A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
APPROVING CONDITIONAL USE PERMIT 98-028 TO ESTABLISH A
VETERINARY SPECIALTY CLINIC AT 2965 EDINGER AVENUE
2 (JAMBOREE PLAZA).

The City CounCil does hereby resolve as follows:

5 I. The City Council finds and' determines as follows:
6 A. That a proper application, Conditional Use Permit 98-028, was filed by
7 Veterinary Specialty Associates requesting to establish a Veterinary
Specialty Clinic at 2965 EdingerAvenue, within Jamboree Plaza.

B. That a proper application, Zone Change 98-003, a request to amend the
9 Jamboree Plaza' District Regulations .Section 3.4.Fo4 to designate
i0 Veterinary Specialty Clinics as conditionally permitted uses, and to amend
Section 3.7.B.2 to establish parking requirements for Veterinary Specialty'
1 Clinics, was approved by the City Council.

C. That a public hearing was duly called, noticed and held for said application
~3 on December 14, 1998 by the Planning Commission, and on January 5,
1999 by the City Council.

~5 D. That on December 14, 1998, the Planning Commission recommended that
the City Council approve the project.

E. That establishment, maintenance, and operation of'the use applied for will

· not, under the circumstances of this.case, be detrimental to the health,'
18 safety, morals, comfort or general welfare of the persons residing or
working in the neighborhood of such proposed use, evidenced by the
~9 following findings:

1) The proposed use, as conditioned, will not be detrimental to the
2~ health, safety, morals, comfort and general welfare of persons
22 residing or working in the neighborhood in that all activities would
take place within the building. In particular, animals would be
23 confined to within the building and storage of biohazardous, medical,
and sharps wastes would take place within the building.

25 2) The proposed use, as conditioned, will not be detrimental to nor
have a negative effect on surrounding property owners in that
26 parking demand can .be accommodated on-site, within the spaces
allocated to the building.. Further, the anticipated Average Daily
27 Trips generated by the proposed use 'on the adjacent streets would
28 not exceed Orange County Congestion' Management Program
thresholds.
F. A Negative Declaration has been approved for this project by the City
Council in accordance with the provisions of the California Environmental
Quality Act (CEQA).

II. The City Council hereby approves CUP 98-028 to establish a Veterinary Specialty

Clinic at 2965 Edinger Avenue, subject to the conditions contained in Exhibit A, of
6 Planning Commission Resolution No. 3644.

s PASSED AND ADOPTED by the City Council of the City of Tustin, at a regular meeting
on the 5th day of January, 1999.
