SUBMITTAL OF CITY OF TUSTIN APPLICATION FOR THE
TRANSPORTATION ENHANCEMENT ACTIVITIES PROGRAM, FISCAL
YEARS 2005-2006 AND 2006-2007
SUMMARY
City Council adoption of Resolution No. 04-78 will authorize the City's application for funds
from the Transportation Enhancement Activities (TEA) Program. The Orange County
Transportation Authority (OCTA) requires City Council authorization as part of the
application process.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 04-78 requesting that the
Orange County Transportation Authority (OCTA) include the City of Tustin's project in the
Fiscal Years 2005-2006 and 2006-2007 Transportation Enhancement Activities (TEA)
Program.
FISCAL IMPACT
If the proposed application is approved by OCTA, the City's funding obligations for various
projects in the Seven-Year Capital Improvement Program will be reduced by $500,000.
BACKGROUND
The TEA program is a federal program that provides grants to local and state agencies to
be used for transportation related projects that enhance quality-of-life in or around
transportation facilities. The specific amount available Countywide under the program is
$3.4 Million. The City will be required to provide a minimum of 25 percent matching funds
for each approved project. The total maximum amount of TEA Program funding available
for each project is $500,000.
Staff has prepared a TEA Program application for one project consistent with the City's
adopted Fiscal Year 2004-2005 through 2010-2011 Seven-Year Capital Improvement
Program. The project for which grant monies are being applied for is the Edinger Avenue
Beautification Project between east of Red Hill Avenue and west of Jamboree Road. The
proposed work consists of landscaping and irrigation installation along the median island
and the north parkway of Edinger Avenue adjacent to the railway right-of-way. This project
was selected based upon review of past application submittals, current established criteria
for funding and evaluation of the project matching fund requirements.

Applications must be submitted to OCTA by September 15, 2004 to meet the TEA Program
deadline. Resolution No. 04-78 designates the project to be submitted by the City for
Fiscal Year 2006-2007 of the OCTA TEA Program. The TEA Program funding eligibility
requires City Council authorization to apply for funding under this program.

RESOLUTION NO. 04-78
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, AUTHORIZING APPLICATION FOR FUNDS FROM THE
TRANSPORTATION ENHANCEMENT ACTIVITY (TEA) PROGRAM UNDER THE
1998 TRANSPORTATION EQUITY ACT FOR THE 21ST CENTURY FOR THE
EDINGER AVENUE BEAUTIFICATION PROJECT BETWEEN EAST OF RED HILL
AVENUE AND WEST OF JAMBOREE ROAD, FISCAL YEAR 2006-2007.
WHEREAS, the United State Congress in June 1998 enacted the Transportation
Equity Act for the 21 st Century, replacing the expired Intermodal Surface
Transportation Efficiency Act of 1991 which make funds available to the Orange
County Transportation Authority (OCTA) for transportation enhancement activities;
and
WHEREAS, OCTA has established the procedures and criteria for reviewing
proposals; and
WHEREAS, the City of Tustin possesses authority to nominate transportation
enhancement activities and to finance, acquire, and construct the proposed project;
and
WHEREAS, by formal action the City Council of the City of Tustin authorizes the
nomination of the Edinger Avenue Beautification Project between east of Red Hill
Avenue and west of Jamboree Road, including all understanding and assurances
contained therein, and authorizes the City of Tustin Director of Public Works/City
Engineer as the official representative of the City of Tustin to act in connection with
the nomination and to provide such additional information as may be required; and
WHEREAS, the City of Tustin will maintain and operate the property acquired,
developed, rehabilitated, or restored for the life of the resultant facilities or activity;
and
WHEREAS, with the approval of the California Department of Transportation
(Caltrans) and OCTA, the City of Tustin or its successors in interest in the property
may transfer the responsibility to maintain and operate the property; and
WHEREAS, the City of Tustin will give Caltrans' and aCTA's representatives
access to and the right to examine all records, books, papers or documents related
to the transportation enhancement activity; and
WHEREAS, the City of Tustin will cause work on the project to be commenced
within a reasonable time after receipt of notification from the State that funds have
been approved by the Federal Highway Administration and that the project will be
carried to completion with reasonable diligence; and

WHEREAS, the City of Tustin will comply where applicable with provisions of the
California Environmental Quality Act, the National Environmental Policy Act, the
Americans with Disabilities Act, and any other federal, state, and/or local laws, rules
and/or regulations;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tustin, hereby authorizes the Director of Public Works/City Engineer as the official
representative of the City of Tustin to apply for the Transportation Enhancement
Activities Program under the Transportation Equity Act for the 21 st Century for the
Edinger Avenue Beautification Project between east of Red Hill Avenue and west of
Jamboree Road, Fiscal Year 2006-2007.
BE IT FURTHER RESOLVED that the City of Tustin, agrees to fund its share of
the project costs and any additional costs over the identified programmed amount.
This action is in conformance with the OCTA TEA guidelines and does not exceed
seventy-five (75) percent of the total eligible costs.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin, California, held on the 7th day of September 2004.
