There is a typographic error in the staff report regarding the above -referenced item. The
reference to the increase in Part 1 Crimes after implementation of Proposition 47 should
state that there were 2,401 Part 1 Crimes reported, not 2,041. With that correction, the
first full paragraph on the third page of the staff report will read as follows:
"In the three years prior to the implementation of Proposition 47 (from 2012-2014),
Tustin averaged 2,079 Part 1 Crimes reported per year. In the three years after
implementation of Proposition 47 (during which many criminal sentences were
reduced from felonies to misdemeanors) (2015-2017) Tustin averaged 2,401 Part
1 Crimes reported each year, reflecting a 15.5% increase in Part 1 Crimes reported
since the implementation of Proposition 47."

Re: Item 17 — Second Reading of the Tustin Inclusionary Zoning — Oppose
Dear Mayor Murray,
On behalf of the Building Industry Association of Orange County, I write to oppose Item
17: The Inclusionary Zoning Housing Tax. As you recall from all prior hearings, the
Business and Development Community stand together in opposition to this taxation on
housing, regardless of its moniker.
Since the first hearing in February, we have outlined how this proposal is self-defeating.
Inclusionary Zoning increases the cost of housing with a disproportionately small benefit
to a select handful of individuals. As a City Government, it is incumbent upon you to
serve the best interests of the entire community at -large. This ordinance will not help
increase housing supply and as such, will not serve to achieve your desired outcome.
Further, there was a time in this process where the BIA had nearly reached an agreement
with the City. In contrast to that time, the current language creates a complicated process
that will only further entangle government regulation into the development of new
homes.
Finally, the City asked for alternatives and the BIA provided them. Case -in -point, the
City of Anaheim worked with homebuilders, hosted roundtable discussions and created
a comprehensive, incentive -based approach to affordable home development, moving
away from governmental intervention into the private market. There is no reason Tustin
couldn't follow suit and we are happy to work with you to achieve this.
Again, we ask for a NO vote on Inclusionary Zoning. This is not the path forward for
Tustin.

Dear Tustin City Council Members,
I am a long-time resident of Tustin and serve as the deacon at St. Paul's Episcopal Church in
Tustin. I understand that you are considering an opt out of the California Values Act (S1354). I know
that this is an emotional issue and that you are facing a difficult decision.
As a member of the clergy who is deeply involved in issues around immigration, I urge you to
consider maintaining
the
current status provided by S1354.
The fear among documented and undocumented immigrants has grown exponentially over the last
year. Residents who have been in this country for many years and have raised families here are
being picked up and detained, sometimes for months. Families are experiencing long term trauma
and a loss of income. I have been in the detention centers and know of their suffering.
Understandably, fear is at a heightened level now. I hear story after story of immigrants who are
afraid to go out of their homes or take the bus to work. The people in question are our neighbors.
That is the compassion side of the debate.
I believe that there is also a practical side that is important for public safety. Opting out of the SB54
would mean that our local law enforcement would be required to work ICE. I can assure you that
immigrant families and individuals will think twice about contacting police over safety issues or when
witnessing a crime. We have a fine police force in Tustin. They do their job well. I believed that it is
important for the safety of everyone that they are able to continue the good work that they do.
I have attached two documents which briefly outline SB54 and a letter to the governor and legislators
signed by law professors throughout the country who support the law.
I pray that you will consider keeping S1354.

Dear Mayor Murray,
I have met you in passing over the years(at fundraisers and philanthropic events as well as when my husband
was honored at the Chamber of Commerce). You have always been kind and receptive to people; this is
appreciated.
I love Tustin. I gave a short testimony at the last council meeting about my connection to this community. I was
shocked when I found out Tustin has made a statement opposing the California Values Act, especially when I
know this community so well. I know it was not formalized, but when it was put on the agenda for Tuesday's
meeting, I had hoped, especially with the law suit Jeff Sessions had filed was thrown out, that Tustin would not
involve itself with this opposition that often times is hate driven.
I myself, upon leaving the meeting, was harassed by the opposition to SB54. I am a white, pregnant legal citizen,
and it only made me more sensitive to the implications of our city formally opposing SB54; it truly may only
feed the hate and fear of anti -immigrant and "other' sentiment.
I plead with you, on behalf of my family, my community, my faith, and as a leader of the Tustin Coalition for
Compassion, please reconsider your stance on SB54. This is a chance to stand on the side of compassion, of
understanding, of sound policy, and in opposition to fear -mongering. At the least, consider the fiscal
implications if Tustin is sued like Los Alamitos. I think we could both agree we have such better things to focus
on in this great community.

Dear Tustin City Council members,
I am a longtime resident of Tustin. My children have all been through TUSD schools, and are all in the 20s
now.
I would like to express my heartfelt support for S1354.
I hope that the elected officials in Tustin also share the belief that immigrants are welcome here. They pay
taxes, build their families, and seek a better life than they could expect to have in their countries of origin. We
should not be punishing them.
There is a need to create a path to citizenship for many immigrants here illegally. But, punishing them and
allowing ICE to run over our own PD is not the answer. We must hold our elected officials accountable. We
expect all of you to follow the states mandate and NOT seek to join the lawsuit some other cities have.
Please do what is just and right. We are watching. We will be at the upcoming meeting to support your
decision to continue to support S1354.

As a Tustin homeowner and voter, I respectfully request the removal from next week's agenda any discussion or
vote on S1354, the California Values Act. Please do not give in to the bullying from hateful outside agitators. We
are a beautiful and diverse city—that is a large part of why I live here. Voting not to support S1354—even though
it is the law in California—will send a message to our immigrant community that Tustin is not an inclusive and
welcoming community. Is that really the message you want to send to the majority of our city's residents?
We are better than this. Tustin is better than this. Please remove this item from consideration—or if it must
come before the council, tell the haters to go home and then vote no on this misguided resolution.

I am writing as a business owner, resident, church attendee and member of the community of Tustin. First and
foremost, I want you to know that I love the city of Tustin and am so grateful for the support and friendships I have
made here.
My wife and I currently own 5 businesses within the city, (The Lost Bean -Newport Blvd, The Lost Vine, Christakis Greek
Cuisine, The Lost Bean -Flight at The Tustin Legacy (opening December 2018) The Little Greek- Flight at The Tustin Legacy
(opening December 2018) and have children that will attend school here.
While I appreciate the support of everyone in Tustin, I feel so strongly about Tustin remaining a city of compassion and
supporting SB 54 that I could not in good conscience choose to open my next planned venture (The Lost Collective) in
Tustin if the council chooses to withdraw our city's support for sanctuary, compassion and hope for all members of our
community.
Voting to opt out of SB 54 would send such a negative message about who we are in this city that it would be hard for
myself and I fear for likeminded entrepreneurs to continue to put down roots.
I have included the summary page for the next business project that I hope finds a home in the compassionate, caring,
open city of Tustin.

Can we not act with compassion when it comes to one another?
I support S1354. Let us not put the Tustin Police Department in charge of assisting ICE.
I am extremely distressed by the tenor of recent meetings of the outside agitators. We can
and should do better than the current situation in regards to detaining immigrants.

Dear Mayor and Council Members,
I write again this morning urging and praying you all have a change of heart and mind and choose to not
withdraw from state support of the California Values Act, SB54. Orange County(and now Tustin) has been
deliberately chosen to make a statement that we, like some others in our country currently, don't have a place
for immigrants, be them legal or not. We are a kind city, we are a good city, we are a unique community that
people choose to raise their family and start their business in. We are not a city that should be an example of
outing the other.
I write one last time today wearing multiple hats, and hoping to show you the many perspectives of why I hope
you all choose to vote in Support(or at the very least abstain) SB54 this coming Tuesday.
I support SB54 as a
-parent. My children attend preschool here in Tustin. I want them to continue to be a part of community that
does not perpetuate fear or hate or anxiety for the marginalized. I want them to be proud this is where they
are from. Currently we pay for preschool in the city, and I myself am a graduate of all public schools here as well
as UCLA, and I believe in the public school institution. I hope to continue to support TUSD with their future
attendance and by supporting as a local business who donates when we asked.
-friend. I know many people who came to this country to flee persecution and hardships from their homeland.
No one wants to come here illegally. I know people who are opposed to sanctuary yet have a nanny, house
cleaner, gardener, employee, friend, neighbor who would be a potential victim if you all choose to opt out of
SB54. I cannot I'm good heart and faith indifferent to this.
-a person of faith. I was raised in a very ethically diverse Catholic Church down the street. I remember the ICE
raids of the 80s, and the attrition and strife that occurred. Kind, good people were deported and separated
from their family, their only local crime being that they were seeking a day job on the corner of Chapman and
Hewes. I understand the complexity of federal law, but I do not think community needs to step into the shoes
of ICE. I also took the Matthew 25 pledge 2 years ago and I believe as a Christian it is my duty to stand with the
oppressed and marginalized. Not in rhetoric alone, but in civic engagement. My current church of the past ten
years, Trinity United, is not diverse like what I was raised in. But my roots of social justice in Christ are firm.
-daughter of an immigrant. My mother loved her adopted homeland and instilled a love and respect in her
children. She was fortunate to be legal, but her accent early on, and her push to assimilate gave her an empathy
for other newcomers that she shared with her children.
-business owner. Together my family owns 5 businesses in Tustin. We have collectively for over 35 years. I'm
proud to have a business here, and I intentionally do my best to shop and eat locally. When I heard the decision
that Los Alamitos made my husband and I looked at each other and said we would not do any commerce in that
city. We would never in good faith send a friend or employee to that city to do business. If anyone would fear
being ticketed and then possibly deported, then we too have no right to be there.
-fellow human citizen. I know I am privileged. Although I grew up with many hardships, I am a Caucasian,
Christian, heterosexual, formally educated women. I have full access to programs, loans, society. I have
traveled the world freely and without fear. I have security that not everyone knows. I believe we cannot be
privileged and not serve or stand up for those who are less so. If I am not the bridge, who can I expect to be? I
have read about the anxiety levels that have risen for children of illegal immigrants over the past couple years.
People afraid to sign up for school programs, for health benefits, because they fear they or their parents or
children may be deported. People afraid to be harassed because they simply look different. I heard it at the last
meeting in Tustin and was shocked; a women stating Foothill didn't look the same as when she attended. I
could only read between the lines that it had more darker complected kids then before. Another said she saw
graffiti on million dollar homes, assuming it was an illegal immigrant that perpetrated that crime. In fact every
bit of crime committed was attributed to people who should be "deported." No facts to back these
assumptions up.
Is this what we call progress? This cannot happen under our watch, in my opinion.
I pray you thoughtfully consider this vote next Tuesday. Even the recommendation of the city attorney and
manager stated under SB54 the city of Tustin is safer, yet they ultimately recommended opposition. Please
make this a vote of conscience, not of partisan politics. Let Tustin remain a community of compassion and
inclusivity. You will not be letting criminals roam the street, but instead letting community programs do their
job and letting ICE do its job. You will be voting to stand with support of the California Values so many of your
constituents support. Please support SB54. We will stand with you too.

Re: Information Pertaining to the Sanctuary State Issue Before the Tustin City Council
I would like to present to you a document relevant to Agenda Item 16 for the September 4 City
Council meeting.
There have been two predominant arguments advanced earlier this year in opposition to the new
state sanctuary law, SB 54. It has been asserted that the law is unconstitutional under the
Supremacy Clause for being in conflict with federal immigration law, and it has been asserted
that the law endangers public safety in that it shields from federal immigration authorities
inmates being released who might otherwise be subject to deportation. In the latter case, the
argument was necessarily speculative, as the government had, as yet, no knowledge respecting
the actual effects of the new law.
Now, however, there is some concrete evidence of the actual effect of the law.
In a June 14, 2018 Media Release, the Orange County Sheriff's Department revealed the early
results of the new sanctuary state law mandates: In SB 54's first five months (January -May
2018), the department released 316 inmates with ICE detainers to ICE custody, and it released
from custody 414 inmates with ICE detainers whom it did not turn over to ICE due to SB 54
protections accorded to unauthorized aliens. Of the 414 who were released, 45 of them have
already been rearrested by the sheriff s department, on 80 charges.
In the sanctuary state law's first five months, then, 11% of the inmates that ICE wanted to take
directly into custody but who were shielded from ICE action due to sanctuary state protections
have already been rearrested.
Among the 80 charges are 2 attempted murders, 1 kidnap for sex crimes, 1 child abduction, 3
assault and batteries, 1 robbery, 4 spousal batteries, 4 assaults with a deadly weapon, 5 DUIs, 1
DUI causing injury, 1 cruelty to child/child endangerment, 2 hit/runs, 1 hit/run causing injury,
and 21 possessions of drugs/drug paraphernalia.

The sheriff s Media Release said, "On average, the 45 individuals were out of custody for 41
days, with one individual who had been out of custody just two days when he was arrested on
suspicion of assault with a deadly weapon and attempted murder," The release noted that the 45
individuals represented only crimes committed in Orange County and only bookings into Orange
County jail; it is possible that persons released have been arrested in other jurisdictions.
The release said that SB 54 provides sheriffs with discretion to respond to ICE requests for
notification of pending releases of specified serious offenders, and the OCSD fully exercises that
discretion. In the five-month period, all 316 inmates who were reportable to ICE were released
to ICE custody. So the OCSD is denying to ICE only the cooperation that SB 54 forbids.
Per the Media Release, SB 54 put an end to the OCSD's participation in the federal 287(g)
program, under which all inmates were screened for their immigration status and where
appropriate had detainers placed on them. The 287(g) program "resulted in the identification of
dangerous individuals not previously on the radar of the federal government."
As mentioned, the OCSD released 414 inmates that ICE wanted, and let ICE take 316. The total
number of ICE detainers, then, was 730. (This 730 number for total detainers, and the 11%
number for those rearrested, are my calculations.)
I have attached a copy of the Orange County Sheriff s Department's June 14, 2018 Media
Release containing the sanctuary -effected release and re -arrest numbers.
The document is still available at the sheriff s website at the Latest News & Highlights page,
using "view archives" and going back to the June 14, 2018 date.
Statistics like these may be very useful in the fight to protect the public from the effects of SB 54
and other sanctuary state legislation. I recommend that your resolution opposing SB 54 include a
request that the sheriff publish statistics every six months (after the end of June and after the end
of December) like those the department published on June 14. On July 27, I spoke with
Undersheriff Don Barnes about the possibility of periodic release of the kind of sanctuary state
statistics that OCSD released on June 14, and I got the impression that the OCSD has no
particular plans to release such statistics in the future.

Senate Bill 54 results in release of 414 criminals, 45 have re -offended in OC
SANTA ANA, Ca. (June 14, 2018) - California Senate Bill 54, which took effect on January 1, 2018, placed
restrictions on collaboration between local custody operations and federal law enforcement authorities. These
communication restrictions have resulted in 45 criminals with federal detainers re -offending following their release back
into the community.
The restrictions in SB54 prohibits the Orange County Sheriff's Department (OCSD) from notifying ICE of the pending
release of certain undocumented offenders with federal detainers. From January 1, 2018 to May 31, 2018, 414
individuals with ICE detainers have been released due to the fact that their charges or convictions did not rise to the
level of crime authorized for communication under SB 54 and the TRUST Act. Of those 414 offenders, 45 individuals have
been re -arrested for a variety of crimes including drug charges, driving under the influence (DUI), theft, child abduction
for sex crimes, spousal battery, assault with a deadly weapon, and attempted murder.
"SB54 provided the opportunity for criminals to be released back into the communities they continue to prey upon,"
said Undersheriff Don Barnes of the Orange County Sheriff's Department. "Open communication amongst law
enforcement at the local, state and federal level is a widely accepted public safety best practice. We must be able to
communicate with our law enforcement partners on issues of public safety. Failure to do so endangers our community."
On average, the 45 individuals were out of custody for 41 days, with one individual who had been out of custody just
two days when he was arrested on suspicion of assault with a deadly weapon and attempted murder. It is important to
note that the 45 individuals identified only represent crimes committed in Orange County and who were booked into
the Orange County Jail. It is entirely possible that others released committed crimes in other jurisdictions.
Below is an outline of all charges for the 45 individuals. Note that many individuals were charged with more than one
crime, so the total number of charges is higher than 45.

SB54 does provide sheriffs with the discretion to respond to ICE's request for notification of the pending release of
specified serious offenders. Orange County Sheriff Sandra Hutchens has chosen to fully exercise that discretion. From
January 1, 2018 to May 31, 2018, 316 inmates who fell within the provision were released to ICE custody. Unfortunately
this number only represents 43 percent of inmates with ICE detainers. Additionally the law resulted in ending OCSD's
participation in the federal 287(g) program. Under this program, OCSD deputies were trained to screen all inmates for
their immigration status and place detainers on undocumented offenders. This program resulted in the identification of
dangerous individuals not previously on the radar of the federal government.
The Orange County Sheriff's Department wants to remind the community that our cooperation with ICE occurs only
within a custody setting. Our deputies who patrol the community do not, and never will, enforce immigration law when
interacting with the community on the street, responding to a call for service or assisting a victim. All criminal offenders,
including those who are undocumented, will be held accountable to the utmost extent of the law.
"We need the community to be co -producers of their own safety," said Undersheriff Barnes. "We have an obligation to
protect all the residents of Orange County, regardless of their citizenship status. The only way we can continue to
remain one of the safest counties in the nation is to have individuals tell us when crime is occurring in your
neighborhood. Do not allow the false narrative that deputies will enforce immigration law within our communities stop
you from reporting crime."

Immigrants in this community take ESL and Citizenship Preparation classes, computer and basic education courses at
Tustin Adult School, where, in the past twenty years, I have been working as an ESL/Citizenship and high-school subjects
teacher. Students come from Asia, Africa, Central and South America as well as Europe and the Middle East. In addition
to impressive academic progress, many long-lasting friendships create a network with demonstrable benefits to our
community. All of us have learned a lot from the classes and especially from each other.
Most immigrants want to live here to be near their family members. Parents emphasize that in the U.S. there are better
opportunities for their children's education and their family's future. Over the years, I have met people, from places like
Syria, who have lost property and freedom and want to stay here for their safety. My students reach their ambitious
goals, working at jobs and studying in school with impressive motivation and admirable energy.
In the last year and a half, many immigrants in my classes, even if they are legal permanent residents, talk about their
high level of stress. Obtaining citizenship has become more and more difficult due to the stated requirements of English
fluency and knowledge of U.S. government and history, but especially because of the discretionary power of
interviewers, some of whom seem unduly harsh in their interpretation of an applicant's worthiness. ICE has increased
its presence in our local area, doing sweeps that terrorize authorized as well as non -authorized immigrants. Many fear
the possibility of coming home to learn about a family member or friend detained or deported. News stories of children
in cages cause all people, citizens or not, to wonder what our country's "liberty and justice" creed actually means.
I know you care about Tustin and want to serve its people. Please make Tustin a city of inclusion, a place where people
can be educated with confidence that our local government values and protects the dignity of every resident. Please
keep Tustin a sanctuary city.

Dear Chuck,
I know the Tustin City Council will be voting about staying a sanctuary city on Tuesday. I
certainly hope and pray that will be a positive vote.
Thousands of immigrants in the Tustin area have participated in ESL and citizenship preparation
classes at St. Paul's Episcopal Church on Wass Ave. I had the privilege of teaching the
citizenship preparation classes for a number of years. The hardest part of learning a new
language is speaking and so in addition to teaching about our history and government, the
students were asked to talk with our class about their home country, why they came here, their
food, culture and life style, etc. Students were from Asia, Africa, South America and Europe and
we all learned a lot from each other.
The number one reason that most of them came here is so they could live with family
members. The second reason was some of them had experienced persecution and loss of
property from their homeland government and they came here for safety reasons. We helped
them learn important basic things like how to make a doctor's appointment and what to say to
the doctor or nurse. We asked what they needed help with. Never was there a request from
the hundreds of students I worked with to receive welfare or any government assistance.
I taught and was an administrator for over thirty years in the Garden Grove Unified School
District, home to a large number of immigrants.
I have remained friends with a number of teachers and administrators in GGUSD. They have
reported that many of the immigrant students have been living in a nightmare situation during
the last year and a half. They are so scared that one or both or their parents are going to be
deported and they will be separated from them. Their high stress level is readily apparent and
they share their fears with their teachers.
ICE has always arrested and deported immigrants here who have committed crimes as they
should. But the changes in recent times is people who have lived here for many years and had
a minor problem like an accident years ago, are being arrested and deported. Some haven't
committed any crimes but are being falsely accused. Although this may sound impossible to
believe, we just have to remember how immigrant infants, children and teens have been
separated from their parents and placed in cage -like structures with no system of tracking
family members.
I know you are a good Christian man. This vote is a "what would Jesus do" moment. It was
simple what Jesus did and profound. He loved everyone and reached out to help those who
needed it. Please vote to keep Tustin a sanctuary city. Please share this letter with the other
city council members.

Subject: Tonight's meeting - being a sanctuary city
To all members of the Tustin City Council:
I am not able to attend the meeting tonight (September 4, 2018), but I respectfully request that Tustin remain a
sanctuary city consistent with the State of California.
We all have friends and neighbors who are themselves and/or have family members who are undocumented,
and are living with constant apprehension and fear of the possibility of deportation. These are good people,
hard working, who are here with the hopes of making better lives for themselves and their families, and some
are in very real danger should they return to their countries of origin.
The city of Tustin, the police department of Tustin, should not be in the position of rounding up or handing over
people to the federal government because of their immigration status. I am sure the Tustin Police Department,
in their desire to "provide the highest level of police services to a dynamic and diverse Tustin" would appreciate
good communication and a trusting relationship with all our residents.
As a long-time resident here, and as a person of faith, I hope and pray that you will make a just decision tonight,
one that will best serve our diverse community.

Mayor to sign Resolution Number 18-66 reaffirming the City's March 22, 2017 letter of opposition to SB 54; and to approve and
authorize the Mayor to sign Resolution Number 18-67 declaring the City's support to repeal Proposition 47 (the "Reduced Penalties for
Some Crimes Initiative").
