Kendig: The Council unanimously denied Claim Nos. 18-11 and 18-12. The Council will reconvene following the Regular Meeting to discuss Items 4 and 5. Other than that, there was no reportable action. PRESENTATIONS — Mayor Murray presented Certificates of Recognition to Officers John Hedges, Robert Nelson, and Jorge Sanchez in honor of receiving the 2018 OC Human Relations Award for Community -Oriented Policing. Mayor Murray presented a Certificate of Recognition to Fire Fighter Nick Mezzo in honor of receiving Orange County Fire Authority Fire Fighter of the Year. Mayor Murray presented a Proclamation to Division Chief Andy Kovacs in recognition of Orange County Fire Authority Drowning Prevention Awareness. Persons wishing to speak regarding Consent Calendar matters should file a "Request to Speak" form with the City Clerk. (Agenda Items 1 through 5) It was moved by Councilmember Puckett and seconded by Councilmember Clark to approve the Consent Calendar items as recommended by staff. Motion carried: 5-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: That the City Council waive reading in full of all ordinances and resolutions on the agenda and declare that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES — REGULAR MEETING OF THE CITY COUNCIL HELD MAY 15, 2018. Motion: That the City Council approve the Action Minutes of the Regular Meeting of the City Council held on May 15, 2018. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: That the City Council approve Payroll in the amounts of $751,767.98 and $771,505.81; and Demands in the amount of $6,327,019.36. 4. QUARTERLY INVESTMENT REPORT FOR THE CITY OF TUSTIN AND THE SUCCESSOR AGENCY FOR THE TUSTIN COMMUNITY REDEVELOPMENT City Council June 5, 2018 Meeting Minutes Page 4 of 16 Government Code Section 53646 requires that the Treasurer make an Investment Report to the City Council at least quarterly showing balances by authorized investment and certifying its compliance with the adopted Investment Policy. Motion: That the City Council receive and file. 5. SECTION 115 TRUST INVESTMENT GUIDELINES POLICY In April 2017, the City Council approved the establishment of a Section 115 Trust with the Public Agency Retirement Service (PARS) in order to pre -fund the City's pension and Other Post - Employment Benefits (OPEB). Over the last several months, staff worked with the City's actuaries, the City Manager, and the PARS Investment Advisor and have selected the investment of funds in the Section 115 Trust in the Moderate Index Plus asset allocation strategy as described in the attached Investment Guidelines Policy document. The investment choices were reviewed with the Audit Commission and the Investment Sub -Committee who were in agreement with the investment with PARS in the Moderate Index Plus asset allocation. Motion: That the City Council receive and file the Section 115 Trust Investment Guidelines Policy. Recessed at 8:03 p.m. Reconvened at 8:04 p.m. ORAL COMMUNICATION/PUBLIC INPUT — (continued) 1. Alireza Kazemzadeh PUBLIC HEARING ITEMS — A Public Hearing Item provides Individuals the opportunity to be heard regarding an intended action of the City Council related to land use or fees. (Agenda Items 6-8) 6. CONDUCT PUBLIC HEARING TO CONSIDER LEVYING OF ANNUAL ASSESSMENTS FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT FOR FISCAL YEAR 2018-2019 The Tustin Landscape and Lighting District Engineer's Report was completed and approved by the City Council at their May 1, 2018 meeting. At that meeting, the City Council declared its intention to levy annual assessments and set a public hearing for June 5, 2018. In order to levy the annual assessments, the City City Council June 5, 2018 Meeting Minutes Page 5 of 16 Council is required to conduct a public hearing and, provided there is no majority protest, adopt Resolution No. 18-13 confirming the annual assessments for Fiscal Year 2018-2019. Public hearing opened at 8:06 p.m. Public hearing closed at 8:06 p.m. with no public input It was moved by Councilmember Puckett and seconded by Mayor Pro Tem Gomez to: 1. Conduct a public hearing to receive testimony on the proposed levy of annual assessments for the Tustin Landscape and Lighting District for Fiscal Year 2018-2019; and 2. Adopt Resolution No. 18-13 confirming the annual assessments for Fiscal Year 2018-2019. Motion carried: 5-0 RESOLUTION NO. 18-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA CONFIRMING THE LEVY OF ANNUAL ASSESSMENTS FOR THE LANDSCAPE MAINTENANCE AND PUBLIC STREET LIGHTING EXPENSES IN THE TUSTIN RANCH AREA WITHIN THE BOUNDARIES OF THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT FOR FISCAL YEAR 2018-2019 7. CODE AMENDMENT 2017-003 (ORDINANCE NO. 1493) - ALCOHOLIC BEVERAGE SALES ESTABLISHMENTS Code Amendment (CA) 2017-003 proposes to amend Article 9 Chapter 2 of the Tustin City Code to update the standards and guidelines related to new alcoholic beverage sales establishments. The CA would allow any commercially or industrially zoned property to request approval for an on- or off-site alcoholic beverage sales license with approval of a conditional use permit; establish new standards and operational guidelines; and, provide processes for issuance and/or revocation of CUPs for sales establishments. On March 13, 2018, the Planning Commission adopted Resolution No. 4360, recommending that the Tustin City Council adopt Ordinance No. 1493, approving CA 2017-003. On May 15, 2018, Tustin City Council continued the item to the June 5, 2018 meeting at staff request. City Council June 5, 2018 Meeting Minutes Page 6 of 16 Staff is requesting that the Tustin City Council continue the item again to July 17, 2018 to allow further analysis of the proposed ordinance. (Applicant: City of Tustin) Public hearing opened at 8:07 p.m. Public hearing closed at 8:07 p.m. with no public input It was moved by Councilmember Bernstein and seconded by Councilmember Puckett to continue the item to the July 17, 2018, meeting. Motion carried: 5-0 8. WORKFORCE HOUSING INCENTIVE PROGRAM ORDINANCE Ordinance No. 1491 proposes to add Chapter 9B to Article 9 (Land Use) of the Tustin City Code (TCC), relating to Workforce Housing Incentive Program. Public hearing opened at 8:08 p.m. Public Input: Adam Wood, BIA Public hearing closed at 8:10 p.m. It was moved by Councilmember Bernstein and seconded by Councilmember Clark to approve staff's recommendation of introducing first reading of the revised Ordinance No. 1491, adding Chapter 9B to Article 9 Chapter 1, relating to Workforce Housing Incentive Program; set a second reading for the next City Council meeting and amend the recommendation to direct staff to revisit the ordinance in two years and present an update to Council at that time. Motion carried: 5-0 ORDINANCE NO. 1491 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADDING CHAPTER 9B TO ARTICLE 9 OF THE TUSTIN CITY CODE ESTABLISHING WORKFORCE HOUSING INCENTIVE PROGRAM. REGULAR BUSINESS ITEMS — Matters listed under Regular Business are generally proposals for new legislation or items requiring discussion. (Agenda Items 9-11) 9. RESOLUTION NO. 18-40, TUSTIN HOUSING AUTHORITY RESOLUTION NO. 18-01 APPROPRIATING FUNDS FOR VARIOUS CITY AND HOUSING AUTHORITY BUDGETS FOR THE FISCAL YEAR 2018/2019 The City Council/Commissioners are requested to approve the attached City Council June 5, 2018 Meeting Minutes Page 7 of 16 Resolutions adopting the budgets for the City, Tustin Housing Authority, and the Water Enterprise Fund for Fiscal Year 2018/2019. This is the 2nd year update of the Fiscal Year 2017-2019 Biennial Budget. Deputy Director of Finance Sean Tran provided a PowerPoint presentation. It was moved by Mayor Murray and seconded by Councilmember Clark to: 1. Adopt Resolution No. 18-40, adopting the City budget and appropriating from the anticipated revenues of the City for fiscal year 2018/2019, Governmental Funds, $142,087,422; Special Revenue Funds, $22,313,273; Special Assessment Funds, $16,047,690, and the Water Enterprise Funds, $37,773,630; 2. Adopt Tustin Housing Authority Resolution No. 18-01, adopting the Housing Authority budget and appropriating from the anticipated revenues of the Authority for fiscal year 2018/2019, $525,695. Motion carried: 5-0 RESOLUTION NO. 18-40 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE CITY BUDGET AND APPROPRIATING FROM wo THE ANTICIPATED REVENUES OF THE CITY FOR THE FISCAL YEAR 2018- 2019 wow TUSTIN HOUSING AUTHORITY RESOLUTION NO. 18-01 A RESOLUTION OF THE TUSTIN HOUSING AUTHORITY OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE HOUSING AUTHORITY BUDGET AND APPROPRIATING FROM THE ANTICIPATED REVENUES OF THE AUTHORITY FOR THE FISCAL YEAR 2018-2019 10. APPROPRIATION LIMIT FOR FISCAL YEAR 2018/2019 Article XIII B of the State Constitution requires each City to annually adopt a limit on appropriations for all governmental funds. The following recommendation and attached worksheets are based on the updated 2nd Year Budget as presented to the City Council on June 5, 2018. It was moved by Councilmember Bernstein and seconded by Councilmember Puckett to: Select the change in the California per Capita Personal Income as the price factor for adjusting the Fiscal Year 2018/2019 appropriations limit. City Council June 5, 2018 Meeting Minutes Page 8 of 16 2. Adopt Resolution No. 18-42 setting the appropriation limit for Fiscal Year 2018/2019 at $90,391,756. Motion carried: 5-0 RESOLUTION NO. 18-42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DETERMINING AND ADOPTING AN APPROPRIATION LIMIT FOR THE FISCAL YEAR 2018-2019 IN ACCORDANCE WITH ARTICLE XIII B OF THE CONSTITUTION OF THE STATE OF CALIFORNIA, AND SECTION 7910 OF THE GOVERNMENT CODE 11. RESOLUTION PRE -APPROVING CERTAIN EXCUSED COMMISSIONER ABSENCES FROM CITY COMMISSION MEETINGS Consider whether specified reasons for commissioners to miss meetings would be deemed excused by the City Council, or alternatively, provide direction to prepare an ordinance amendment removing the existing exception for Council - approved absences. It was moved by Mayor Murray and seconded by Councilmember Clark to maintain the current code as it relates to commissioner absences. Motion carried: 4-1 (Mayor Pro Tem Gomez dissented) OTHER BUSINESS/CITY MANAGER AND CITY ATTORNEY City Manager Jeffrey C. Parker Thanked and congratulated John Buchanan, Director of Finance, Sean Tran, Deputy Director of Finance, Jenny Leisz, Deputy Director of Finance, the Finance Department, and Department Heads for their hard work during the entire budget process; announced was very pleased to present the second year of the two-year budget (2018/19 Budget) to the City Council, as well as having City Council approve the budget unanimously. May 24 Attended the Tustin Police Department's Swearing -In Ceremony; congratulated the Police Officers on their advancement; thanked all Tustin Police Officers for their dedicated service to the Tustin community. May 28 Attended the Memorial Day Celebration at the Tri -City Cemetery in Santa Ana. May 26 Honored to attend the Memorial Service for Bud Schuback, Commander of the American Legion Post in Leisure World. May 30 Attended the Orange County Business Council Leadership Breakfast; thanked Lucetta Dunn, President and CEO of the Orange County Business Council. May 31 Attended the League of California Cities -Orange County Division Board meeting; very informative meeting. Announced Governor Jerry Brown signed new legislation: AB1668 and SB606; which establishes permanent water conservation rules in California. Thanked city staff for always doing an amazing job; congratulated colleagues for taking a stand on city issues. Councilmember Puckett May 18 Participated in the Orchard Hills Middle School Exit Interviews; thanked Orchard Hills Middle School for the opportunity to participate in the event. May 21 Attended the Hope International Golf Fundraising Tournament; a fundraiser for student scholarships; raised over $70,000 for student scholarships. May 24 o Attended the Orange County Council of Governments (OCCOG) Board meeting; was elected Chairman for the upcoming year. o Attended the Transportation Corridor Agencies (TCA) meeting. o Attended the Tustin Police Department's Swearing—In Ceremony; great ceremony to attend. May 25 Attended the Tustin Ranch Elementary School's Memorial Day Celebration. June 1 Attended the Tustin Man and Woman of the Year Award Ceremony; congratulated Lindburgh McPherson and Christine Uribe for receiving the award. June 2 Attended the Row House Ribbon Cutting Ceremony. June 3 Attended the City of Tustin Street Fair and Chili Cook -Off event; congratulated David A. Wilson, Director of Parks and Recreation, the Parks and Recreation staff, Donna Marsh - Peery, Chair of Tustin Street Fair and Chili Cook -Off, and all the volunteers for their hard work; was very happy to attend the event this year, was unable to attend last year, due to having heart surgery. Councilmember Clark May 17 o Attended the Orange County Mosquito and Vector Control Board meeting. o Attended the City Selection meeting, was reappointed to the Emergency Medical Care Committee; thanked mayor Murray and Council colleagues for their support. May 18 o Participated in the Orchard Hills Middle School's Exit Interviews; was impressed with all of the eighth graders. o Attended the Tustin Unified School District's Teacher of the Year Awards Ceremony; congratulated teacher and Department Chair Advisor Joanna Vandal on receiving the Teacher of the Year Award. May 22 Attended the new Hoag Health Center, Open House Event, at the Tustin Legacy; great service to offer the Tustin community. May 24 Participated in the Association of California Cities Orange County (ACCOC) Elected Official's call on the Housing Trust Bill. May 25 Participated in the Tustin Ranch Elementary School Memorial Day Ceremony; thanked Tustin Ranch Elementary School teacher, Curtis Porter and Principal Tracy Barquer for the opportunity to participate. June 3 Unable to attend the Tustin Street Fair and Chili Cook -Off event, due to prior family obligations; heard event was a success; thanked Tustin Street Fair and Chili Cook -Off Chair Donna Marsh -Peery, everyone who participated, and volunteers for their hard work with the an event. Announced was selected as one of the twenty-five women to be a part of the Women in Government Program, led by Governing Magazine. Mayor Pro Tem Gomez May 17 Attended the Orange County Library Advisory Board Subcommittee, Strategic Vision Task Force; met to discuss long term plans for the library system; afterwards, the full Library Advisory Board met to discuss the budget for the upcoming year; discussed operations, capital funding, staffing, technology, and demographics, including the various languages spoken within the county. May 18 o Attended the Community Action Fund annual lunch; former Senator, Barbara Boxer was the featured speaker o Attended the Tustin Unified School District's Teacher of the Year Awards Ceremony; always an inspiring event and a great way to recognize the educators. May 24 0" o Unable to attend the Tustin Police Department's Swearing -In Ceremony due to scheduling conflicts. City Council June 5, 2018 Meeting Minutes Page 12 of 16 o Attended the Santa Ana River Flood Protection Agency (SARFPA) meeting; discussed the budget for the upcoming year and received an update on the pending projects. o Announced her family awarded a memorial scholarship at former middle school in her mother's name. May 25 Attended the Memorial Day Celebration at Tustin Ranch Memorial Elementary School; favorite event of the year; best part of the ceremony, along with honoring the veterans, hearing young voices cite the Pledge of Allegiance. May 29 Spoke to the Orange Area Realtors Group about the Tustin community and education in Orange County. June 3 Attended the Tustin Street Fair and Chili Cook -Off event; event seemed to be a great success as well as a very safe event; received many positive comments from many residents. Announced the Budget is a huge undertaking and the two-year cycle really helps for planning purposes. Echoed the comments from colleagues on Hoag Health Center in the Tustin Legacy; will be greatly used by the residents in the area. Congratulated Tustin Officers Jorge Sanchez, John Hedges and Robert Nelson for their community work in the south portion of Tustin at Heideman Elementary School as well as increasing the presence of the officers in a friendly way. Mayor Murray May 16 Attended the Fresh Off the Boat Restaurant Ribbon Cutting Ceremony. May 17 o Attended the Orange County Transportation Authority (OCTA) Bike Rally. o Attended the Orange County Transportation Authority (OCTA) Legislative Committee meeting. o Attended the Leadership Tomorrow Mayor and City Manager Interview Panels; Matthew West Assistant City Manager did an outstanding job of representing the City Manager's Office. May 18 o Attended the Orange County Transportation Authority (OCTA) Arlington Drive Project dedication ceremony in Costa Mesa. o Attended the Tustin Unified School District's Teacher of the Year Awards dinner. May 19 o Attended the Tustin Lemonade Day event; thanked Councilmember Clark for her efforts with the event. o Attended the Rotary Club's Lobsterfest at Peppertree Park; event was successful May 23 o Attended the Enderle Center's Mayor's Business Forum meeting with Jerry Craig, Deputy Director of Economic Development, and Bill McInerney, Tustin Chamber of Commerce Chairman. o Attended the Tustin Citizen Academy Public Works session; complimented Director Public Works Douglas S. Stack and his staff on a job well done. May 24 o Attended the Orange County Explorer Executive Committee meeting. o Attended the Association of California Cities Orange County (ACCOC), Legislative and Regulatory Committee Meeting. o Attended the Tustin Police Department's Swearing—In Ceremony; great ceremony to see. o Attended the Orange County Fire Authority (OCFA) Board of Directors meeting; Fire Chief Brian Fennessy has some good ideas in helping the agency move forward. May 25 o Attended the Memorial Day Celebration at Tustin Ranch Memorial Elementary School. o Attended the Orange County Transportation Authority (OCTA) Board of Directors meeting.
