costs set forth in the report be collected as a special
assessment against the subject property.

APPROVAL AUTHORITY:
TCC Sections 1102(c) and 5508 et al. provides the City Council with the authority to recover the
City's costs of nuisance abatement, including all administrative costs, through a special
assessment against a parcel (in accordance with California Government Code Section
38773.5). City staff has tracked time spent and expenses incurred with the abatement
associated with the subject property.
Staff is recommending that the City Council consider the expense report (Exhibit A of Resolution
No. 18-05), approve the report, and direct staff to record the nuisance abatement costs set forth
in the report with the Orange County Auditor and Orange County Recorder. The costs incurred
would then be collected as a special assessment against the subject property.
BACKGROUND AND DISCUSSION:
On July 28, 2015, Code Enforcement staff was notified that a private resident's block wall
constructed adjacent to a sidewalk (the residence occupied a corner lot) was leaning and
threatening to fall into the adjacent sidewalk (see photographs below). The City's Building
Official inspected the wall and determined it to be an imminent life -safety concern. The hazard
was declared a public nuisance in violation of several Tustin City Codes, including, but not
limited to TCC 5502(b) — "Any condition which exists upon any premises that is dangerous to
human life or is detrimental to health as determined by an appropriate city official"; and
5502(m)(3) — "All walls, fences and trash enclosures and other structures shall be maintained
free of significant surface cracks, dry rot, warping, missing panels or blocks which either (i)
threaten structural integrity, or (ii) result in a dilapidated, decaying, disfigured, partially ruined
appearance."

City staff sent several notices of violation to the property owner requesting removal/replacement
or repair of the wall. Numerous citations were issued to the property owner when the City's
requests were ignored. The property owner did not appeal any of the notices of violation or
citations that were issued. Unfortunately, these efforts were unsuccessful in obtaining the
property owner's cooperation to address the hazardous wall.
In February 2016, the matter was forwarded to the City Attorney's office. The City Attorney
attempted to obtain the property owner's cooperation over the next four (4) months. In addition,
Code Enforcement staff issued additional citations to the property owner for refusing to
eliminate the hazard.
In July 2016, the City obtained a court order, entered the property and replaced the wall to
abate the hazard (see photographs below). The property owner was notified prior to taking this
action. Pursuant to TCC Sections 1122(c) and 5508, the City is entitled to recover the costs
incurred by the City to abate a public nuisance. In September 2016, the City Attorney forwarded
a Demand for Payment to the property owner for reimbursement of City expenses in resolving
the matter. Subsequently, the Finance Department billed the owner on three (3) separate
occasions in 2017 for the amount due. City staff worked through the Franchise Tax Board to
successfully recover all Code Enforcement citation fines and penalties ($2,630.00).
TCC Section 5508 et al. authorizes the City Council to apply a special assessment against the
property to recover the current balance of $22,555.17 in unpaid City costs related to this matter.
Staff is seeking City Council adoption of Resolution No. 18-05 authorizing the placement of a
special assessment on the subject property to be filed with the Orange County Auditor and the
Orange County Recorder for recordation. The special assessment will enable the City to
recover its costs at the same time and in the same manner as ordinary municipal taxes are
collected and shall be subject to the same penalties and sale in case of delinquency as provided
for ordinary municipal taxes.

The property owner was given timely notice of the date, time and location that this matter would
be heard as required by TCC 5508(b).
A report and list of Administrative Costs incurred is attached hereto in Exhibit A of Resolution
No. 18-05 (Attachment 1).

CONFIRMING THE REPORT AND ACCOUNT OF
NUISANCE ABATEMENT COSTS RELATING TO
CERTAIN REAL PROPERTY LOCATED IN THE CITY OF
TUSTIN AND REQUESTING THE ORANGE COUNTY
AUDITOR ADD THE UNPAID NUISANCE ABATEMENT
COSTS INCURRED BY THE CITY OF TUSTIN TO THE
TAX ROLL FOR 14412 RAINTREE ROAD, CITY OF
TUSTIN (ASSESSOR PARCEL NUMBER 432-434-01).
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TUSTIN AS
FOLLOWS:
Section 1: The City Council hereby, finds, determines and declares as
follows:
A. That on July 28, 2015, City of Tustin staff was notified that a private
resident's block wall was leaning and threatening to fall into the adjacent
sidewalk. The City's Building Official inspected the wall and determined it
to be an imminent life -safety concern and the subject hazard was declared
a public nuisance is in violation of several Tustin City Codes, including, but
not limited to TCC 5502(b) and 5502(m)(3). In July 2016, the City obtained
a court order, entered the property and replaced the wall to abate the
public nuisance and abate the hazard to the public.
B. That Karen J. Calkins is the owner of record ("Responsible Party") for the
real property located at 14412 Raintree Road, City of Tustin, Assessor
Parcel Number: 432-434-01 ("Subject Property");
C. That a report and account of the costs incurred by the City of Tustin for
nuisance abatement activity at the Subject Property is attached hereto as
Exhibit "A" and incorporated herein by reference ("Report");
D. That the Responsible Party is delinquent in the payment of said nuisance
abatement costs;
E. That Tustin City Code Section 5508 provides that the total costs of
nuisance abatement, including all administrative costs, shall constitute a
special assessment against a parcel in accordance with California
Government Code Section 38773.5; and
F. That the City Council held a hearing on January 16, 2018, which was
properly noticed as required by California Government Code Section
38773.5 and Tustin City Code Section 5508, for the purpose of considering
the Report, and duly considered all protests related thereto.
Section 2: The City Council hereby approves, confirms, and adopts the
Report, attached hereto as Exhibit "A" and incorporated herein by reference, and
orders that the nuisance abatement costs set forth in the report be collected as a
special assessment against the Subject Property.
Section 3: The City Council hereby directs the City Clerk to cause the delivery
of a certified copy of the Report to the Orange County Auditor and to submit a
certified copy of the Resolution (with attachments) to the Orange County Recorder
for recordation.
Section 4: The City Council hereby requests the Orange County Auditor and
Orange County Recorder to take any and all actions necessary to provide for the
placement of the nuisance abatement costs on the tax roll and collecting said costs
with the general taxes.
