HomeMy WebLinkAboutCC RES 99-11 RESOLUTION NO. 99-11 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, 2 CALIFORNIA DENYING, WITHOUT PREJUDICE, ZONE CHANGE 98-002, A 3 PROPOSAL TO AMEND THE OFFICIAL TUSTIN ZONING MAP AND APPLY THE CULTURAL RESOURCE OVERLAY DISTRICT TO THE 4 PROPERTIES SHOWN IN EXHIBIT A. 6 The City Council of the City of Tustin does hereby resolve as follows: 7 I. The City Council finds and determines: 8 9 A. That the original Cultural Resource District was approved by the City Council through the adoption of Ordinance No. 1001 on June 20, 1988 to recognize, ~0 preserve, protect and use culturally significant structures, natural features, sites and ~1 neighborhoods within the City of Tustin in the interest of the health, safety, prosperity, social and cultural enrichment and general welfare of City residents. 12 B. That Tustin City Code Section 9252e provides designation procedures for the 13 establishment of cultural resource districts. 14 C. That public workshops on the subject of the potential expansion of the Cultural ~5 Resource Overlay District were held on February 24, 1998 and March 21, 1998. 16 D. That Public Hearings were duly noticed, called and held on Zone Change 98-02 27 by the Cultural Resource Advisory Committee on August 11, 1998 and September ~8 8, 1998; the Planning Commission on October 26, 1998 and November .9, 1998; and by the City Council on January 5, 1999. 19 20 E. This project is e~cempt from the requirements of CEQA pursuant to Section 15270 of the California Environmental Quality Act, which states that CEQA does not n apply to projects rejected or disapproved by a public agency. 22 F. That the proposed Zone Change is consistent with the Tustin General Plan, 23 including the General Plan policy to "Study the potential expansion of the Cultural Resource Overlay District north of First Street to Irvine Boulevard." 24 25 G. That the City's Historical Resources Survey Report, dated July 1990, recommends that the residential area between First Street and Irvine Boulevard be considered for 26 two separate potential cultural resources districts. 27 H. ' That the area to the north of the original Cultural Resource District between First 28 Street and Irvine Boulevard (including First Street and Yorba Street) lies within 29 Resolution No. 99-11 Page 2 1 2 Tustin's original City limits, but contains only 74 of the 271 structures listed in the 3 City's Historical Resources Survey. 4 I. That the area of the proposed zone change contains only 54 of the 271 structures 5 listed in the City's Historical Resources Survey. 0nly 43 of the 54 structures are considered contributing structures. Eleven of the historic structures have "D" 6 ratings because they have been significantly altered. 7 J. That the residential area between First Street and Irvine Boulevard contains a group g of historic homes that have the potential to be an asset to the existing Cultural 9 Resource District. Consideration for establishing a district in this area may be appropriate in the future. 10 ~ ~ K. That only a portion of the homes within the proposed Cultural Resource Overlay District embody distinctive characteristics of style, type, period, or method of ~2 construction, or are a valuable example of the use of indigenous materials or craftsmanship, in that the area contains a limited collection of Spanish Colonial 13 Revival, California Bungalow, Craftsman, Colonial'Revival, Period Revival and ~4 Victorian-Italianateresidences, most of which were built between 1915 and 1928. ~5 L. That the proposed zone change would require that all properties within the zone ~6 change area be subject to the Certificate of Appropriateness process. This process would create an additional level of regulation which is not justified at this time in ~7 the subject zone change area based on the small number of highly significant ~s historic structures in the proposed zone change area. ~9 II.
