Norman Pulliam is requesting authorization to vary with the provisions of the Sign Code and erect, at Larwin Square, three monument signs for three separate businesses each under 5,000 square feet; Directory sign for center and a Reader Board for the future Von's Market. On May 23, 1977 the Tustin Planning Commission approved the conceptual Larwin Square sign plan for the center, to include the monument signs, with permit details to be worked on with staff. It was staff opinion that due to the amount and size of the addi- tional signing requests that a formal variance application was required for review of proposals. FINDINGS 1. The three detached structures along Newport Avenue do not meet the minimum area requirements (5,000 square feet) to be authorized free standing identity within a shopping center. -- The three detached businesses (a financial institution, a restaurant and a fast food facility) will be located much closer to the Newport street frontage than any of the other businesses in the center. Street visibility should be no problem for these new structures. Staff has already received comments from concerned business persons located in the larger structures of the center about visibility into the project from Newport Avenue for their own facilities. It is logical to assume that some of the larger businesses (Kresges, Thriftys, Yardage shop, etc.) would also request similar free standing identity if it is 'ranted to those businesses right along the Newport frontage. Directory Signs are not provided for in the Commercial Signing District. The proposal calls for a Directory facing Newport of 280 square feet which is much larger than any sign provided for in the Code. A Directory listing the Report to the. City Council on Variance 77-7 Page 2 July 5, 1977 tenants could be authorized as a Center Identification Sign with the following conditions: 1) Pole Sign- 50 square feet maximum, or; Monument- 75 square feet, 6' maximum height 2) The site can be authorized one center ID sign per street frontage for a total of three. There is the possibility of allowing the Centennial Street signing allocation on the interior for ~use as the Directory and eliminating signing on Centennial. 3. A fifty-six (56) square foot reader panel is proposed for the new market building. Such a sign is not provided for within the Code nor has the City Council viewed such proposals without considerable concern in the past. Ther.e is the opportunity for the applicant to request from the Planning Agency authorization of 10 square feet of supplemental signing for special and unique identification needs. RECOMMENDED ACTION If the Planning Agency is to approve this application as submitte~ a ~finding of hardship placed upon these businesses by the Sign Code is required per State law. Resolution No. 1634 (A) is presented for adoption based '~Don a finding of hardship for each request. Conversely, if the Planning Agency does not find justification for the proposals the variance application should be denied by the adoption of Resolution No. 1634, substantially as drafted. The Planning Agency of the City of Tustin does hereby resolve as follows: 1. The Planning~Agency finds and determines as follows: a) That a proper application for Variance No. 77-7 was filed on behalf o~ Mr. C. Norman Pulliam for authorization to permit the installation of three (3) monument signs for three separate businesses each under 5,000 sq. ft.; of a directory sign for the center; and the display of a reader panel for the future Von's Market at Larwin Square. b) That a public hearing was duly called, noticed and held on said application. c) That .the construction, maintenance and operation of the signs requested in said application will not, under the circum- stances of this case, be detrimental to the health, safety, morals, or comfort of persons residing or working in the neighborhood nor injurious or detrimental to the property and improvements in the neighborhood of the subject property, nor to the general welfare of the City of Tustin, and should be granted. d) That because of special circumstances applicable t~ the subject property, relative to size, shape, topography, location or surrroundings, a strict application of the Sign Code (Ord. 0684) is found to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification, evidenced by the following findings: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 e) A request for a Negative Environmental Impact Report has been filed for the remodeling of Larwin Square. 2. The Planning Agency hereby approves Variance No. 77-7 to authorize construction of three (3) monument signs of 15 square feet for the three detached structures along Newport Avenue; the installation of a directory sign facing Newport Avenue of 288 sq. ft.; and the disPlay of a 56 sq. ft. reader panel on the front wall of the proposed market with the following conditions: a) Submittal of precise sign plans indicat- ing the exact sign locations and proposed copy for staff review. b) Approval of free standing sign locations by the City Engineer. c) Removal of the existing Larwin Square center identification sign prior, to the issuance of sign permits. PASSED AND ADOPTED at a regular meeting of the Planning Agency of the City of Tustin held on the 5th day of July, 1977. SIGNS AND ONE READER PANEL AT' LARWIN SQUARE. The Planning Agency of the city of Tustin does hereby resolve as follows: 1. The Planning Agency finds and determines as follows: a) That a proper application for Variance 77-7 was filed on behalf of C. Norman Pulliam to vary with provisions of the Sign Code and erect three monument signs for three separate businesses each under 5,000 s.f.; Directory sign for center and a Reader Board for the future Von's Market at Larwin Square. b) That a public hearing was duly called, no- ticed and held on said application. c) That said signs are not authorized by the 'Sign Code (Ord. #684). d) That in the absence of special circumstances applicable to the subject property, relative to size, shape, topography, location or surroundings, a strict application of the Sign Ordinance is found not to deprive the subject property of privileges enjoyed by other properties in the vicinity and under identical zone classification. e) That the granting of a variance as requested will constitute a grant of special privilege inconsistent with the limitations upon other properties in the vicinity and district in which the subject property is situated. f) That granting of a variance for construction of the 'requested monument and Reader panel signs would be contrary to the intent of the Sign Code, and said variance should not be granted. g) That the installation of a Directory Sign along the Newport Avenue frontage as noted on the submitted plans can be justified if proposed in lieu of one of the those authorized center identification signs. 2. The Planning Agency hereby denies a variance to authorize the construction of three business identificaition monument signs and one Reader panel for Larwin Square.. The Planning Agency does approve the construction of a 75 square foot, 6 foot high monument Directory sign to be located within the Larwin Square parking area as proposed subject to the following conditions: 4 ? 8 9 10 11 12 14 15 16 17 18 19 ~0 21 Z4 a) The Directory Sign is authorized in lieu of one of the three center identification signs. b) Submittal of detailed location and copy of the p~ans. c) Approval of location by City Engineer.
