ZONING ADMINISTRATOR MEETING

1. CONDITIONAL USE PERMIT (CUP) 2018-00008 AND DESIGN REVIEW
(DR) 2018-00014

LOCATION: 165 Lockwood Park Place
REQUEST:
A request to demolish an existing garage with an unpermitted second dwelling unit
and construct a new 452 square-foot garage with attached 598 square-foot guest
quarters.
ENVIRONMENTAL STATUS:
This project is categorically exempt (Class 3) pursuant to Section 15303 of the
California Environmental Quality Act.
RECOMMENDATION:
That the Zoning Administrator adopt Zoning Administrator Action No. 18-005,
approving CUP 2018-00008 and DR 2018-00014 to:
1) Demolish an existing 302 square-foot, two-vehicle detached garage with
a 601 square-foot general purpose room that had been converted into an
unpermitted living area; and
2) Construct new detached 452 square-foot, two-vehicle garage with
attached 598 square-foot guest quarters with no cooking facilities.
It was noted there were no members of the public in attendance for this item.
The applicant, Nathan Chivers, was present.

The Zoning Administrator stated she had reviewed the staff report and requested
Jessica Aguilar, Assistant Planner, present the item. The Zoning Administrator then
asked Aguilar if the proposal would demolish the existing detached garage, in order
to establish a new detached garage with guest quarters, which Jessica Aguilar did
confirm. Aguilar also provided a modified Finding EA within the ZAA to the Zoning
Administrator and the applicant, which they reviewed.
The Zoning Administrator opened the Public Comments Section of the Public
Hearing.
Mr. Georg Suchsland, resident of Lockwood Park Place, asked questions which
generally included: definition of guest quarters and if there would be a bathroom and
shower; the proposed project might be permanently occupied; he asked if the City
would be checking in periodically on the project.
In response to Mr. Suchsland's questions, the Zoning Administrator stated the
following in general: she provided a description of guest quarters which has a
bathroom and shower, with no kitchen facility and is a living quarter that must work
with the main structure; an accessory dwelling unit can have a kitchen facility and
can operate independently from the main structure; she confirmed that the proposed
guest quarters could be permanently occupied and is supposed to operate as a guest
quarter; once the City finals the building permit, the project is complete and would
need no further inspection; there will be a deed restriction that identifies that it is not
a separate unit.
Aguilar added that the guest quarter cannot be rented or leased.
The Zoning Administrator asked Mr. Chivers if he had the opportunity to review ZAA
18-005, including the Conditions of Approval. Mr. Chivers did review and he did not
have any concerns, but he did ask if staff would provide the language for the deed
restriction. Per the Zoning Administrator, staff could provide the language for the
deed restriction. Mr. Chivers also asked when the City would want the deed
restriction. The Zoning Administrator stated the City would want the deed restriction
prior to the issuance of the building permit.
The Zoning Administrator closed the Public Comments Section at 10:03.
The Zoning Administrator adopted ZAA 18-005.
The Public Hearing item was closed at 10:04 a.m.
