REQUEST:
A REQUEST TO AMEND THE MASTER SIGN PROGRAM FOR
THE PLAZA LAFAYETTE SHOPPING CENTER BY REPLACING
AN EXISTING CENTER IDENTIFICATION POLE SIGN WITH A
NEW POLE SIGN IDENTIFYING THE CENTER AND MAJOR
TENANTS.
RECOMMENDATION
That the Planning Commission adopt Resolution No. 3930 approving Conditional Use
Permit 04-021 amending the existing master sign program for the Plaza Lafayette
shopping center.
BACKGROUND
The site is located at the northwest corner of Newport Avenue and Irvine Boulevard
(Attachment 1 - Location Map) in the Central Commercial (C-2) District. The site is
bounded by an apartment complex to the north, commercial establishments to the east
and south, and professional offices to the west.

On November 24, 1986, a Conditional Use Permit authorizing the installation of a center
identification pole sign was approved by the Planning Commission through Resolution No.
2373. On April 15, 1987, the original master sign program for Plaza Lafayette was
approved administratively and was later amended on April 7, 1994. On August 4, 2004,
the City administratively approved an amendment to the existing Master Sign program to
allow for second floor tenants to install signs that are consistent with the City's Sign Code.
A master sign program is authorized by Section 9403g of the Tustin City Code and is
required for multi-tenant developments to encourage coordinated and quality sign design.
The Community Development Department is authorized to review and approve a master
sign program that is consistent with the Sign Code requirements. Section 9404.b.6 of the
Tustin City Code provides for a process in which a Conditional Use Permit could be
considered by the Planning Commission for a master sign program with elements that
deviate from standards contained in the City's Sign Code provided that the project is
located within a center with at least thirty thousand (30,000) square feet of building area.
The Plaza Lafayette shopping center meets these criteria in that it is a center with 57,011
square foot of building area.
DISCUSSION
Plaza Lafayette was constructed in 1986 as an upscale commercial shopping center
with top quality architecture that complements the area. Over the years, the shopping
center has attracted desirable tenants and clientele. Recently, the center was bought
by Plaza Lafayette Investors, loP. and, as part of their efforts to expand business
opportunities within the center, a new replacement pole sign identifying the center and
major tenants was requested (Attachment 2 - Submitted Master Sign Program)
The existing pole sign located at the landscape planter area along Newport Avenue was
authorized under Section 9404.b.2 of the Tustin City Code through Planning
Commission Resolution No. 2373 (Attachment 4). Section 9404.b.2 limits a pole sign to
the following:
(a)
Type of business. Only center identification signs are permitted to be pole
signs.
(b)
Size and scale of project. The center identified by the sign is a single
development project of at least one hundred thousand (100,000) building
square feet or five (5) acres in project size which has a minimum of three (3) or
more tenants.
(c)
Design. The pole sign is designed to reflect the theme of the center it identifies
and incorporates similar design elements, materials, colors and special
qualities of the architecture of the building(s) in the center and is compatible
with existing or proposed signage in the center.

(d)
Location. The pole sign shall (1) be located within a landscaped area and is
limited to one per street frontage, (2) maintain a minimum of one hundred
(100) lineal feet from any other monument or freestanding sign in the center,
and (3) be set back a minimum of twenty-five (25) feet from the interior side
property line or maintain a minimum of fifty (50) feet from another pole or
freestanding sign located on an adjacent site.
(e)
Height and size. The sign shall be compatible with the size and scale of the
project and shall not exceed twenty (20) feet in height and fifty (50) square feet
in size.
The existing pole sign does not comply with current code criteria in that, although the
shopping center is a single development project, it has only 57,011 square feet of
building square footage on an approximately 4.1-acre site instead of the required one
hundred thousand (100,000) building square feet or five (5) acres in project size with a
minimum of three (3) or more tenants. Therefore, the existing pole sign is considered
to be legal non-conforming. Tustin City Code Section 9405.e related to non-conforming
sign allows the continuation of the non-conforming sign; however, the sign may not be
expanded or altered so as to change the size, shape, position, location, or method of
illumination of the sign.
The proposed pole sign is illustrated on Page 3 of the Master Sign Program (Attachment -
2). The sign area is designed to project toward Newport Avenue instead of being
centered on the pole, as with the existing pole sign (Attachment 3 - Superimposed
photos of existing and proposed pole sign). Although the proposed pole sign would
comply with the design, location, and height and size criteria for a pole sign, the sign
would not comply with the type of business to be advertised nor the minimum size and
scale of a project that is eligible for a pole sign, as shown below:

While Section 9404.b.2 limits a .pole sign to certain criteria as discussed above, Section
9404.b.6 of the Tustin City Code allows the Planning Commission to consider a Master

Sign Program with elements that deviate from standards contained in the Sign Code
provided that the project is a center with at least thirty thousand (30,000) square feet of
building area. The Plaza Lafayette shopping center meets the criteria for deviations in
that it contains over 57,011 square feet building area and is located within a center.
Since the City is undertaking the Newport Avenue widening project, Condition No. 3.3 is
included to ensure that no part of the new pole sign would encroach onto the future public
right-of-way. Also, Condition No. 2.3 is included to limit the minimum letter height for the
pole sign to a minimum of six (6) inches to ensure the tenant names are legible for
motorists along Newport Avenue.
FINDINGS
In determining whether to approve the Conditional Use Permit, the Planning Commission
must determine whether or not the proposed amendment to the master sign program will
be detrimental to the health, safety, morals, comfort, and general welfare of the persons
residing in or working in the neighborhood, or whether it will be injurious or detrimental to
property or improvements in the vicinity, or to the welfare of the City. A decision to
approve this request is supported by the following findings:
1)
Section 9403g and Section 9404.b.6 of the Tustin City Code provides for the
adoption of master sign programs and allows for deviations from standards
contained in the City's Sign Code provided that the project is located within a
center with at least thirty thousand (30,000) square feet of building area. The
Plaza Lafayette shopping center meets these criteria in that it contains
approximately 57,011 square feet of building area and is located within a center.
2)
The proposed pole sign complies with the criteria for a pole sign in accordance
with Section 9404.b.2 of the Tustin City Code, with the exception that the pole sign
would include not only center identification but also five (5) major tenant signs
and is .9 acres smaller than the minimum size and scale of a project that is
eligible for a pole sign. The pole sign generally conforms to the requirements for
pole signs and the requested deviations are minor in nature. While the proposed
pole sign would allow for tenant signs, they are limited to only major tenants and
are required to be maintained within the allowable sign area for a pole sign. In
addition, the center is one of the largest shopping centers in the area with unique
business activities serving a community-wide area.

The location, design, height, and size of the proposed pole sign are designed to
reflect the center's theme by incorporating similar design elements, materials,
colors, and special qualities of the buildings in the center.

Signs proposed in the amendment to the master sign program would not be
detrimental or injurious to the community in that the new pole sign would be
required to comply with visual clearance requirements and the applicant would be
required to obtain a sign permit and approval from the City's Public Works
Department for the proposed pole sign prior to installation.

SECTION I
INTRODUCTION
The purpose of this sign master plan is to ensure the design and production of
quality signage which reflects the integrity of the architectural theme of Plaza
Lafayette. This sign master plan has been developed to communicate the particular
parameters each tenant is given so their individual store signage may be effective
and also complement the project as a whole.
To accomplish this goal the sign master plan has been written in sections with
numbered articles for easy reference. Each tenant is to read Section I and then
proceed to Section III to locate their leased space on Location Plan 2, then find
their suite number within the listing and read the sign types allowed for that
location. Section IV will explain the specific fabrication methods available for
each sign type. Section V provides the specific location of each sign layout area
and maximum square footage on each required elevation. (Refer to your suite number
and turn to the corresponding diagram).
APPROVAL PROCEDURES
All signs installed or displayed on the premises of Plaza Lafayette must have
written approval by the landlord and the City of Tustin. The aesthetic character-
istics of the signs, i.e., placement, size, proportions, color, texture, and
graphics are subject to the discretionary approval of the landlord, within the
context of this sign master plan. Tenants shall submit three (3) sets (one in
color) of professionally executed sign drawings which meet the City of Tustin
submittal standards (refer to City of Tustin Sign Code Articles I and II) and be
submitted to the landlord for review and approval. All tenant submittals to the
City of Tustin must be previously approved by the landlord, LaFayette Plaza
Investors, LP, c/o Remarc Management, Inc., or their designee.

TO DEVELOPERS AND SIGN CONTRACTORS
Design review and sign permits are required prior to the installation of
individual tenant signs.
The sign contractor shall submit two sets of plans to .the Community Development
Department containing elevation of existing building, location of sign on subject
elevation, number of proposed signs, details and calculations of structure sizes,
materials, colors, and lighting. Signs shall be consistent with the colors of
the center and with this sign master plan. Signs for adjacent tenants shall also
be shown.

FABRICATION STANDARDS
GENERAL SPECIFICATIONS
1. In no case will there be any exposed electrical raceways, conduit, transformers,
or junction boxes. Exposed hardware will be finished in a manner consistent
with quality fabrication practices and the installation will be approved by the
landlord.
2. All signs and installation of 'signs shall conform to the appropriate building
and electrical codes. The tenant and the sign contractor will obtain any and
all permits required.
3. All illuminated tenant signs must be from a dedicated service with a time clock.
(A) Major Tenant Wall Signs
1. A major tenant is defined as a tenant occupying 3,000 square feet or more of
gross leasable area.
2. Each major tenant will be allowed one (1) wall sign per street or parking lot
frontage to a maximum of two (2).
3. A major tenant may choose from three (3) categories of sign fabrication.
i)
Reversed metal channel letters internally illuminated to cr~ate a halo
lighting effect. The face of each letter must be opaque. The return of
each letter will be a minimum of 4 inches and not exceed 10 inches in
depth, and will be painted to match the letter face or the project
mullion color.
ii)
Die cast or fabricated bronze, brass, or aluminum/metal "letters. The
letters may be polished, oil finished, patined or painted with an
appr6priate automotive finish. The letter depth is not to exceed 25%
of the letter height (including distance spaced from wall).

Exposed neon wall sign. Cases where neon is listed as a signage option
will be reviewed on an individual basis, taking into consideration the
type of business, and visual impact, if any,. on neighboring tenants.
A maximum of 4 tenants. will be allowed to exercise the neon option
for wall signs. Once a tenant has approval fór neon wall signs,
it will be prohibited for adjacent tenants. Neon signs must be fabricated
to meet U/L standards and the City of Tustin's building code. No flashing
signs will be allowed. All neon signs will be approved by the Planning
Commission.

4. Major tenants may utilize their logo .graphics and custom colors. Creative
design of these elements is greatly encouraged so as to add to the aesthetic
theme of Plaza Lafayette. Major tenants may utilize a logo symbol fabricated
in the same fashion as the logotype. The exception to this rule is a fabricated
metal cabinet with a matte finish, semi-transparent plex face internally illuminated
to be used only in conjunction with reversed metal channel letters. The logo return
depth must match the logotype in size and color. .
5. The height of the signs' capital letters should be no higher than 24 inches and
no smaller than 10 inches. If a logo symbol is to be used in conjunction with
the logotype, the logo symbol must not exceed an area of 30% higher than the cap
height or two times (2x) the cap height in width.

6. The maximum square footage for each'major tenant wall sign is stated on the
corresponding elevation diagram for that suite. To find a specific store front,
refer to Location Plan 2, then tur~ to the corresponding diagram for that suite
number. The maximum sign area must not exceed 15% of the store front elevation
to a maximum area of 75 square feet.

(B) PLAZA TENANT WALL SIGNS
1. A plaza tenant is defined as a tenant occupying less than 3,000 square feet of
gross leasable area.
2. Each plaza tenant will be allowed one (1) wall sign per street or parking lot
frontage to a maximum of two (2).
3. A plaza tenant may choose from two (2) categories of sign fabrication.
i)
Individuàl letters fabricated or die cast from materials consistent with the
architectural and aesthetic theme of Plaza Lafayette, (eg. bronze, brass,
aluminum, wood). The letters must be finished to protect the~ from weathering
and provide a compatible appearance with the project theme (eg. oil' finished,
patined, painted, polished and clear coated). The letter depth must not
exceed 25% of the letter height (including distance if spaced from wall).
ii) Exposed neon wall sign. Cases where neon is listed as a signage option
will be reviewed on an individual basis, taking into consideration the
type of business, and visual impact, if any, on neighboring tenants. A
maximum of 4 tenants will be allowed to exercise the neon option for wall
signs. Once a tenant has approval for neon wall signs, it will be
prohibited for adjacent tenants. Neon signs must be fabricated to meet
U/L standards and the City of Tustin's building code. No £lashing neon
signs will be allowed. All neon signs will be approved by the Planning
Commission.

4. Plaza tenants may utilize their logo graphics and custom colors. If a logo symbol
is used in configuration with a logo typestyle, the symbol must be fabricated in
the same fashion as thetypestyle. If the tenant does not have a business identity
program or logotype, the tenant should utilize the project typeface with custom
colors. .
5. The height of the siq~s' capital letters should be no higher than 16 inches and
no smaller than 8 inches. If a logo symbol.is to be used in conjunction with.
the logotype, the logo symbol must not exceed an area of 30% higher than the cap
height or two times (2x) the cap height in width.

The Planning Commission of the City of Tustin dóes hereby resolve as
follows:

The Planning Commission finds and determines a~ follows:
A.
That a proper application. (Use Permit No. 85-31) has been filed
on behalf of Burnett-Eh1fne Properties and Rental Properties.
Inc. to authorize the installation of a 50 square foot, center
identification pole-type sign. 17'6" high at 13031 Newport
Avenue.
B.
That a public hearing was duly called, noticed and held on said
application.
C.
That establishment. maintenance, and operation of the use
applied for will not. under the circumstances of this case,
be detrimental to the health, safety, morals, comfort, or
general welfare of the persons residing or working in the
neighborhood of such proposed use, evidenced by the following
findings:
1.
That the design of the pole sign meets City code and
standards.
2.
That the pole sign is compatible with the architectural
quality of the structure to be served.
3.
That approval of a pole sign on the subject property will
not impair the orderly and harmonious development of the
area.

That the establishment. maintenance, and operation of the use

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF TUSTIN, APPROVING CONDITIONAL
USE PERMIT 04-021 AUTHORIZING AN AMENDMENT
TO THE PLAZA LAFAYETTE SHOPPING CENTER
MASTER SIGN PROGRAM FOR THE PROPERTIES
LOCATED AT 13011-13051 NEWPORT AVENUE.
The Planning Commission does hereby resolve as follows:

The Planning Commission finds and determines as follows:
A.
That a proper application, Conditional Use Permit 04-021, has been filed
by Lafayette Plaza Investors, loP. requesting authorization to amend the
existing Plaza Lafayette shopping center Master Sign Program approved
on August 4, 2004, by replacing an existing center identification pole sign
with a new pole sign containing the center identification and major tenants'
identifications.
B.
That the project is located within the Central Commercial (C-2) zoning
district and is designated by the Tustin General Plan as "Community
Commercial" which provides for the establishment of retail, professional
office, and service-oriented business activities. In addition, the project has
been reviewed for consistency with the Air Quality Sub-Element of the City
of Tustin General Plan and has been determined to be consistent with the
Air Quality Sub-Element in that the installation of a new pole sign will not
affect air quality.
C.
That Section 9404.b.6 of the Tustin City Code requires the approval of a
Conditional Use Permit for a master sign program with elements that
deviate from standards contained in the Sign Code.
D.
That a public hearing was duly called, noticed, and held for said
application on September 13, 2004, by the Planning Commission.
That the establishment, maintenance, and installation of the pole sign
applied for will not, under the circumstances of this case, be detrimental to
the health, safety, morals, comfort, or general welfare of the persons
residing or working in the neighborhood of such proposed use nor be a
detriment to the property and improvements in the neighborhood of the
subject property, nor to the general welfare of the City of Tustin as
evidenced by the following findings:

Section 9403g and Section 9404.b.6 of the Tustin City Code
provides for the adoption of master sign programs and allows for

deviations from standards contained in the City's Sign Code
provided that the project is located within a center with at least thirty
thousand (30,000) square feet of building area. The Plaza Lafayette
shopping center meets these criteria in that it contains approximately
57,011 square feet of building area and is located within a center.
2)
The proposed pole sign complies with the criteria for a pole sign in
accordance with Section 9404.b.2 of the Tustin City Code, with the
exception that the pole sign would include not only center
identification but also five (5) major tenant signs and is .9 acres
smaller than the minimum size and scale of a project that is eligible
for a pole sign. The pole sign generally conforms to the
requirements for pole signs and the requested deviations are minor
in nature. While the proposed pole sign would allow for tenant
signs, they are limited to only major tenants and are required to be
maintained within the allowable sign area for a pole sign. In
addition, the center is one of the largest shopping centers in the
area with unique business activities serving a community wide-
area.

The location, design, height, and size of the proposed pole sign are
designed to reflect the center's theme by incorporating similar design
elements, materials, colors, and special qualities of the buildings in
the center.
Signs proposed in the amendment to the master sign program would
not be detrimental or injurious to the community in that the new pole
sign would be required to comply with visual clearance requirements
and the applicant would be required to obtain a sign permit and
approval from the City's Public Works Department for the proposed
pole sign prior to installation.
This project is Categorically Exempt pursuant to Section 15311, Class 11 of
the California Code of Regulations (Guidelines for the California
Environmental Quality Act).
II.
The Planning Commission hereby approves Conditional Use Permit 04-021
authorizing the amendment to the Plaza Lafayette shopping center Master Sign
Program for properties located at 13011-13051 Newport Avenue, subject to the
conditions contained within Exhibit A attached hereto.

GENERAL
1.1
The proposed replacement pole sign shall substantially conform with the
submitted master sign program for the Plaza Lafayette shopping center date
stamped September 13, 2004, on file with the Community Development
Department, except as herein modified, or as modified by the Director of
Community Development in accordance with this Exhibit. The Director of
Community Development may also approve minor modifications to the
master sign program if such modifications are to be consistent with the
provisions of the Tustin City Code and other applicable codes.
Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with as specified or prior to the issuance of any building permits for
the project, subject to review and approval by the Community Development
Department.
Approval of Conditional Use Permit 04-021 is contingent upon the applicant
and property owner signing and returning to the Community Development
Department a notarized "Agreement to Conditions Imposed" form and the
property owner signing and recording with the County Clerk-Recorder a
notarized "Notice of Discretionary Permit Approval and Conditions of
Approval" form. The forms shall be established by the Director of
Community Development, and evidence of recordation shall be provided to
the Community Development Department.
As a condition of approval of Conditional Use permit 04-021, the applicant
shall agree, at its sole cost and expense, to defend, indemnify, and hold
harmless the City, its officers, employees, agents, and consultants, from any
claim, action, or proceeding brought by a third-party against the City, its
officers, agents, and employees, which seeks to attack, set aside, challenge,
void, or annul an approval of the City Council, the Planning Commission, or
any other decision-making body, including staff, concerning this project. The
City agrees to promptly notify the applicant of any such claim or action filed
against the City and to fully cooperate in the defense of any such action. The
City may, at its sole cost and expense, elect to participate in defense of any
such action under this condition.

Any violation of any of the conditions imposed is subject to the payment of a
civil penalty of $100.00 for each violation, or such other amounts as the City
Council may establish by ordinance or resolution, and for each day the
violation exists, subject to the applicable notice, hearing, and appeal process
as established by the City Council ordinance.
The applicant shall hold harmless and defend the City of Tustin from all
claims and liabilities arising out of a challenge of the City's approval for this
project.

Letter height on the pole sign shall be not less than six (6) inches to
ensure the sign is legible to motorists along Newport Avenue.

Prior to issuance of any building and/or sign permit, pole signs over four (4)
feet in height and modification to existing freestanding signs shall be
engineered by a California licensed and registered civil or structural
engineer.
All electrical work shall conform to the 2001 Edition of the California
Electrical Code (CEC).
Prior to issuance of any building and/or sign permit for the pole sign, the
applicant shall obtain necessary approval from Public Works Department to
ensure no part of the pole sign would encroach on the future right-of-way.
The pole sign shall be installed with adequate horizontal and vertical
intersection sight lines. In general, a 25 foot by 25 foot limited use triangle
shall be provided at typical driveways and shall be shown on the site plan.

Prior to issuance of any building and/or sign permits, payment shall be made
of all applicable fees, including but not limited to, the following. Payment
shall be required based upon those rates in effect at the time of payment
and are subject to change.
A. Building plan check and permit fees to the Community Development
Department based on the most current schedule.
B. Electrical plan check and permit fees to the Community Development
Department based on the most current schedule.
C. Sign plan check and permit fees to the Community Development
Department based on the most current schedule.
Within forty-eight (48) hours of approval of the subject project, the
applicant shall deliver to the Community Development Department, a
cashier's check payable to the COUNTY CLERK in the amount of forty-
three dollars ($43.00) to enable the City to file the appropriate
environmental documentation for the project. If within such forty-eight (48)
hour period that applicant has not delivered to the Community
Development Department the above-noted check, the statute of limitations
for any interested party to challenge the environmental determination
under the provisions of the California Environmental Quality Act could be
significantly lengthened.
