PUBLIC HEARING NO. 1 DATE' July 18, 1977 SUBJECT' PREZONE 77-4 LOCATI ON: The property is located in the unincorporated area, 230 feet easterly of the centerline of Newport Avenue, bounded by Bonita Street on the south, and a public alley, 210 feet northerly from the centerline of Walnut Avenue on the north. APPLICANT: The application was initiated by the City of Tustin Planning Agency on its own motion. PROPOSAL' To amend the zoning map for the properties in the unincorporated portion of Orange County facing Newport Avenue, by changing the classifi- cation from the Orange County R-2 District to the City of Tustin Commercial General (CG) Dis- trict, to be effective upon annexation to the City of Tustin. BACKGROUND. Prezone 77-3, as approved by the City Council on June 6, 1977, established the R-3-2000 District for those properties in the unincorporated area easterly of the subject properties. At the time of the public hearing for Prezone 77-3, the Council, at the request of several of the property owners, proposed that the frontage of Newport Avenue be consistently developed between Laguna Road and Main Street for commercial uses. The proposed prezoning is for the purpose of creating a consistency of the zoning for the Newport frontage between Main Street and Laguna Road. DISCUSSION' The subject properties along Newport Avenue are underdeveloped to a four-lot depth, with the lot lines running northerly and southerly, parallel with Nev~ort Avenue. Although the frontages of the lots are on Walnut and Bonita Streets, several of the properties have been developed with Newport Avenue frontage as residential dwelling units. Where ultimate right-of-way has been acquired on Newport Avenue, the frontage lot has a depth of 28 feet. The remainder of the lots are 50' x 170' or 50' x 180'. Preferred and promoted development would be a realignment of the commercial development of the parcels with Newport Avenue front- age, taking access from the local streets and alleyways. It is believed that the prezoning action may Stimulate rede- velopment of the area with improved land use and community amenity. There have been no communications from the property owners within the subject area. The proposed rezoning would be compatible with the General Plan of the City of Tustin. A negative declaration for an exemption from an Environmental Impact Report has been filed on the premise that there are no pending development plans. RECOMMENDED ACTION: It is recommended that the Planning Agency recommend to the City Council the approval of Prezone 77-4 by the adoption of Resolu- tion No. 1644, substantially as drafted. BACKGROUND' The Red Hill Lutheran Church provided the City with a letter of consent for the annexation of their properties. The Local Agency Formation Commission approved the proposed Annexation No. 100, which includes five other lots in addition to Church-owned prop- erty. The protest hearing for the annexation is scheduled for August 15, 1977. Church-owned properties comprise the 4.63-acre parcel facing Red Hill Avenue which houses the Church building and school buildings. In addition to this parcel, the Church owns lots 10, ll, 13, 14 and 15 of Tract 3715 on Melvin Way and Red Hill Avenue. It is the intent of the Red Hill Lutheran Church to incorporate the lots adjoining their main facilities into their master plan of development for church and institutional use. A copy of the master plan is enclosed. The proposed zone change to the Public & Institutional District would therefore include all of these properties identified as under Church ownership. . Portions of the property included within the specific plan were zoned Multi-Family Residential for that section westerly of Yorba Drive, and Commercial (C-2) for the site of the Union Oil Station on the easterly side of Yorba southerly of 17th. The purpose of this application is to auth- orize the development of the properties on the westerly side of Yorba in conformance with the plans submitted for the Enderle Center. There have been no comments nor communications relative to the proposed change in zoning classification. The proposed zone change action would bring subject properties into conformance with the General Plan and the specific plan for the subject properties. ZONING STATUS' The Planning Community District regulations adopted for the Irvine-Tustin Industrial Complex require approval of a Use Permit for the location of truck terminals within the Irvine Industrial Complex. BACKGROUND' Sage Properties has submitted development plans for a 102,000- square-foot office and warehouse building and 975-square-foot detached building for office and equipment serving a fuel island, for the benefit of the Schick Moving and Storage Co. The ini- tial plans proposed by the developer included a public storage mini-warehouse facility. This proposal was rejected by the Irvine Company and modified to consist of a warehouse building and truck terminal. DISCUSSION' The staff has reviewed the plans and discussed them with the designer, proponent, and Irvine Company. Subject lot is the prime lot for exposure to the Irvine-Tustin Industrial Complex. It is at the entranceway to the tract on new Myford Road, with Santa Ana Freeway exposure, adjacent to the Dynachem building. It is the concern of the Irvine Company and City staff that the amenities of design for this structure create an impression that will favorably characterize remaining developments within Use Permit'77-13 Public Hearing No. 4 July 18, 1977 Page two the Irvine Industrial Complex. The proposed use makes it diffi- cult to create such an environment. The Santa Ana Freeway elevation is an acceptable architectural style. The remaining elevations, due to the nature of operations and truck storage warehouse requirements, detract from the site and require extensive landscaping in order to alleviate the starkness of the exposed warehouse doors and bleak tilt-up panels. There are also requirements related to off-site street improvements. The Fire Department will have specific requirements related to the sprinkler system and storage facilities when building plans are submitted for review and approval. The Community Development Department's concerns relate to poten- tial outside storage of packing boxes and crates, truck Storage, architectural relief of the building, traffic patterns, and landscaping. The developer of the center has indicated that the tenant's intent is far more extensive than that of a take-out sandwich shop. He intends to provide food service for the entire cli- entele of the Irvine-Tustin Industrial Complex. It is intended to have seating accommodations and a full service snack shop. As such, the proposal would have an adverse impact upon the industrial development. If permitted to advertise, provide on-site seating, and attract clientele from outside of the facility, there would be insufficient parking and create a nuisance for the adjoining tenants. Lot 16 of Tract 8763, located at Walnut and Franklin, was reserved for commercial use with the precise use as proposed by this application being authorized and encouraged under appro- priate development criteria. If retail commercial activities are permitted in the industrial buildings, it will not be possible to have commercial developments establish in the com- mercial area, due to more stringent parking requirements. As of the date of this report, no comments have been received from other departments. 1. The plans as submitted do not provide for the required loading area for drop-off and pick-up of children attend- ing the school. Unless the parking lot is redesigned to accommodate a loading and drop-off area, it is recom- mended that Sixth Street be used for that purpose and that a walkway from the building to the Sixth Street front- age be provided. If this were accomplished, it would be necessary to paint the curb to restrict parking on the south side of Sixth Street to loading zone designation. 2. It is proposed by the applicant that the freeway chain link fence would serve as a property line fence on the southerly side and a new 6'8" chain link fence would be installed on the northerly property line. There is a pro- posed wood treatment for the chain link fence and an alternative design for the east and north frontages of the property which would consist of alternative wood panels with 8' span wrought iron. If the chain link fence on the freeway frontage is retained with the wood battens attached, it would be necessary to receive the approval of CalTrans. It is suggested that, due to the noise of the site as well as potential hazards, the free- way exposure require a masonry wall and the removal of the chain link fencing. The proposed wrought iron and redwood battens for the north and easterly exposure is acceptable to the staff, if the Council determines that the use would have no adverse effect upon any adjoining devel- opments. In order for the parking lot to have adequate circulation, it will be necessary to have an on-site turning area unless a reciprocal drive easement is obtained for the adjoining Boys Club property. 4. BACKGROUND' The General Plan designation for the subject area indicates Pro- fessional office buildings. The most southerly portion of the total area, being some 309 feet northerly and adjacent to the single-family residential developments bounded by Yorba and the Newport Freeway, is proposed for the development of an office building complex. The proposal under consideration would change the land use designation for this parcel from Professional office to Commercial General to permit development of a charac- ter similar to the Cal-Va Dairy immediately north from the subject parcel. DISCUSSION' There are no development plans submitted for that portion of property subject to this General Plan Amendment. Prior to development it will be necessary to submit a rezoning application and a parcel map for the division of the properties. The Com- mercial General District would provide more flexibility of development than presently authorized under the Professional classification. Uses that would be appropriate for the site include: outdoor nursery sales, and activities of Iow traffic generation which require high volume traffic exposure. It would be essential, in connection with any rezoning application that may be submitted, for the development proposal to be reviewed for compatibility with the Enderle Center, as well as residential developments easterly of the subject site. Adverse factors related to the site are the Newport Freeway to the.west and General Plan Amendment 77-2(C). July 18, 1977 Page two Yorba Street to the east, providing a.depth of less than 135 feet at its southerly terminus and 64-foot depth of the lot at its northern terminus. RECOMMENDED ACTION: It is recommended that the Planning-Agency recommend to the City Council approval of the Land Use Amendment to provide for Commercial General development, by adoption of Resolution No. 1652, substantially as drafted, with the staff being directed to advertise a public hearing for the City Council at 3:00 p.m. on August 15, 1977. LOCATION: South side of Sixth Street easterly of "B" Street, known as the portion of Lot Y of Stafford and Tustin Tract (approximately 1 acre). BACKGROUND: The City Council directed that the subject property, presently designated as an athletic field in conjunction with the Tustin Boy's Club, be offered as surplus land for sale and development. A parcel map has been authorized for segregation of this portion of the property from the adjoining Boy's Club parcel. The property is adjoined on the easterly boundary by the Foster Arts Industrial Complex, classified as a Planned Industrial District, and bounded on the west side by the Boy's Club, in the Public and Institutional District. Property on the north side · of Sixth Street is in the R-1 Single-family District although developed at mixed densities, an'd the Santa Ana Freeway bounds the project on its southerly perimeter. The highest and best use for the property, in keeping with other properties within the vicinity, is for industrial use, comparable to the developments immediately adjacent to the subject parcel. The required processes are; amendment of the General Plan, a Zone Change action, Parcel Map preparation and approval, finding of property to be surplus to City needs, and solicitation of offers for the purchase of the property. CHAIR~N RECORDING SECRETARY TO THE PLANNING COMMISSION PUBLIC HEARING NO. 12 DATE: July 18, 1977 SUBJECT: ENVIRONMENTAL I~ACT REPORT (EIR 77-3) - A focused EIR for commercial portion of Packer Square. APPLICANT: Harry Kassebaum, 3848 Campus Drive, Newport Beach, CA. PROPOSAL: An EIR related to proposed development of a 40,400 square feet of retail commercial developments on 4.5 acres. LOCATION: The easterly side of Newport Avenue, southerly of Irvine Blvd. BACKGROUND: An EIR has been prepared for the total development of the 11 acres of land on the eastern side of Newport Avenue southerly of Irvine Boulevard and the Tustin Heights Shopping Center. The EIR encompasses a development proposal consisting of commercial, professional, resi- dential, and highrise residential. This action is subject to a General Plan Amendment and Zone Change related to the residential portion. A focused EIR has been submitted, based upon the EIR pre- pared for the total project, which related only to the commercial section of the proposed Packer Square Development and related to a Use Permit application for commercial development only. The under- lying proposal includes a 5,000 sq. ft. drive-thru bank, 5,000 sq. ft. restaurant, and 24,400 sq. ft. of shops with 6,000 sq. ft. of pro- fessional office space. Significant long range impacts of the proposed development relate to the noise and traffic impact upon the potential development of the remainder of the parcel proposed for residential units and the impact of traffic circulation upon the street system within the area. DISCUSS ION: The City Engineer's memo dated June 7, 1977, made the following evaluation of the proposal: 1. The proposed pedestrian walkway in the adjacent commercial development to the north is presently being used for a vehicular drive-thru cleaners. It appears there may be pedestrian-vehicle conflict in this area unless the facilities are segregated. ResPonse: The consultant's response identifies the need and desirability for the pedestrian walkway and suggests mitigating measures to minimize hazards such as well-lighted and marked cross- ways. He states further that a potential for accidents will still exist, despite the fact that the driveway to be crossed will be a Public Hearing No. 12 July 18, 1977 Page 2 one-way service road only with low traffic volumes. The question raised by the City Engineer related to pedestrian access through a drive-thru cleaners driveway has not been addressed ~by the consultant. 2.' The City Engineer states that the-plot plan shows parking for the commercial areas along the northerly side of the commercial buildings (29 stalls). This drive was described as a drive for service vehicles only, but the elevations in the appendices shows store fronts with access. The consultant responds that public entrances of the three buildings which back onto the service drive will be from the front and not from the service entrance side. However, deliveries and employees entrance will be from the rear of these shops with a total of 32'employee parking spaces proposed for the area immediately behind the two northern most shop buildings adjacent to the service road. It is the City Engineer's opinion that both the elevations and convenience of parking at this site will foster the use of the service road as an entrance way into the shops by the public. 3. The City Engineer raises a question pertaining to the alignment of the Orange County bike trail along the AT&SF right-of-way. The consultant responds that it is his understanding that the bike trail would follow the E1 Modena-Irvine Flood Control Channel since no provisions have been made for a bike trail thru Packer Square. As of this date we have not received a report from the Orange County Environmental Management Agency related to the proPosed bike trail alignment. 4. The statement of extending the center median on Newport Avenue to restrict left egress from the site is not practical. The motorists would utilize any open area near their intended movement to make a left turn from Newport Avenue. The only practical way to prohibit left turn egress is to restrict all cross street movement by con- structing a raised median. The consultant's response states that to deny left turn access into the site at the center driveway would mean that all ingress from Newport Avenue would have to be right- turn only. In their estimation, this could adversely effect the economic viability of the retail outlets and could potentially cause congestion elsewhere. 5. The proposed installation of a stop sign at the northeast corner of Builder's Emp~um property in the opinion of the City Engineer, may not be a solution to the problem that would be created. The consultant acknowledges that enforcement could be a problem and suggests that ~other solutions may be available. Public Hearing No. 12 July 18, 1977 Page 3 To Appendix 1 of the master EIR Traffic Impact Analysis, the City Engineer has taken exception to the circulation pattern for the proposed development. Some comments relate to the total development while others relate solely to the commercial development. The responses of the consultant's Traffic Engineer to the concerns of the City Engineer have not been satisfactory. It's believed that there are distinctive problems related to traffic circulation both for the commercial development and the total site. It is further suggested that mitigating measures proposed have not alleviated the adverse impacts upon traffic circulation. There has not been an opportunity for the City Engineer and the consultant's Traffic Engineer to fully discuss the proposed circulation plan and mitigating measures. Prior to certification of EIR, it is suggested that these matters should be fully addressed and brought to the attention of the Planning Agency for resolution. RECOMMENDED ACTION: It is recommended that the Planning Agency continue as an open public hearing EIR 77-3 until August 1, 1977, for further public comment and resolution of conflicts and mitigating measures related to traffic circulation. BACKGROUND' Comments relative to previously considered EIR 77-3 are appli- cable to this proposed project. Concerns relate primarily to traffic circulation. Concerns of the Community Development Department related to the proposed commercial development pertain to the northeasterly property line and drive access. There is no physical separation between the two properties and the service entrance appears to be the most pronounced of all accessways to the center. It would also be a primary access road to the resi- dential developments that are programmed for the southeasterly portion of the site. A negative impact would be created unless there were preimeter walls or landscaping, or alternatively incorporating the common service entrances to serve the two adjoining properties. As such, it would be inappropriate to have the parking located along the service road, and to the degree possible this alleyway or service road should be screened from public view. The proposed land use is appropriate to the site and would be compatible with other uses within the vicinity. Staff would recommend approval of the Use Permit upon modification of the circulation pattern to the satisfaction of the City Engineer, and accommodation of the aesthetics of the site as related to adjoining properties. This final map lies northwesterly of Medford Avenue and Carroll Way, and easterly of the Newport Freeway. The original tentative map as approved by the Planning Commis- sion and the City Council contained 30 single family R-1 lots. With the precise calculation and plotting of the final map, one additional lot has been added to the development. This addi- tional lot was made possible by the adjustment of lot lines along the westerly edge of the development. It is felt that this additional lot does not substantially vary from the tenta- tive map as long as all lot areas and frontages meet the minimum City requirements. Ail subdivision bonds and agreements have been executed by the developer and returned to the City for its execution. Street improvement plans have been submitted and are ready for approval by the City Engineer except for Condition "E" of Planning Commis- sion Resolution No. 1608. This condition is being reviewed by the Tustin Water Works and can be resolved at a later date.
