Planning Commission Report GPC Determination—Housing Authority March 27, 2018 Page 2 APPROVAL AUTHORITY General Plan Conformity: Pursuant to Section 65402(a) of the Government Code, the Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed acquisition or disposition of real property is consistent with the General Plan. BACKGROUND AND DISCUSSION: The Housing Authority is proposing the sale of a City-owned residential unit located at 370 Flyers Lane at market rate. The affordable unit was purchased as a result of foreclosure activities. On March 7, 2018, the Tustin Housing Authority Commission authorized the sale. The Housing Authority utilized Low and Moderate Income Housing Asset Funds (LM]HAF) to purchase the unit. These funds will be recovered through the sale of the unit at market rate and the proceeds will be deposited into the LMIHAF. The LMIHAF supports Housing Authority efforts to monitor and preserve the balance of affordable ownership units in the Authority's inventory. Genera!Plan Conformity Pursuant to Section 65402(c) of the Government Code, prior to acquisition or disposition of real property by a local agency such as the City, a general plan conformity . determination is required. The Planning Commission is authorized to determine whether the location, purpose, and extent of the proposed conveyance are consistent with the General Plan. The proposed sale of the affordable unit at market rate supports the following General Plan Housing Element goals: 1. Housing Element Goal 1: Provide an adequate supply of housing to meet the need for a variety of housing types and the diverse socio-economic needs of all community residents. 2. Housing Element Goal 3: Increase the percentage of ownership housing to ensure a reasonable balance of rental and owner-occupied housing within the City. 3. Housing Element Goal 4: Preserve the existing supply of affordable housing in the City. Planning Commission Report CPC Determination — Housing Authority March 27, 2018 Page 3 While the sale of the affordable unit at market rate values reduces the Housing Authority's inventory, the funds are used to administer and monitor the Housing Authority's existing inventory of affordable ownership units. The purpose of administering and monitoring the existing inventory is to insure units at risk of foreclosure remain in the inventory and to prevent affordable owners from renting their units. Affordable owners can attempt to purchase another home by renting out their affordable unit and this is to the detriment of other families who could qualify to purchase their affordable unit. By preventing owners from renting their units, the Housing Authority seeks to preserve affordability for future buyers and prevent existing affordable owners from taking advantage of the City's affordable program in order to add to their real estate portfolio. In an effort to expand affordable housing opportunities in Tustin, the City and Housing Authority conveyed property at 140 S A Street on October 4, 2017, to Habitat for Humanity of Orange County for the purpose of constructing two homes for income-eligible veterans to purchase. The City and Housing Authority are currently negotiating with Jamboree Housing Corporation for the development of affordable rental housing in Tustin Legacy. CONCLUSION The location, purpose, and extent of the proposed conveyance is in conformance with the General Plan and staff recommends that the Planning Commission adopt Resolution No. 4362.
