A regular meeting of the City of Tustin Planning Agency
was held on the 3rd day of October, 1977, at 3:00 p.m.,
and 7:30 p.m., in the City Council Chambers, Centennial
Way at Main Street, Tustin, California.

PUBLIC HEARINGS 1. Amendment to Use Permit 76-14 - (Courtyard)
Allstate Savings for authorization to construct
and operate a drive-up teller facility located at
18323 Irvine Boulevard in the Courtyard Shopping
Center.
After the presentation of the staff report by Mr. Chase,
the public portion of the hearing was opened at 3:10 p.m.
There being no comments or objections the hearing was
declared closed at 3:11 p.m.
Moved by Edgar, seconded by Welsh, to approve the
amendment to Use Permit 76-14 by the adoption of
Resolution No. 1684. Carried: 4-4).
2. Use Permit 77-29 - USA Sandwich Shop for authorization
to operate take-out sandwich and salad shop within the
Stewart multi-tenant industrial co~p~lex located at the
southeasterly corner of Franklin and Walnut Avenues.
After presentation of the staff re/~'rt by Mr. Chase, the
public portion of the hearing was ~ened at 3:14 p.m.
There being no comments or objecti~z~s the hearing was
closed at 3:15 p.m. (Mr. Schuster,arrived at this time.)

by the adoption of Resolution No. 1685. Carried: 5-0.

STAFF CONCERNS
1. Mr. Chase presented the median island plan for
Newport Avenue. After some discussion among the Agency
members concerning the stamped concrete, the color
planting in the arms of the island and the dichondra,
it was moved by Saltarelli, seconded by Welsh, that
the Planning Agency is in accord with the design standard

as presented to the City. Carried: 5-0.
2. Mr. Chase presented the Agency with the new revised
zoning maps and introduced Darrell Stall, the new draftsman
who had prepared them.
3. Mr. Chase presented the new,p dated vacant land use
summary which was prepared by Mr. Eugene Snyder, Public
Services Assistant, Community Development Department.
4. Mr. Chase informed the Agency ~f a proposed Senior
Citizens Project for the corner of Sixth and E1 Camino
Real to be comprised of 100 units.
5. Signing for the Clifton Miller Community Center. Mr.
Chase presented an alternative ma~ial of styrene for
the proposed signing for this cen~t~. Mr. Chase explained
that the material is not as durabt~as the initially pro-
posed anodized aluminum. After s~me discussion it was
moved by Edgar, seconded by Welsh, ~o purchase the signing
made out of anodized aluminum. C~ed: 5-0.

Mr. Chase presentedthe staff report and ~onditions approving
the Use Permit.' A conceptual plan for the entire project
was presented to include Senior Citizen Housing on the
rear portion of the project.
After some discussion pertaining to the entire project it
was moved by Edgar, seconded by Schuster, to approve Use
Permit 77-16 by the adoption of Resolution No. 1656.
Mr. Saltarelli suggested that the parking as shown may not
be adequate for the senior citizen housing and one of the
open space areas should be set aside to provide extra
Parking if needed at a later date.
In response to Mr. Welsh's question pertaining to financing,
Mr. Harry Kassebaum, applicant, stated that they have
looked into the financing of thesenior citizens project and
it looks like a feasible project.
The above mot ion was carried unanimOusly.
Moved by Welsh, seconded by Edgar to adjourn to a City
Council meeting at 7:50 p.m. Carried unanimously.

REQUEST:
'BACKGROUND
A Use Permit to authorize the establishment and operation
of a dance studio with an average class enrollment of eight
to ten studehts.
This property was formerly the site of the Tustin Branch of the Orange
County Library and was annexed into the City on May 5, 1977, as part
of Annexation No. 81 (amended) C. The applicant desires to loca{e
her dance studio in part of the old library building along with the
existing Sand Box Superstars pre-school. The zQning of this property
is Commercial General (CG) and surrounded by residential on the east
and commercial on the other perimeters.
The subject application is determined to be categorically exempt from
the requirements of an Environmental Impact Report as a Class I
exemption (existing facility).
The application was circulated to the various City departments for review
and. no adverse comments were received.

There are 11 parking spaces provided for the entire site which according
to commercial standards is inadequate. This concern can be alleviated
by the designation of a loading area on the Andrews Street frontage which
would permit a place for temporary parking where childreh could be
picked up or dropped off.
RECOMMENDED ACTION
It is recommended that the Planning Agency approve Use Permit 77-30
by the adoption of Resolution No. 1687, with the condition that the
striping and signing cost of the pick-up area be borne by the property
owner.

RESOLUTION NO. 1686
A RESOLUTION OF THE PLANNING AGENCY OF THE CITY OF
TUSTIN GRANTING A USE PERMIT ON APPLICATION NO. U.P.
77-30, OF KAREN MULLIN.
' The Planning Agency of the City of Tustin does hereby
resolve as follows:
1. The Planning Agency finds and determines as
follows:
a. That a proper application U.P. 77-30 was filed on
behalf of Karen Mullin for a Use Permit to allow
the establishment and operation of a dance studio
with an average class enrollment of ten students for
the property located at 13682 Newport Avenue.
b. That a public hearing was duly called, noticed and
held on said application.

That establishment, maintenance and operation of the
use applied for will not, under the circumstances of
this case, be detrimental to the health, safety, morals,
comfort or general welfare of the persons residing or
working in the neighborhood of such proPOsed use,
evidenced by the following findings:
(1) That a dance studio will provide a cultural
facility for the community.
(2) That this is an appropriate use for this particular
site which is located in a commercial district.
(3) That the subject use is in conformance to the Tustin
General Plan.
That the establishment, maintenance and operation
of the use applied for will not be injurious or detrimental
to the property and improvements in the neighborhood of
the subject property and improvements in the neighborhood
of the subject property, nor to the general welfare of
the City of Tustin, and should be granted.
e. Proposed development shall be in accordance with the
Zoning Ordinance and the development policies adopted
by the City Council, Uniform Building Codes as administered
by the Building Official, Fire Code as administered by
Fire Chief, and street improvement requirements as
administered by the City Engineer.
That this request is categorically exempt from the
requirement of an Environmental Impact Report as a
Class I Exemption (Existing Facility).

The Planning Agencyhereby grants a Use Permit, as applied for,
to allow the establishment and operation of a dance studio
with an average class enrollment of 10 students subject to
the following conditions:
a. That signing for this use be submitted for staff review
and approval in conformance with the Sign Code Ordinance
No. 684.

b. That a loading area be striped and signed on Andrews
Street with the cost borne by the owner of the property.

PROPOSAL:
Remodel existing fast food facility to include drive-thru
service.
BACKGROUND AND DISCUSSION
Mr. Gordon Gray, operator of the Mc Donald's Restaurant on First Street
is requesting authorization to remodel the existing facility to include
drive-thru service facility, additional signing and inside seat remodeling.
The plans call for the construction of 750 sq. feet. additional dining
area, the installation of a 8'-6" drive-thru lane and pick-up window,
the elimination of 22 parking spaces, and the m6dification of the
existing signing.
Previous public hearings involving this development include:
Zone Change 68-185 authorized the C-2 (General Commercial) classification
on the subject property.
Use Permit 68-274 authorized construction of the Mc Donald's Restaurant.
Variance 68-225 authorized the operation of the Mc Donald's Restaurant
to vary with the sign ordinance and install 356 sq. ft. of signing.
The application was circulated to the various .City departments with the
following comments received:
FIRE
1. Occupancy classification will be B3 and will be ·required to meet
exit requirement for such.
ENGINEERING
The initial site plan was reviewed on August 11, 1977, and subsequently
discussed with the applicants. The following are remaining items of
concern:
The existing sign as located by the most easterly drive may be
better located adjacent to the middle drive which is designated
as the "drive-thru entrance".
2. The access to the site from the 20' easement to Prospect Avenue

should be signed to'reduce the one way traffic conflicts at the
northwesterly corner of the site.
3. If the project is approved, it appears that there may be an
increase in vehicular traffic both in and out of the site with
respect to First Street. The existing median island configu-
ration on First Street is not a good engineering design for the
left turn movements from First Street to the middle driveway at
Mc Donald's restaurant. In addition there is some left turn
movemen~ from the most westerly drive of the site to eastbound
~t' Street Which i's~ an illegal movement.
It is the Engineering staff's recommendation that the median island be
~dified as shown in red on the attached drawing to provide a protected
left turn pocket to the middle driveway of Mc Donald's and to extend the
barrier which will help prevent left turn movements from the westerly
driveway. This work is estimated to be approximately $3500.00 and the
cost should be the entire responsibility of the City.
PLANNING
1. A continuous concrete curb should be provided along the west of the
· six (6) parking stalls near the center of the parking area. This
will stop motorists from driving against one way traffic. Protective
planters should be provided at each end of these six (6) spaces.
2. The planter adjacent to parking stall No. 8 should be extended
to the side of stall No. 7 with a "do not enter" sign directed at
the one way drive aisle next to the building.
3. Landscaping requirements for a development of this size are:

The roof light beams are not installed on the present roof
structure as indicated on Sheet No. 2. The placement of
flourescent lighting on a tile roof is not in keeping with the
style of architectural standard prevalent in Tustin and should
not be authorized.
The new location of the "Mc Donald's" sign on the mansard roof is
not authorized in the Sign Code. The sign should be placed on the
roof facia as it is presently installed. The "drive-thru service"
sign to be attached to the existing pole sign measures 15.7 sq. ft.
If approved, the cabinet should be moved up to the base of the
existing cabinet to read as one sign. Previous Planning Commission
actions have not accepted additions to existing'signs which tend
to look like separate add on signing. In conjunction, the pole
sign structure should be fitted with an attractive pole cover.
Menu signing is also proposed for the rear of the structure to
which the staff does not take exception in that is is a necessary
part of the drive-thru concept, visible only to customers.

resolve as follows:

That a proper application, Use Permit 77-31, was
filed on behalf of Gordon Gray for a Use Permit
to authorize the remodeling of the existing
facility to include remodeling of the drive-thru
service facility, additional signing and inside
seat, remodeling, for the property located at
245 East First Street.
That a public hearing was duly called, noticed

of the use applied for will not, under the cir-
cumstances of this case, be detrimental to the
health, safety, morals,, comfort or general

The sign cabinet which advertises "Drive-Thru
Service" shall be installed flush to the bottom
of the existing identification pole sign. A
decorative pole cover shall be added to the
pole sign structure.
The installation of fluorescent light fixture
along the top of the mansard roof is not auth-
orized for the improvements of the building.
The "McDonald's" wall sign shall be placed on
the roof facia line as it is presently installed
on the existing building.
That final development plans be submitted for
staff review and approval to include plot, ele-
vations, landscaping, irrigation, lighting, and
signing plans.'
