CALL TO ORDER — Meeting #2433 ROLL CALL — City Clerk PUBLIC INPUT — Members of the public may address the City Council on items on the Closed Session Agenda. CLOSED SESSION UPDATE — City Attorney David E. Kendig CLOSED SESSION ITEMS - The Brown Act permits legislative bodies to discuss certain matters without members of the public present. The City Council finds, based on advice from the City Attorney, that discussion in open session of the following matters will prejudice the position of the City in existing and anticipated litigation: 1. CONFERENCE WITH LEGAL COUNSEL—ANTICIPATED LITIGATION -Significant exposure to litigation pursuant to Government Code § 54956.9(d)(2): (2 Cases) WRITTEN MATERIALS — Materials that are distributed to a majority of the Council members, less than 72 hours prior to the Regular Meeting, are available for public inspection at the following locations: In the City Clerk's Office during regular business hours and following business hours (after 5:30 p.m.) in the Council Chamber on the day of the meeting. CONFERENCE WITH LEGAL COUNSEL -ANTICIPATED LITIGATION -Significant exposure to litigation pursuant to paragraph (d)(2) and (e)(5) of Section 54956.9 regarding the April 25, 2018 direction by the City Council of the City of Santa Ana to sue all cities in the county regarding the homelessness situation. 3. Kendig ORAL COMMUNICATION/PUBLIC INPUT — At this time, any member of the public may address the Council on matters which are not on this evening's agenda, provided the matter is within the subject matter jurisdiction of the City Council. PRESENTATIONS — Dr. Glenn Roquemore, President Irvine Valley College: Integrated Design, Engineering and Automation (IDEA) at ATEP CONSENT CALENDAR ITEMS - All matters listed under the Consent Calendar are considered to be routine and will be enacted by one motion without discussion. Persons wishing to speak regarding Consent Calendar matters should file a "Request to Speak" form with the City Clerk. (Agenda Items 1 through 9) 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Recommendation: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL HELD APRIL 17, 2018. Recommendation: That the City Council approve the Action Minutes of the Regular Meeting of the City Council held on April 17, 2018. 3. RATIFICATION OF PAYROLL AND DEMANDS City Council May 1, 2018 Meeting Agenda Page 3 of 7 The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Recommendation: That the City Council approve Payroll in the amounts of $755,287.23; and Demands in the amount of $1,708,966.49. 4. AUTHORIZATION TO AMEND THE ALL CITY MANAGEMENT SERVICES (ACMS) INC. CROSSING GUARD SERVICES AGREEMENT The crossing guard contract with All City Management Services, Inc. is up for renewal for the 2017-2018 City of Tustin school year and the 2018-2019 City of Tustin school year. In August of 2014, the City of Tustin entered into a 3 -year contract agreement with All City Management Services, Inc. to provide crossing guard services for the City of Tustin. The original contract was authorized for the 2014-2015, 2015-2016, and 2016-2017 school years. The original contract allows the City of Tustin the option to extend the terms of the agreement for two (2) additional two-year terms. Recommendation: That the City Council approve and execute a 2 -year amendment to the existing contract entered into on August 5, 2014, with All City Management Services, Inc. and the City of Tustin in order to provide 13,860 hours of school crossing guard service for the 2017-2018 school year, and 15,750 hours of school crossing guard service for the 2018-2019 school year. 5. APPROVAL OF PRE -QUALIFIED GENERAL CONTRACTORS AND ADOPT RESOLUTION NO. 18-31 TO APPROVE PLANS AND SPECIFICATIONS FOR BIDS FOR THE CONSTRUCTION OF VETERANS SPORTS PARK AT TUSTIN LEGACY PARK IMPROVEMENTS PROJECT, CIP NO. 20043 The general contractors for construction of Veterans Sports Park at Tustin Legacy Park Improvements Project, CIP No. 20043 have been pre -qualified and are ready to be approved as eligible to bid the project. Also, the plans and specifications for the Veterans Sports Park at Tustin Legacy Park Improvements Project, CIP No. 20043 are being finalized and ready to bid mid-June pending final approval of the Project Environmental Review Form (PERF) T-012 and applicable portions of plans and specifications pertaining to the PERF by the Department of the Navy and City Engineer. Recommendation: That the City Council: Approve the eligible pre -qualified general contractors as identified to bid the construction of the Veterans Sports Park at Tustin Legacy Park Improvements Project, CIP No. 20043. 2. Adopt Resolution No. 18-31 approving the plans and specifications for construction of the Veterans Sports Park at Tustin Legacy Park City Council May 1, 2018 Meeting Agenda Page 4 of 7 Improvements Project, CIP No. 20043, and authorize the City Clerk to advertise to receive bids from the seven (7) pre -qualified general contractors. RESOLUTION NO. 18-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE VETERANS SPORTS PARK AT TUSTIN LEGACY PARK IMPROVEMENTS PROJECT, CIP NO. 20043 AND AUTHORIZING ADVERTISEMENT FOR BIDS 6. APPROVE THE ENGINEER'S REPORT FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT AND SET A PUBLIC HEARING TO CONSIDER LEVYING FISCAL YEAR 2018-2019 ASSESSMENTS At the February 20, 2018 meeting, the City Council ordered the preparation of an Engineer's Report for the Levy of Annual Assessments for the Tustin Landscape and Lighting District. The Engineer's Report has now been completed and is ready for City Council approval. Additionally, it is requested that the City Council declare its intention to levy annual assessments and set a public hearing for June 5, 2018. Recommendation: That the City Council: 1. Adopt Resolution No. 18-11 approving the Engineer's Report for the Tustin Landscape and Lighting District for Fiscal Year 2018-2019; and 2. Adopt Resolution No. 18-12 declaring its intention to levy annual assessments for Fiscal Year 2018-2019 and setting a public hearing for June 5, 2018. RESOLUTION NO. 18-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING THE ENGINEER'S REPORT FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT LEVY OF ANNUAL ASSESSMENTS FOR FISCAL YEAR 2018- 2019 RESOLUTION NO. 18-12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA DECLARING ITS INTENTION TO PROVIDE FOR AN ANNUAL LEVY OF ASSESSMENT FOR FISCAL YEAR 2018-2019 FOR THE IMPROVEMENT, MAINTENANCE AND SERVICING OF PUBLIC LANDSCAPING AND LIGHTING FACILITIES IN THE TUSTIN RANCH AREA WITHIN THE BOUNDARIES OF THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT AND TO LEVY AND COLLECT ASSESSMENTS PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 AND PROPOSITION 218 AND GIVING NOTICE THEREOF City Council May 1, 2018 Meeting Agenda Page 5 of 7 7. SUMMARY OF PROJECTS The following report provides a summary of projects and activities from the Community Development Department to the Tustin City Council. The report focuses on the status of projects that the Planning Commission, Zoning Administrator, or staff approved; major improvement projects; Certificates of Appropriateness; Code Enforcement activities; and, other items of interest. Recommendation: That the City Council receive and file this item 8. ADOPT RESOLUTION NO. 18-18 TO ACCEPT IMPROVEMENTS FOR THE VICTORY ROAD EXTENSION ROADWAY CONSTRUCTION PROJECT, CIP NO. 70221, AND AUTHORIZE THE CITY ENGINEER TO FILE A NOTICE OF COMPLETION Construction of the Victory Road Extension Roadway Construction Project, CIP No. 70221, has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. Recommendation: That the City Council: 1. Adopt Resolution No. 18-18 accepting the construction of the Victory Road Extension Roadway Construction Project, CIP No. 70221; and 2. Authorize the City Engineer to execute and file the Notice of Completion with the Orange County Recorder's Office. RESOLUTION NO. 18-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE VICTORY ROAD EXTENSION ROADWAY CONSTRUCTION PROJECT, CIP NO. 70221 9. CANCELLATION OF THE AUGUST 7, 2018 CITY COUNCIL MEETING Due to a lack of quorum, staff recommends cancellation of the August 7, 2018 City Council meeting. Recommendation: That the City Council direct the City Clerk to post a Notice of Cancellation for the regularly scheduled Council meeting on August 7, 2018. The City Council hereby waives notice of said meeting as required by Government Code §54954. REGULAR BUSINESS ITEMS — Matters listed under Regular Business are generally proposals for new legislation or items requiring discussion. SECOND READING AND ADOPTION OF ORDINANCE NO. 1495 Ordinance No. 1495 forms Community Facilities District No. 2018-01 (Public Services) levying special taxes within Improvement Area No. 1 of the City of Tustin Community Facilities District No. 2018-01 (Public Services). Recommendation: That the City Council have second reading by title only and adoption of Ordinance No. 1495. ORDINANCE NO. 1495 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ACTING AS THE LEGISLATIVE BODY OF THE CITY OF TUSTIN COMMUNITY FACILITIES DISTRICT NO. 2018-01 (PUBLIC SERVICES) LEVYING SPECIAL TAXES WITHIN IMPROVEMENT AREA NO. 1 OF THE CITY OF TUSTIN COMMUNITY FACILITIES DISTRICT NO. 2018-01 (PUBLIC SERVICES) 11. LEGISLATIVE UPDATE Staff has prepared an update of proposed key California legislative items for 2018. Recommendation: At the direction of the City Council. OTHER BUSINESS/CITY MANAGER AND CITY ATTORNEY COUNCILMEMBER COMMENTS AND REPORTS ADJOURNMENT — The next meeting is scheduled on Tuesday, May 15, 2018 for the Closed Session Meeting at 5:30 p.m. and the Regular Business Meeting at 7:00 p.m. in the Council Chamber, 300 Centennial Way, Tustin, California.
