A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 15574
TO ELIMINATE FOURTEEN (14) PLANNED RESIDENTIAL UNITS
AND DEVELOP A COMMUNITY RECREATION FACILITY AT 2834
BALLESTEROS DRIVE WITHIN THE VENTURANZA DEL VERDE
PROJECT
The City Council of the City of Tustin does hereby resolve as follows:
The City Council finds and determines as follows:
A. That Final Tract Map 15574 has been submitted by Reilly Homes, Inc. ("the
Subdivider");
B. That a public hearing was held by the Planning Commission on February
23, 1998. At this hearing, the Planning Commission recommended that the
City Council approve Tentative Tract Map 15574. Subsequently, the City
Council approved Tentative Tract Map 15574 on March 2, 1998;
C. Pursuant to Section 15268(b) (Ministerial Projects) of the California
Environmental Quality Act (CEQA), the Final Map is considered statutorily
exempt from the requirements of CEQA.
D. That the proposed subdivision is in substantial conformance with the Tustin
General Plan, the Tustin Zoning Code and Subdivision Map Act;
E. The parkland dedication requirement for Tract 13835, as revised by
Tentative Tract Map 15574, has been satisfied with the recordation of Tract
12870. The parkland dedication requirement has been reduced from
1.8612 acres to 1.7688 acres;
F. That the City has reviewed the status of the School Facilities Agreements
between the Irvine Company and the Tustin Unified School District for the
impact of Tentative Tract 15574 on School District facilities, and changes in
state law. Impacts associated with this approval on School District facilities
are adequately addressed;
G. That the site is physically suitable for the type of development proposed;
H. That the site is physically suitable for the proposed density of development;
I. That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife in their habitat;
J. That the design of the subdivision or the type of improvements proposed
will not conflict with easements acquired by the public-at-large, for
access through or use of the property within the proposed subdivision;
K. That the design of the subdivision or the types of improvements
proposed are not likely to cause serious public health problems; and,
L. That the Final Map is in substantial conformance with the Tentative
Tract Map.
II. The City Council hereby approves Final Tract Map 15574, subject to final
approval by the City Attorney and City Engineer.
