PARKER, CITY MANAGER DERICK YASUDA, DIRECTOR OF HUMAN RESOURCES EXTENDING THE TERM OF THE PROJECT POSITION OF PUBLIC WORKS MANAGER Adoption of the attached Resolution will extend the term of the project position of Public Works Manager by five (5) years. RECOMMENDATION Adopt Resolution No. 18-46 to extend the term of the project position of Public Works Manager by five (5) years. FISCAL IMPACT None. This position is included in the adopted budget for Fiscal Year 2018-19. BACKGROUND AND DISCUSSION On August 5, 2014, the City Council adopted Resolution No. 14-53 to amend the City's Classification and Compensation Plan to create the classification of Public Works Manager and authorize the appointment of a project employee in this classification for a period of up to four (4) years from the employee's hire date. Krys Saldivar was hired to fill this project position on September 2, 2014; therefore, under the terms of Resolution No. 14-53, her employment will end on September 2, 2018 unless the City Council takes action to extend the term of the position. The project position of Public Works Manager was created in 2014 to provide professional expertise and staff support to the Deputy Director of Public Works — Engineering, with a focus on the following activities related to Tustin Legacy: traffic and transportation demand analysis and oversight, capital project management design and construction, development entitlement review and analysis, and long-range planning. The rationale for creating this project position was the expected increase in development activities after the completion of the Tustin Ranch Road extension in November 2013. Over the past four years the City has experienced the accelerated pace of development that was anticipated. Several major roadways have been City Council Agenda Report July 3, 2018 Extending the Term of the Project Position of Public Works Manager Page 2 completed at Tustin Legacy, a number of other major roadways are currently under construction, and planning for internal roadways within the neighborhoods of Tustin Legacy is ongoing. Traffic analysis of the impacts on adjacent cities continues to be a need for the City and multi -modal transportation solutions such as bikeways and other transit alternatives are key planning drivers moving forward. In addition to work on Tustin Legacy development, the project Public Works Manager has also been instrumental in assisting with other citywide transportation improvement projects, including the upcoming Main Street and Tustin Marketplace improvements, as well as assisting with the planning and review work for the Downtown Community Core and Red Hill Specific Plan Corridor. In short, the City has a continued need for the services provided by the project Public Works Manager and requests the Council's permission to extend the term of the position by an additional five (5) years, through September 3, 2023. An employee hired into a project position is employed at -will, meaning employment may be terminated at any time by the City or the employee, which provides the City with the flexibility to terminate the employee's employment prior to September 3, 2023 if a need no longer exists for the services she provides. On the other hand, if the City determines that a need for this position exists beyond September 3, 2023, the project position can be extended once again or the position can be converted to a regular full-time position. f Derick (as ud Director of Human Resources Attachment: 1. City Council Resolution No. 18-46 RESOLUTION NO. 18-46 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, EXTENDING THE TERM OF THE PROJECT POSITION OF PUBLIC WORKS MANAGER WHEREAS, the City of Tustin (the "City") has implemented Personnel Rules, Resolution No. 15-50, which authorize the City Council to establish "project" positions for a prescribed period of time or for the duration of a specified project; and WHEREAS, the City Council previously adopted Resolution No. 14-53 authorizing a project position of Public Works Manager for a period of four (4) years from the appointed employee's initial date of employment; and WHEREAS, the four (4) year term of the employee appointed to the project position of Public Works Manager will expire on September 2, 2018; and WHEREAS, the City has determined that there is a continued need for a project position of Public Works Manager. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin authorizes staff to implement the provisions of this Resolution. Section 1: Effective Dates The effective date of each section is September 3, 2018, unless otherwise stated herein. Section 2: Tenn of Employment The term of the project position of Public Works Manager shall be extended by an additional five (5) years from the effective date of this Resolution, through September 3, 2023. Extended terms of employment may be granted by the City Council as necessary if a need for this project position exists beyond this extension. An employee appointed to this position is employed at -will and employment may be terminated at any time by either the City or the employee. Section 3: Salary and Benefits The salary range and employment benefits for the classification of Public Works Manager are set forth in the Management Salary Resolution, Resolution No. 17-06, or as subsequently amended by the City Council.
