A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
3 CALIFORNIA, APPROVING FINAL PARCEL MAP 97-164 LOCATED
AT THE NORTHWEST CORNER OF JAMBOREE ROAD AND
4 EDINGER AVENUE.

The City Council of the City of Tustin does hereby resolve as follows:
? I. The City Council finds and determines as follows:
8 A. That Final Parcel Map 97-164 has been submitted by Jamboree Plaza
Holdings, LLC ("the Subdivider");
B. That a public hearing was held by the Planning Commission on October
~0 27, 1997. At this hearing, the Planning Commission recommended that
the City Council approve Tentative Parcel Map 97-164. Subsequently,
~ the City Council approved Tentative Parcel Map 97-164 on November 3,
~2 1997;
~3 C. Pursuant to Section 15268(b) (Ministerial Projects) of the California
Environmental Quality Act (CEQA), the Final Map is considered
~4 statutorily exempt from the requirements of CEQA.
~5 D. That the proposed subdivision is in substantial conformance with the
Tustin General Plan, the Tustin Zoning Code and Subdivision Map Act;
E. That the proposed project has been reviewed for conformity with the
~? provisions of the Orange County Congestion Management Program,
and it has been determined that the additional traffic generated by the
~s proposed project onto the CMP Highway System does .not cause the
~9 system to, exceed established level of service standards (ELS);
20 F. That the City has reviewed the status of the School Facilities
Agreements between the irvine Company and the Tustin Unified School
2~ District for the impact of Tentative Parcel Map 97-164 on School District
facilities., and changes in state law. Impacts associated with this
2~- approval on School District facilities are 'adequately addressed; ,
23 G. That the site is physically suitable for the type of development proposed;
24 H. That the site is physically suitable for the proposed density of
25 development;
26 I. That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
27 and avoidably injure fish or wildlife in their habitat;
28 J. That the design of the subdivision. or the type of improvements proposed
will not conflict with easements acquired by the public-at-large, for
:9 access through or use of the property within the proposed subdivision;
K. That the design of the subdivision or the types of improvements
proposed are not likely to cause serious public health problems;

~_ L. That the Final Map is in substantial conformance with the Tentative
Parcel Map; and,

M. That the project has been reviewed for consistency with the Air Quality
Sub-Element of the City of Tustin General Plan and has been

determined to be consistent or has been conditioned to be consistent
5 with the Air Quality Sub-Element.

II. The City Council hereby approves Final Parcel Map 97-.164, subject to the final
? approval by the City Engineer and City Attorney.
9 PASSED AND ADOPTED at a regular meeting' of the Tustin City Council, held on the
16th day of February, 1999.
