HomeMy WebLinkAboutCC RES 98-110 RESOLUTION NO: 98-110 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE FINAL NEGATIVE 3 DECLARATION AS ADEQUATE FOR CONDITIONAL USE PERMIT 97-028 AND DESIGN REVIEW 97-036. ALL FEASIBLE 4 MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY 5 ACT. The City Council of the City of Tustin does hereby resolve as follows: ? I. The City Council finds and determines as follows: 8 A. That Conditional Use Permit 97-028 and Design Review 97-036 are 9 considered "projects" pursuant'to the terms of the California ~0 Environmental QUality Act; and B. A Negative Declaration has been prepared for this project and has ~ been distributed for public review. ~2 C. Whereas, the Planning Commission of the City of Tustin has ~s considered evidence presented by the Community Development Director and other interested parties With respect to the subject ~4 Negative Declaration, and on November 9, 1998 recommended that tfie City Coundl certify the Negative Declaration. 15 D. The City Council of the City of Tustin has reviewed and considered ~6 the Negative Declaration and has determined that the Negative Declaration is adequate and complete. It. A Final Negative Declaration has been completed in compliance with CEQA ~8 and state guidelines. The City Council has received and considered the ~9 information contained in the Negative Declaration prior to recommending approval of the proposed project, and found that it adequately discussed the 20 environmental effects of the proposed project. Further, the City Council finds the project involves no potential for any adverse affects, either 2~ individually or cumulatively, on wildlife resources; and therefore makes a De Minimis Impact Finding related to the California State Department Fish and 22 Game Code Section 711.4. 23 PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on the 7th day of December 1998. 24 27 THOMAS R.
