SUBJECT: AUTHORIZE A CONTRACT CHANGE ORDER WITH SUKUT CONSTRUCTION,
LLC FOR RELATED GRADING AND THE PLACEMENT OF SOIL STOCKPILES
(SURCHARGE) FOR THE TWO BRIDGE APPROACHES REQUIRED FOR THE
FUTURE TUSTIN RANCH ROAD PEDESTRIAN BRIDGE (CIP NO. 70243) AT
MOFFETT DRIVE
SUMMARY
Staff is recommending that the City Council authorize a contract change order to Sukut
Construction, LLC (Sukut), currently constructing the Moffett Drive (CIP No. 70230) and Legacy
Road (CIP No. 70231) Extensions, for grading of the eastern pedestrian bridge pad and the soil
stockpiles (surcharge) placement for both bridge approaches adjacent to Moffett Drive for the
future Tustin Ranch Road Pedestrian Bridge (CIP No. 70243).
RECOMMENDATION
It is recommended that the City Council:
1. Authorize a contract change order in the amount not to exceed $150,000 with Sukut
Construction for the work necessary to complete the eastern pedestrian bridge pad
grading and the surcharge stockpiles for both pedestrian bridge approaches based upon
bid pricing for similar work under contract and mobilized for the Moffett Drive and Legacy
Road extensions; and
2. Appropriate $150,000 utilizing budgeted MCAS Tustin Legacy Backbone Fee Program
(Fund 187) funds as programmed in the adopted FY 2018/19 Capital Improvement
Program for the Tustin Ranch Road Pedestrian Bridge (CIP No. 70243).
FISCAL IMPACT
Sufficient funds for this work and design in the amount of $1,400,000 have been budgeted in the
FY 2018/19 Capital Improvement Program for the Tustin Ranch Road Pedestrian Bridge (CIP No,
70243) utilizing the MCAS Tustin Backbone Fee Program Fund (Fund 187).
CORRELATION TO THE STRATEGIC PLAN
The construction of the Tustin Ranch Road Pedestrian Bridge contributes to the fulfillment of the
City's Strategic Plan Goal A: Economic and Neighborhood Development. Specifically, the project
implementation of Strategy 1, which among other items, is to develop critical phases of Tustin
Legacy.
DISCUSSION AND BACKGROUND
On August 25, 2015 the City of Tustin and Tustin Unified School District (TUSD) entered into a
Site Conveyance Agreement for the eventual construction of the Legacy Magnet School. The

school is currently anticipated to open in the Fall, 2020. Concept plans are underway to have the
Tustin Ranch Road Pedestrian Bridge completed in conjunction with the school opening if so
desired. Placing surcharge on the bridge pads will allow settlement of the underlying soils to
occur, which is anticipated to take anywhere from six to ten months. This is a similar procedure
that was previously used for the Tustin Ranch Road vehicular bridge over Edinger Avenue.
On September 20, 2016, Sukut was awarded the construction contract for the mass grade of the
school property (CIP 70234) and the surrounding streets and city property including the western
pedestrian bridge pad. Pursuant to the requirements of the Site Conveyance Agreement, an as -
graded certification and as -graded geotechnical report for the 40 -acre site were transmitted to
TUSD on May 1, 2017.
On October 18, 2016 the First Amendment to the TUSD Site Conveyance Agreement was entered
into by the parties which stipulated among other things that the Moffett Drive and Legacy Road
extensions would be constructed including all utility connections and to provide construction
access for TUSD by August 31, 2018 or such other time as agreed to by the parties. In response
to that amendment, on September 19, 2017 Sukut was awarded the construction of the Moffett
Drive (CIP No. 70230) and Legacy Road (CIP No. 70231) Extension Roadway Construction
Project which is currently underway.
The Moffett Drive work from east of the proposed Legacy Road to Park Avenue is now at a point
where utilities have been installed and concrete curb & gutter and asphalt street work are
imminent. Prior to these street improvements commencing, monies can be saved by grading the
eastern bridge pad and surcharging both pads for the Tustin Ranch Road Pedestrian Bridge now
before the streets are further completed. This will also allow ample time for the settlement of
these pads to occur prior to actual bridge construction.
