Use Permit 78-10 - An application submitted by Donald Robbins on behalf of the Mobil Oil Corporation, requesting authorization to operate a snack shop with beverages totally within the existing office of the service station. The existing station is part full-serve and part self-serve and will be changed completely to self-serve. The existing pole sign will also be modified to reflect the self-serve change. I. CALL TO ORDER The meeting was called to order at 3:00 PM by Chairman Welsh. II. PLEDGE OF ALLEGIANCE Led by Mrs. Kennedy. III. INVOCATION Given by Mr. Saltarelli IV. APPROVAL OF MINUTES Moved by Mr. Saltarelli,~ seconded by Mr. Schuster, that the minutes of the meeting of April 17, 1978 by approved. Carried unanimously. VI. PUBLIC HEARINGS 1. Use Permit 78-8 - An application submitted by Thrifty Oil Company requesting authorization to construct and operate a new Self--serve gasoline facility and building, and demolish the existing facility. The location of this project is 14121 Newport Avenue. After the presentation of the report by Mr. Chase, the public hearing was opened at 3:10 PM. Mr. Martin ~aldo of 10197 Stilbite Avenue, Fountain Valley, addressed the Agency on behalf of Thrifty Oil. He expressed his concerns regarding the driveways and the proposed monument sign. Staff was concerned that a monument sign would block the visibility of motorists and pedestrians, and therefor cause a traffic hazard. Staff agreed to look into the driveway widths, and also suggested that a pole sign be used rather than the proposed monument sign. The public hearing was closed at 3:21 PM. Moved by .Mr. Saltarelli to approve Resolution No. 1743 with revisions, giving staff sufficient discretion to accept and modify the driveway widths and to provide a sign acceptable to both staff and applicant; seconded by Mr. Schuster. Ayes: Saltarelli, Schuster, Kennedy, Abstained: Welsh, Absent: Sharp 2. Pre-Zone 78-4 - An action initiated by the Planning Agency to Pre-zone the properties on the east and west sides of "B" Street, southerly of the Santa Ana Freeway, from the Orange County R-4 district to the City of Tustin R-3 district, upon annexation to the City. Members of the Agency were concerned with the fac% they had no back-up information on any of the pre-zones. Mr. Chase extended his apologies for not having including this information with the reports, but noted they do have the information, and it would be provided at the next public hearing before Council. -1- ~Lrs. Kennedy moved that all by continued until this information pre-zones could be reviewed. Chairman Welsh stated that each pre-zone had to go through a separate public hearing. The public hearing was opened at 3:27 PM. There being no comments or objections, the public hearing was closed at 3:27 PM. Moved by Mr. Schuster that the Agency take public testimony and continue the action as an open public hearing to the next Agency meeting on May 15, 1978; seconded by Mrs. Kennedy. Carried unanimously. 3. Pre-Zone 78-5 - An action initiated by the Planning Agency to pre-zone the Montesilla Mobile Park fromthe Orange County R-4 to the City of Tustin Mobile-Home Park (MHP) classification, effective upon annexation to the City of Tustin. -The Montesilla Mobile Park is located at 15601 South "B" Street. Mrs. Kennedy expressed her concern about not having any material to review before the hearing on the pre-zone. It was indicated that the change is simply to recognize what has previously taken place, mainly construction, and that our zoning of MHP is more stringent than the County R-4 zoning. The public hearing was opened at 3:32 PM. There being no comments or objections, the hearing was closed at 3:32 PM. ~oved by Mr. Schuster to direct staff to prepare a resolution of approval,~ seconded by Mr. Saltarelli. Pre-Zone 78-6 --An application initiated by Steve Justus on behalf of Construction Investments to pre-zone 15732-15742 South "B" Street from the Orange County R-4 District to the City of Tustin Planned Development (PD) District. Mr. Chase gave a short summary of the pre-zone application, commenting that the City of Tustin's Planned Development District is more stringent than the County R-4 district. The public hearing was opened at 3:35 PM. There being no comments or objections, the hearing.was closed at 3:35 PM. M~ved by. Mr. Saltarelli to direct staff to prepare a resolution of approval seconded by Mr. Schuster. Carried: Ayes: Schuster, Saltarelli, Welsh NOes: Kennedy, Absent: Sharp 5. Moved by Mrs. Kennedy to continue this matter until the next meeting on May 15 in order to compile and review the back up information. Motion died for lack of second. Mr. Saltarelli moved t© continue until the next meeting and direct staff to prepare a resolution for approval that will bring Pre-Zone' 78-13 into conformance with the General Plan, specifying the proper zoning classification; seconded by Mr. Schuster. Carried unanimously. 6. Pre-Zone 78-15 - An action initiated by the Planning Agency to pre-zone the property known as Whispering Woods Apartments and the Tahitian Terrace Apartments located at the northwesterly corner of Red Hill and Walnut Avenues from the Orange County R-4 to the City of Tustin R-3 district, effective upon annexation to the City of Tustin. -2- There was a brief discussion regarding future development of the property, and Mr. Chase commented that these two apartment complexes were already in agreement with our density requirements and no other units could be added. The public hearing was opened at 3:53 PM. There being no comments or objections, the hearing was closed at 3:53 PM. Moved by Mr. Saltarelli to direct staff to prepare resolution of approval, seconded by Mr. Schuster. Carried unanimously. 7. Pre-Zone 78-16 - An action initiated by the Planning Agency to prezone the property known as Sycamore Gardens which borders on Newport Avenue and Sycamore Avenue, from the Orange County R-4 to the City of Tustin R-3 district, effective upon annexation to the City. Mr. Ross Edgell, 12345 Euclid St., Garden Grove, attorney for Mrs. Helen Crider, addressed the Planning Agency on behalf of Mrs. Crider. Mrs. Crider's main concern is trash collecting between the one foot gap between the fences. Mr. Jack Davis, 1345 No. Grand Ave., Santa Ana, spoke on behalf of Investors Development and stated this problem could be alleviated by eliminating the one foot gap and moving his wall up to Mrs. Crider's fence. (Mr. Sharp arrived at the meeting 4:05 PM). Moved-by Mr. Saltarelli to recommend approval to City Council of Final Parcel Map Nos. 78-105, 78-106, 78-107, 78-108, and 78-109 by the adoption of Resolution No. 1739, seconded by Mr. Schuster. Tentative Tract Map No. 10281, Jansvu Properties, Inc. Location: Between First and Second Streets Mr. Chase presented the staff report to the Agency. Final Parcel Map 77-104, Ro~ Chikasawa, Location: Southeasterly corner of Walnut and Newport Avenues. After Mr. Chase presented the report, Mrs. Kennedy asked if the property was being separated with the intent to be sold. Mr. Chase stated the reason was for financial purposes, that it may eventually be sold, but it would have to meet City requirements and come up again before the Agency. -3- Moved by Mr. saltarelli to recommend approval to City Council of Final Parcel Map 77-104 by the adoption of Resolution No. 1742, seconded by Mrs. Kennedy. Chase Community Development Director TO THE PLA NNING COM MISS ION PUBLIC HEARING NO. 2 DATE: May 15, 1978 SUBJECT: Variance 78-4 LOCATION: 18331 Irvine Boulevard (at Plaza Drive) APPLICANT .- PROPOSAL: George Metsovas Request for authorization to vary with the setback requirements of Tustin Plaza Development Standards. BACKGROUND AND DISCUSSION On January 7, 1974, the Tustin City Council approved the Tustin Plaza Development Standards for Specific Plan No. 4 by the adoption of Ordinance No. 606. A provision of the standards was that a 10' building setback be maintained from interior driveway~. The plan as submitted, provides 0' setback from an existing driveway along the east property line. The application was reviewed by the'various city departments, with the following comments received: Engineering. The most southerly driveway on Plaza Drive as shown will be limited to right turn ingress and egress only due to the median island existing within the street. The driveway including any part of the X-section should not encroach within any part of the curb return radius. The developer of this lot will be eligible for reimbursement for an amount equivalent the 5 foot wide sidewalk adjacent to Plaza Drive frontage of Lot No. 1 at the rate of $0.95 per square foot. The developer however, will be required to construct the total-width (10') sidewalk adjacent to Plaza Drive. Planning 2e Due to the character of the development as mandated by the Specific Plan, staff believes the complex should be developed to professional standards, regardless of use, therefore the side yard setback on the interior property line should not be less than five (5) feet. The eleven (11) foot setback variation along Plaza Drive would be consistent with other professional projects. Staff has serious concerns.over the rear and right side architectural elevations. These sides do not exhibit the same architectural features (mansards and brick pilasters) as does the front, and yet the rear and east elevation will be visible from neighboring office complexes. Report to Planning Agency Page Two May 15, 1978 It is strongly suggested that the staff be directed to work with the developer to ensure that the side and rear elevation be improved to avoid any negative impact views from the neighboring developments. 3e Se The lack of a rear loading area is also of concern. If the rear parking spaces were occupied, delivery vehicles would then have to stop and be unloaded from the 25' common drive aisle. Based upon preliminary submittals, this drive aisle will be the only means of ingress and egress from the development to the north, also it is a secondary route from the Beverly Hill Savings development~ A striped loading zone, sufficient in size for one delivery vehicles should be provided in addition to the required parking spaces. The parking requirements for a retail commercial project of this size is 32 spaces. The proposal is two spaces short of required minimum. As a result one of the tenant stores will have to be reserved solely for professional office use or additional parking allocations be provided on the site. If the structure is reduced by 330~ by providing 5' side yard setback as stated in paragraph #1, the parking accommodations are adequate. Landscaping requirements in addition to turf Along the street frontage planters are: 6 - 24" box 25 - 15 gal. e Signing for the center is limited to professional standards. The Beverly Hills Saving development was authorized by a Use Permit, 32 sq. ft. of free standing identify and 25 sq. ft. front and rear wall signing. It is suggested that staff be. authorized to grant similar signing to the proposed shopping center (1 - 32 sq. ft. free standing sign, and 25 sq. ft. front and rear signs per tenant). RECOMMENDED ACTION It is recommended the the Planning Agency approve Variance 78-4 by the adoption of Resolution No. 1754 substantially as drafted. The Planning Agency of the City of Tustin does hereby resolve as follows: 1. The Planning Agency finds and determines as follows: That a proper application for Variance No. 78-4 was filed on behalf of George Metsovas for a variance to permit a five (5) foot setback from the property line and drive aisle in lieu of a ten (10) foot setback as required by the Tustin Plaza Development Standards. CHAIRMAN RECORDING SECRETARY dpj: 5/11/78 THE PLANNING COM MISS ION PUBLIC HEARING NO. 3 DATE: SUBJECT: LOCAT ION: May 15, 1978 Pre-Zone 78-4 Change from Orange County R-4 to City of Tustin R-3-2000 Nisson and "B" Street, south of Santa Ana Freeway BACKGROUND The proposed prezoning involves an area of thirty single family homes, a 24-unit apartment complex (1/2650 sq. ft.) a 9-unit apartment complex (1/1200 sq. ft.), a 12-unit apartment complex (1/1435 sq. ft.) and a small rest home, a small storage and office structure and one 32-unit apartment complex (1/3222 sq. ft.) divided over three parcels. The single family residences are divided between two main groups of lot sizes, most are either 5000 sq. ft. or in ~e area of 17,200 sq. ft. The majority of the single family structures are rentals with absentee landlords. Man~ of the structures are below Housing Code standards and are in need of repair. The area on the whole is substandard and lacks many basic capital improvements. DISCUSSION The Tustin 'General Plan designates this area for Medium Density-Residential Multi-family uses. By applying the R-3-2000 zoning designation, the City would be encouraging a redevelopment of this area in conformance with the Tustin General Plan. Three of the existing apartment complexes have been built to a higher density than the County should have allowed or the City will allow. The apartments existing at a lower density (3222 ~ vs. 2000 ~) are in need of repair and hopefully would someday be removed for a redevelopment of the land. Current zoning and building code requirements of the City would not allow additional units to be added to the existing complex. RECOMMENDED ACTION In order to encourage redevelopment and bring this property into conformance with the Tustin General Plan, it is recommended that the Agency approve Pre-Zone 78-4 by adoption of Resolution No. 1747. The area consists of twenty duplex units for a total of forty dwelling units. The current zoning in the County is R-4 which allows no more than one unit per 3,000 sq. ft. Most of these properties range from 3,600 sq. ft. to 4,100 sq. ft. per unit. The City of Tustin R-2 zone calls for 3,500 sq. ft. per unit. DISCUSSION The Tustin General Plan designates this area for Low density residential uses of which R-2 is included. In order to avoid the payment of excessive severance damages, the City bought the entire parcel and at this time is ready to sell the excess land not required for street purposes. This parcel (3690 square feet) was purchase at the cost of $7500.00. The remain- ing parcel, which is to be offered for sale will be 90 feet in length by 30 feet of depth and will contain 2700 square feet. The minimum bid price for this parcel should be $2.03 per square foot or $5500.00. This was the value p~aced on the property by our consultant appraisers in September, 1977.- Attached is a legal description and sketch of the excess land proposed for sale. Please prepare the necessary documents required for the City to sell this land.
