LEGACY PARK IMPROVEMENTS PROJECT, CIP NO. 20043
SUMMARY
The general contractors for construction of Veterans Sports Park at Tustin Legacy Park
Improvements Project, CIP No. 20043 have been pre -qualified and are ready to be approved as
eligible to bid the project. Also, the plans and specifications for the Veterans Sports Park at Tustin
Legacy Park Improvements Project, CIP No. 20043 are being finalized and ready to bid mid-June
pending final approval of the Project Environmental Review Form (PERF) T-012 and applicable
portions of plans and specifications pertaining to the PERF by the Department of the Navy and
City Engineer.
RECOMMENDATION
It is recommended that the City Council:
1. Approve the eligible pre -qualified general contractors as identified to bid the construction
of the Veterans Sports Park at Tustin Legacy Park Improvements Project, CIP No. 20043.
2. Adopt Resolution No. 18-31 approving the plans and specifications for construction of the
Veterans Sports Park at Tustin Legacy Park Improvements Project, CIP No. 20043, and
authorize the City Clerk to advertise to receive bids from the seven (7) pre -qualified
general contractors.
FISCAL IMPACT
Sufficient funds have been budgeted and appropriated in this Fiscal Year 2017-2018 Capital
Improvement Program for the project. The engineer's estimate for the park improvements project
is $16,000,000. The project is funded through a combination of sources that include MCAS
Backbone Fees (Fund 187), MCAS Tax Allocation Bonds (Fund 561) and Park Development Fees
(Fund 132).
CORRELATION TO THE STRATEGIC PLAN
The park improvements for the Veterans Sports Park at Tustin Legacy, CIP No. 20043 contributes
to the fulfillment of the City's Strategic Plan Goal A: Economic and Neighborhood Development.
Specifically, the project implementation of Strategy 1, which among other items is to complete the
Master Plan for Tustin Legacy and Strategy 6, which is to assess and to explore opportunities for
expanded recreational activities.

BACKGROUND
Pursuant to Public Contract Code 20101, on December 19, 2017 the City Council approved a pre -
qualification package for general contractors, utilizing a pre -qualification process modeled after the
California Department of Industrial Relations guidelines, for construction of the Veterans Sports
Park at Tustin Legacy Park Improvements Project. The pre -qualification procedure was selected for
the construction of the Veterans Sports Park at Tustin Legacy Park Improvements Project due to
the very specialized nature of construction. Construction scheduling may prove difficult and will
require significantly more expertise in coordination and facilitation of project progress. The City
Council approved pre -qualification package is attached for reference.
The pre -qualification questionnaire consisted of three (3) parts: Part I - Requirements for
Qualification, Part II - Organization, History, Organizational Performance and Compliance with Civil
and Criminal Laws and Part III - Recent Park Construction Projects Completed. Each of the above
Parts included numerical, scorable questions as well as a series of "yes" and "no" questions. In Part
I the criteria indicates that a contractor will be immediately disqualified if the answer to any of the
questions #1 through #5 is "no". The majority of contractors successfully completed the scorable
questions in the pre -qualification package.
However, Part III included a requirement (Item No. 39) to provide information about completed
projects and comparable projects, which some of the contractors did not provide the minimum
requirement information. Specifically, Item No. 39 required a contractor to provide information about
its three (3) most comparable park construction projects all of which must have been successfully
completed within the last seven (7) years. The projects identified by respondents had to be in
California, comparable in scope and quality with the Project, and with a contract value of at least
$10,000,000.
Whether a respondent was determined pre -qualified was based upon scores achieved by assigning
point values to completed responses in the three (3) parts described above, and complete,
affirmative responses to the "yes" and "no" questions. A passing score in Part I was 64 out of 80
possible points, Part II was 44 out of 55 possible points, and Part III was 88 out of a possible 110
points.
On March 1, 2018, the City received submittals under the pre -qualification process from fifteen (15)
general contractors for this project. As a result of review of the stipulated essential requirements for
qualification and analysis completed by gkkWorks and City staff, it has been determined that seven
(7) of the fifteen (15) general contractors have successfully met the minimum requirements of pre -
qualification for this project, and will be eligible to bid when this project is advertised for bid. The list
of the eligible pre -qualified general contractors is as follows:
• Angeles Contractor, Inc.
• BrightView Landscape Development Inc.
• Byrom -Davey, Inc.
• P.H. Hagopian Contractor, Inc.
• Los Angeles Engineering, Inc.
• Ohno Construction Company
• Pinner Construction Company, Inc.
As identified in the original Request for Pre -Qualification, the pre -qualification packages
(respondent questionnaire answers and financial statements) submitted by prospective contractors
are not public records and are not open to public inspection. All information provided is kept
confidential to the extent permitted by law. However, the contents may be disclosed to third parties

for purpose of verification, or investigation of substantial allegations, or in an appeal hearing. State
law requires that names of contractors applying for pre -qualification status shall be public record
subject to disclosure, and the first page of the questionnaire is used for that purpose. A list of those
general contractors that were not determined qualified based on the adopted Request for Pre -
Qualification are also attached.
As set forth on the Prequalification package, two (2) contractors did not meet the Part II required
minimum passing score of 44 and in the past 5 years has court litigations. Four (4) contractors did
not meet the minimum project experience criteria required. Specifically, the 3 projects listed were
not all park improvements related construction and did not meet the minimum $10,000,000 project
size. And two (2) contractors did not meet the minimum project experience criteria required and in
the past 5 years has court litigations claim.
The construction effort for the entire park improvements project is segregated into two phases. The
grading phase of this project consists of grading, storm drain, water, reclaimed water and sanitary
sewer installation. That phase of the construction was awarded to Sukut Construction, LLC, on
October 3, 2017 and is nearing completion. The park improvements phase will complete the
construction of the Veteran's Memorial monument, sports fields, sports courts, restroom buildings,
walkways and site amenities.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE
VETERANS SPORTS PARK AT TUSTIN LEGACY PARK IMPROVEMENTS
PROJECT, CIP NO. 20043 AND AUTHORIZING ADVERTISEMENT FOR BIDS
WHEREAS, it is the intention of the City Council of the City of Tustin, California to
contract for the construction of the Veterans Sports Park at Tustin Legacy park improvements
project, CIP No. 20043; and
WHEREAS, the City Engineer has presented plans and specifications for the
construction of said work; and
WHEREAS, That on January 16, 2001, the City of Tustin certified the Program Final
Environmental Impact Statement/Environmental Impact Report (FEIS/EIR) for the reuse and
disposal of MCAS Tustin. On December 6, 2004, the City Council adopted Resolution No. 04-76
approving a Supplement to the FEIS/EIR for the extension of Tustin Ranch Road between Walnut
Avenue and the future alignment of Valencia North Loop Road. On April 3, 2006, the City Council
adopted Resolution No. 06-43 approving an Addendum to the FEIS/EIR. The FEIS/EIR along with
its Addendums and Supplement is a program EIR under the California Environmental Quality Act
(CEQA). The FEIS/EIR, Addendum and Supplement considered the potential environmental
impacts associated with development on the former Marine Corps Air Station, Tustin; and
WHEREAS, an environmental checklist was prepared for the proposed project that
concluded no additional environmental impacts would occur from approval of the project. The
Environmental Analysis Checklist concludes that it can be seen with certainty that there is no
possibility that the activity in question may have a significant effect on the environment because
all potentially significant effects 1) have been analyzed adequately in an earlier EIR pursuant to
applicable standards, and 2) have avoided or mitigated pursuant to that earlier EIR, including
revisions or mitigation measures that are imposed upon the proposed project; and
NOW, THEREFORE, BE IT RESOLVED that the plans and specifications presented by
the City Engineer are hereby approved as the plans and specifications for:
Veterans Sports Park at Tustin Legacy Park Improvements Project, CIP No. 20043
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to
