: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, CERTIFYING THE FINAL NEGATIVE
s DECLARATION AS ADEQUATE FOR GENERAL PLAN
AMENDMENT 99-001 AND ZONE CHANGE 99-001 AS
4 REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY
5 ACT.
6 The City Council of the City of Tustin does hereby resolve as follows:
7 I. The City Council finds and determines as follows:
s A. That General Plan Amendment 99-001 and Zone Change 99-001
are considered "projects" pursuant to the terms of the California
9 Environmental Quality Act; and
~0 B. A Negative Declaration has been prepared for this project and has
been distributed for public review.
~2 C. Whereas, the Planning Commission of the City of Tustin has
considered evidence presented by the Community Development
Director and other interested parties with respect to the subject
~3 Negative Declaration, and on February 22, 1999 recommended that
t4 the City Council certify the Negative Declaration.
~5 D. The City Council of the City of Tustin has reviewed and considered
the Negative Declaration and has determined that the Negative
~6 Declaration is adequate and complete.
t? II. A Final Negative Declaration has been completed in compliance with
CEQA and state guidelines. The City Council has received and considered
is the information contained in the Negative Declaration prior to
recommending approval of the proposed project, and found that it
~9 adequately discussed the environmental effects of the proposed project.
2o Further, the City Council finds the project involves no potential for any
adverse effects, whether individually or cumulatively, on wildlife resources;
2~ and, therefore, makes a De Minimis Impact finding related to the Califomia
State Department Fish and Game Code Section 711.4.
