APPLICATION FOR LAND AND WATER CONSERVATION FUND (LWCF)
GRANT
SUMMARY
Authorization is requested to apply for a Land and Water Conservation Fund (LWCF) grant
administrated by the State of California Office of Grants and Local Services for the construction of
athletic amenities at the new Veterans Sports Park at Tustin Legacy.
RECOMMENDATION
It is recommended that the City Council:
1. Adopt Resolution No. 18-02 approving application for a Land and Water Conservation Fund
(LWCF) Grant to pay for the construction of athletic amenities at the new Veterans Sports
Park at Tustin Legacy.
FISCAL IMPACT
The estimated cost of the athletic amenities included in the grant application is $6 million. Under the
LWCF program, the maximum grant request amount is $3 million and the City must provide a 100%
match for all grant funds proposed which will require that the City provide $3 million towards the
project. These matching funds are included in the City's FY 2017-2018 Capital Improvement Program
for Tustin Legacy.
CORRELATION TO THE STRATEGIC PLAN
This recommendation advances Strategy 6 of Goal A in the City of Tustin Strategic Plan regarding
Economic and Neighborhood Development by exploring opportunities for expanding recreational
activities.
BACKGROUND
The Land and Water Conservation Fund (LWCF) is a federal grant program that provides matching
funds for the acquisition and development of public outdoor recreation areas and facilities. For
California, these grant funds are administered by the State of California Office of Grants and Local
Services (OGALS). Agencies choosing to submit an application for a LWCF Grants are required to
submit an approved resolution from the applicant's governing body. In the current grant cycle, the
deadline for applications is February 4, 2018. OGALS expects award notifications to be made in
June 2018.
Currently, the Veterans Sports Park at Tustin Legacy Grading Project is underway. The full park
construction is expected to be publicly bid in the Spring of 2018 with the work starting shortly
thereafter. The proposed grant application will request funding for the construction of four (4)
soccer/multi-purpose synthetic turf fields, four (4) tennis courts, eight (8) pickleball courts, two (2)
basketball courts, and an outdoor fitness area.

RESOLUTION OF THE CITY OF TUSTIN
APPROVING THE APPLICATION FOR LAND AND
WATER CONSERVATION FUND VETERANS
SPORTS PARK PROJECT
WHEREAS, the Congress under Public Law 88-578 has authorized the
establishment of a federal Land and Water Conservation Fund Grant -In -Aid program,
providing Matching funds to the State of California and its political subdivisions for
acquiring lands and developing Facilities for public outdoor recreation purposes; and
WHEREAS, the California Department of Parks and Recreation is responsible or
administration of the program in the State, setting up necessary rules and procedures
governing APPLicATioNs by local agencies under the program; and
WHEREAS, the APPLICANT certifies by resolution the approval of the
APPLICATION and the availability of eligible MATCHING funds prior to submission of
the APPLICATION to the State; and
NOW, THEREFORE, BE IT RESOLVED that the City of Tustin hereby:
a) Approves the filing of an APPLICATION for Land and Water Conservation Fund
assistance for the proposed; Veterans Sports Park
b) Agrees to abide by SECTION 6(f)(3) of Public Law 88-578 which states "No
property acquired or developed with assistance under this section shall, without
the approval of the National Secretary of the Interior, be converted to other than
public outdoor recreation uses. The Secretary shall approve such conversion only
if he finds it to be in accord with the then existing comprehensive statewide outdoor
recreation plan and only upon such conditions as he deems necessary to assure
the substitutionof other recreation properties of at least equal fair market value
and of reasonably equivalent usefulness and location."
c) Certifies that said agency has MATCHING funds from eligible source(s)
and can finance 100 percent of the Project, which up to half may be
reimbursed; and
d) Appoints the Parks & Recreation Department Director as agent of the
APPLICANT to conduct all negotiations and execute and submit all documents,
including, but not limited to, APPLICATIONS, CONTRACTS, amendments,
payment requests, and compliance with all applicable current state and federal
laws which maybe necessary for the completion of the aforementioned PROJECT.
