PARKER, CITY MANAGER FIRST READING OF ORDINANCE NO. 1492 ESTABLISHING COMPENSATION AND TERMS OF OFFICE FOR THE BUILDING BOARD OF APPEALS Staff recommends that the City Council approve compensation for the Building Board of Appeals in the amount of $150 per Board Member per meeting attended and establish staggered terms for the members of that Board. RECOMMENDATION: That the City Council have first reading by title only of Ordinance No. 1492. FISCAL IMPACT: There is no significant budget impact related to these increases. BACKGROUND: On February 6, 2018, the City Council adopted Ordinance No. 1486 establishing the Building Board of Appeals. Prior to the establishment of the independent Building Board of Appeals (the "Board"), the members of the Planning Commission served as the Board. The proposed meeting stipend of $150 is consistent with the current per meeting stipend for the members of the Planning Commission. Pursuant to section 1573 of the Tustin City Code, the term for each Board Members is four (4) years commencing on the date of appointment for each office. So that the terms of all members do not all expire on the same year, staff recommends that the initial appointments of the Board members be as follows: three (3) members will be appointed to serve four (4) year terms and two (2) members will serve an initial two year term. Thereafter, all members would be appointed to serve staggered four (4) year terms. This structure of staggered terms is consistent with the staggered terms served by the City's other commissioners. ORDINANCE NO. 1492 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING ARTICLE 1, CHAPTER 5 OF THE TUSTIN CITY CODE REGARDING COMMISSIONER AND BOARD MEMBER COMPENSATION AND TERMS The City Council of the City of Tustin, California, hereby ordains as follows: SECTION I The City Council finds and determines as follows: A. That the City Council of the City of Tustin wishes to amend the Tustin City Code as it pertains to compensation of City Commissioners and Board Members. B. That the Tustin City Code presently authorizes Commissioner and Board Member compensation to be established by the City Council, but does not require an Ordinance to amend the amount by such compensation. That the City Council finds that the amount of the Commissioner and Board Member compensation should be established and amended by City Council ordinance. C. That the City Council established four (4) year terms for the Building Board of Appeals. This Ordinance amends the City Code to establish staggered terms for the Board member appointments. SECTION II Section 1573 (c) of the Tustin City Code shall be amended to read as follows: 1573 - APPOINTMENTS AND TERMS c. Terms of Office. The terms of office shall be for four (4) years commencing on the date of appointment for each office. Initial appointments establishing the Board shall be as follows: three (3) members will be appointed to serve four (4) year terms and two (2) members will serve initial two year terms. Thereafter, each term shall be four (4) years. SECTION Ill. This Section supersedes Ordinance No. 1434.
